HomeMy WebLinkAbout100 - Dept. of Public Works Approval - Regulating Traffic Upon Public StreetsORDINANCE N0, 100 AN ORDINANCE OF THE CITY OF COSTA MESA AMENDING ORDINANCE N0, 44, ENTITLED "AN OR IMUCE OF THE CITY OF COSTA MESA REGULATING TRAFFIC UPON THE PUBLIC STREETS AND REPEALING ALL OTHER ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREhC YM o The City Council of the City of Costa Mesa does ordain as followst SECTION ld There is hereby added to Article II of Ordinance No, 44 of the City of Costa Mesa, a new section as follows: "Section 37. Any provision of this Ordinance which regulates traffic or dolegates the regulation of traffic upon State highw.Vs in arr way for w0hi.ch the approval of the Drop ai"U. t of 'ublic Works is required by State lata, shall cease to be operative six (6) months after receipt by the City Council of written notice of withdrawall of approval of -the Department of Public Works, "Whenever this Ordinance delegates authority to a city officer, or authorizes action by the City Council to regulate traffic upon a State highway in eW way which by State lair requires the prior approval of the Department of Public Works, ;no such officer shall exercise such authority nor shall such action by the City Council be effective with respect to any State highway without the prior Approval, in writing of the Department of Public Works in and to the extent required by Division 9 and Division 31 of the Vehicle Code." SECTION 2. (Urge) This Ordinance is adopted as an urgency ordinance. The facts constitut- ing the urgency are as follows: That the City Council of tip. City of Costa Mesa is without adequate control of parkin on the State highway within the City of Costa Mesa, Present parkin; on said highway is constituting a traffic hazard and it is necessary for the protection of life and property that this Ordinance be effective immediately in order that approval of the State may be obtained to regulate parking on said highway. SECTION 30 This Ordinance shall take effect immediately and within fifteen (15) days thereafter, this Ordinanco, together with the names of the members of the City Council voting for and against the same, shall be published once in the Costa Mesa Globe Herald, a newspaper printed in the City of Costa Mesa., PASSED .SND ADOPTED this 8th day of August, 19550 ATTESTt Mayo oY EH55M-6-3?
