SPECIFTCATIONS FOR WORTS, That certain document on file in the office of the City Clerk being marked and designated as 14State of California, Depar�mwb of Public Works, Division of Highways Standard Specifications" dated January 30, 1951, co, -misting of three copies in book fora, is hereby adopted as the standard specifications of the City for the construction, maintew-mce and rep&4.r of streets and all streets ahall be constructed, maintained and repaired in accordance till the said standard specifications and the 0ireations, provisions and requirezrents therein set forth and contained, together faith the provisions of Ordinance No. 37 of the City of Costa Mesa. SECTION. 2. HODD=IATION. The City Engineer msq modify, vary or in- crease the said standard specifications relating to the surfacing and sub- snrfacing of the streebe, the thickness of the surface, the composition of the aggregate and the gmmiXy of oil required when, because of the grade or the texture of the soil or of the surfacing 4wmos.niNif -1- or subsurfacing materials such modification variation or increase is required in order to secure a surface or sub- surface that will withstand the wear in traffic anticipated,, ARTICLE II OBSTRUCTION OF THE STREETS AND SIDEWALKS, ETC, PROHIBITED SECTION to OBSTRUCTING STREETS AND SIDEWALKS, It is prohibited and therefore unlawful to obstruct the free passage or use of any portion of any roadway., of any street or of any sidMlalk without first obtaining a permit to do so from the Street Superintendent; providing that nothing herein contained shall be deemed to prevent the obstruction of one-half the width of any gide-walk not exceeding two hours in any one day for the receipt of or delivery of merchandise„ SECTION 2„ OBSTRUCTIONS ACROSS DITCHES AND GUTTERS,, It is prohibited and therefore unlawful to construct or maintain any dam or obstruction in or across any public waste water or storm water ditch, channel or gutter, in said City or to construct or maintain over and across any such ditch, channel or gutter any bridge, crossing or covering without permission being first obtained frolu th6 Street Superintendont„ SECTION I, IRR IGAT I OAT A14D STORM WATER TO BE CONTROLLED It is prohibited and therefore unlawful to allow or permit any irrigation water (except from lawns% storm water drained from buildings or water drained from swirmn,ing pools to run upon or over the surface of any sidewalk in said City or upon or into the roadway of any street therein except in the gutters thereof or properly controlled channels Which may be approved at the discretion of the Street Superintendent SECTION 1�� PLACING OIL ON STREETS, It is prohibited and therefore unlawful to place, cause or permit to be placed or discharged, any oilo petrolaini, naphtha., liquid, asphaltum$, gasoline, kerosene, or any kindred substances„ or water mixed with any such substances into any sewer, public or otherwise, -2- 0 P or 3n or upon any street or sidewalk in said City, or upon any private property so that the same will or may run into or upon any such street or side;zalk., or to drive or permit or allow to be ch iven, run or propelled any vehicle or machine carrying, in bulk or otherwise,, any such substances, upon the streets of said City, un3ess the same shall be contained within such vehicle in such a manner that said substances cannot be spilled, dropped, leak or drip from said container, or from drip pans attached to said vehicle or container. All vehicles traversing City streets carrying more than the normal amount of vehicular fuel for the normal operation of said vehicle and all commercial vehicles carrying explosives,, explosive liquids or gases shall, at all times, carry fire extinguishes appropriate to the material carried as approved by the Fire Chief or State Fire Marshal, SECTION 5. ERECTION OF SIGNS, It is prohibited and therefore unlawful to erect or maintain any sign or sign device over or upon any street or sidewalk. or to paint„ paste, or in any way affix any sign or poster or notice or advertise- ment upon any street, sidewalk,, or private property-, without the consent of -',Le o nei°,y i_n the case of public property, without the consent of the City Council., provided that said sign or signs may be erected or maintained in accordance vrith applicable portions of Ordinance No,, 32,, SECTION b. AWNINGS,, It is prohibited and therefore unlawful to erect or maintain over any sidewalk, any awning,, any part of which is less than seven (7) feet above the side- walk„ Awnings will be constructed in accordance with the provisions of the Uniform Building Code sdopted by said City of Costa Mesa. SECTION L BARBED WIRE FENCES„ It is prohibited and therefore unlawful to construct or maintain any barbed wire fence or thorn bearing hedge along the line of any street in said City,, SECTION 8. TRITC41NG Or. TREESo It is prohibited and therefore unlawful to permit the branches or foliage of any tree„ plant, hedge or bush growing on private property to obstruct the free passage of vehicles in the roadway of any st-roet or of pedestrians upon the sidewalk portion thereof, or to hang over such portion of sidewalk within seven (7) Beet of the surface thereof„ SECTION 9, CWTING TREES, It is prohibited and therefore unlawful to out or permit the cutting of any tree or the roots or branches thereof,; being or growing upon any street in said City, or to in any manner injure or impair the growth of life thereofs, without first obtaining a permit to do so from the Street Superintendent, SECTION 10, EXCESSIVz" NOISE. It is prohibited and therefore unlawful to make or cause to be made any excessive or loud noise of any source or music upon any street within the City limits of this City, except as may be otherwise permitted by laws, or by permit from the Police Chief:, SECTION 11, MERCHANDISE ON SIDMIALKS, It is prohibited and therefore unlawful to block or obstruct or make unsafe for travel on the sidewalk or streets of said City with merchan- dise for sale, storage, display or advertisement, or refuse and debris, or containers therefor, or to install or retain any appurtenances to buildings extending over public property unless specifically permitted herein. ARTICLE I]:I EXCAVATION OF STREETS SECTION 1, EXCAVATIONS, FILLS„ OBSTRUCTIONS UPON OR INJURY TO STREETS., WITHOUT PERI= PROHIBITED„ No person shall make any excavation, tunnel or bore in or under the surface or any street, construct, erect,, place., or repair any facility or equipment ing upon, along,, across,, under or over any street, or remove any facility or attached equipment from any street; repair, construct, reconstruct,, erect or make any street betterment in9 upon9 along,,.across., under or over any street or remove any street betterment from any street when such work is done or performer: by or at the instance and request of the owner of the real property abutting said street where such street betterment is to be repaired constructed., re- constructed,, erected or made, or removed,, destroy or remove any street improvement in,, upon, along, across, under or over any street; construct, leave, place, or maintain any obstruction in, upon,, along, across or over any street; drive or operate a vehicle over any curb or sidewalk located upon any street at a point other than where a driveway has been constructed or otherwise approved unless he shall have first obtained a permit hereunder as hereinafter provided, SECTION 20 APPLICATION FOR PER1,11TS: TIME FOR FILING, Applications for permits hereunder shall be filed not less than fort? -eight (48) hours before the work is proposed to be done. SECTION 3, FORM OF APPLICATION FOR PERMIT. Applica- tions for permits required by this Ordinance shall be filed with the Street Superintendent upon printed forms to be prescribed and supplied by him. The application shall be signed by the applicant and shall state: (a) The name and address of the applicant; (b) The location., purpose, extent and nature of the proposed obstruction (c) The time during which it is estimated that the excavation, fill or obstruction will exist„ (d) That the applicant agrees to indemnify., defend and save the Citys its authorized agents, officers,, representatives and employees., harmless from and against any and all penalties, liabilities or armzoyanees or loss resulting from claims or court action and arising out of any accidents loss or daneige to persons or property happening or occurring as a proximate result of any work undertaken under the permit granted pursuant to the application; (e) That the applicant agrees that if any tank,, pipe, conduit,, ducts, tunnel or other installation of any nattixe or ?rind placed in the excavation,, fill or obstruction ?dor which the permit is issued which shall at anytime in the future interfere with the uses repair„ i-mprovoment, widening or change of grade of the streets the applicant,, or his successors or assigns within ben (10) days after receipt of a written notice from the Street Superintendent to do so,, will at his own cost- either os+either rom..ove such tank, pipes, conduit„ duct, tunnel or other installation, or, subject to the approval of the Street Suporinter_dent, relocate them to a site which may 'be designated by the Street Super',-ntendent (f) Any additional information which the Street Superintendent r a,3 deem necessary for the proper disposition of the application. SECTION 4E - FILING OF PLAT., The application shall be accampanied b7 a plat showing the looation, dimension, nature of the proposed excavation,, obsti�uetion or fill, and any other detail which the Street Superintendent mag require,. SECTION 5, PROOF OF RIGHT TO USE STREET„ Each applicant for a permit shall submit to the Street Superintendent satisfactory proof of the applicant's right to use the street for the purpose set forth in the application, SECTION 6,, MPODIFICATION OF APFLICATION I4AY BE REQUIRED, The Street Superintendent may require s;.ich changes in the application respecting the location,, dimensions, character or number of the proposed excavations, fills or obstructions as in his opinion may be necessary for tho protection of the street,, the prevention of undue interference with traffic, or to assure the safety of persons using the street. SECTION 7F STREET SUPERIVMNDENT MAY ELECT TO D0 THE RESURFACi?`*4. The Street Superintendent may9 either at the time of the issuance of the permit or at any time thereafter, elect to do the resurfacing or repair of any street surface �6� 1%el 1%� removed or damaged by the proposed excavation or obstruction pursuant to a permit hereunder. SECTION 8�. ISSUANCE FEE,, Each application for a permit shall. bs acco.rpanied by an .issuance fee of Two Dollars (y""'2,,00), no part of which shall be returned to the applicant, regardless of the action taken on the application,, SECTION 9,, SPECL41, DEPOSIT OF COSTS REQUIRED: COMPUTA, TION THERE OF o (a) Unless the Street Superintendent shall. have authorized the applicant to perform this resurfacing or repair of the sLrfaee of any street which may be removed In, part or damaged by the proposed excavation, rill„ or obstruction., each applicant shall., in addition to the issuance fee, deposit with the Street Superintendent the estimated cost of resurfacing or repairing the surface of the street Vaich may be damaged or'destroyed4 'The special deposit required hereunder shall 9n''na ` 4veri be'' 1:es the ten dollars (;W1O�60), The estimated cost shall be detexzm ned by the Street Superintendent by multi pl.ping the number of square feet of surface which may be damaged, as shown by the application, by the cost to the City square foot. per :b) in cases where the applicant- is granted authority to make the repairs required under this Ordinance, the Street Superintendent may, In order to insure the completion of said repairs in a satisfactory manner, require the applicant to furnish a Surety bond. The condition of said bond shall. be that the applicsnnt will parf'orra the work authorized by any pexmit issued pvrsiisnt to this Ordinance ,in a good and workman. 11ke manne„ and to the satisfaction of the Street Superintendent,, 7, (c) Whenever an applicant is authorized to make or perform any portion of the necessary repairs to any street pursuant to this Ordinanco, the applicant shall, in addition to other fees and oosts, be required to pad- the actual engineering and inspection costs incurred by the City to insure the making of the repairs In a workmanlike and satisfactory manner. To secure the payment of such costs, the applicant shall, In addition to the poralt fee and other fees required by this Ordinances deposit with the Street Superintendent an amount estimated by the latter to be equal to twice the actual cost of all necessary engineering and inspection costs;, Engineering and inspection costs shall include the wages of the Engineering and/or Inspector for the time actually spent in connection with the Permitteeas operation, plus expenses of transportation, plus fifteen (15) percent of the total wages to cover overhead items,, The deposit ragyired Under this Subsection may, with the approve) of the Street Superintendents, be effected through a charge against or deduction from azy Hands maintained as a tgeneral deposit? authorized by Section 10 of this Ordinance or with the approval of the Street Superintendent, the payment of said fees nay be secured through any surety bond posted by the applicant under the provisions of this Ordinance SECTIOh1 10 � RIGH' OF A PPLICAMP TO MAKE GENERAL DEPOSIT (a) In lieu of making the special deposit required by Section 9, the applicant may mare and maintain with the Street Superintbndent a general deposit in an amount estimated by the Street superintendent to be sufficient to pay for the cost of permit issuance fe©s and effected repairs occasioned by future excavations or obstructions, but not to exceed Five Hundred Dollars (0500.00). (b) In lieu of tho special deposit required by Section 9 or of making the general deposit as provided .for in -8- Subsection (s) of this Section, the applicant may, with the approval of the Street Superintendent,, :':garnish a surety bond conforming in all respects to the requirements for surety bonds set forth in Subsection (b) of Section 9. except that the condition of such bond shall be that the applicant will pay to the City upon demand all fees,, -costs,, or charges incurred by or cue to the City under the provisions of this Ordinance. SECTION 11, COMPUTATION OF COSTS,. Wherever in this Ordinance any costs aro to be charged to any Permittee and no other method for the caleniation thereof is specified& such costs shell be the actual cost, including the proportion- ate part of the salaries, wagon or other compensation of any deputy or employee, plus the cost of overhead,, not to exceed fifteen (15) percent of the total cost SECTION 12, EXEMPTION OF PUBLIC AGENCIES FROM DEPOSITS. If the United States, this Stater this or any other county;, any maxnicipal corporation.o school district or other public body files with the Street Superintendent a written guaranty of payment of all costs for which they may become liable to the City hereunder, then no deposit for costs shall be required from such persons. rdo permit issu.anco :dee shall be required of any public agency entitled to exemption therefrom pursuant to Section 6103 of the Goverment Cod© of the State of California... SECTION 13,, ISSUANCE OF PER1iIT,, If the applicant for a permit hereunder caAplies in all respects with this Ordinance and with all other applicable laws, rules, regulations or ordinances of the City or of any other public agency and pays the fees acid deposits required by this Ordinance, the Street Superintendent shall approve the application and issue the permit, SECTION ll�. CONDITIONS OF PERT'., The permit shall_ be subject to the following conditions which shall be stated thereon: (a) The permit must be kept at the site of the work r and be shown, on demand, to any authorized repx'esentative of the City or any law enforcement officer (b) The permit shall authorize work to be performed only as to such portior cif the street over -vfnich theCity of Costa Mesa has juridiction„ (e) All work shall be performed in accordance with provisions of this Ordinance and of all applicable laws, rules and regulations of the City and any other public agency and to the satisfaction of the Street Superintendent,, (d) The permit shall be non -transferable,, (e) The Street Superintendent may cancel the permit unless the work authorized therein is commenced within thirty" 51 -0) days of the issuance of the permit and thereafter, in the opinion of the Street Superintendent,, is diligently prosecuted to completion Cancellation_ may be effected by giving written notice thereof by sending the same to the applicant by ordinary mail to the address shown on the applica- tion. (f) The Street Superintendent may, either at the time of the issuance of the permit or at any time thereafter until the completion of the work, prescribe such additional conditions as he may deem reasonably necessary for the protection of the street or for the prevention of undue interference with traf YI.a or to assure the safety of persons using the street, SECTION 15. COMPLIANCE WITH TERMS OF' PERTITIT REQUIRED A permittee shall not make or cause to be made any excavation or construct, place upon$ maintain, or leavy any obstruction or impediment to travel$ or pile or place any material in or upon any street, or install or maintain or cause to be installed or maintained any tank, pipes conduit., duct, or tunnel, in, upon or under the surface of any street,, at any location, or in miy manner other t1han that descr'bed n the application as approved by the Street Supt3rintendent, or contrary to the terms of the permit or of any provision of this Ordinance, SECTION 16,, RESTORATION OF STREET UPON COMPLETION OF WORK. Immediately upon completion of the work necessitating the _10- excavation or obstruction authorized by any permit Issued pursuant to this Ordinance,, the permittee shall promptly and in a workmanlike manner refill the excavation or remove the obstruction to the satisfaction of the Street Superintendent, If any permittee fail: or refuses to refill any exeamation which he has made or remove any obstruction which he has placed on any street, the Street Superintendent may do so and the applicant shall promptly reimburse the City the coast thereof. SECTION 17® RESURFACING BY PERMTEE OR CITY AND SPECIFI_CA.TIONS THEREFOR, Upon completion of the refilling of the excavation and the removal of the obstruction, the permittee shall promptly resu?:,face or repair any portion of the street surface removed or damaged by the excavation or obstruction, or the Street Superintendent may, at his option, elect to do the resurfacing or repairing himself. Where the pavement or surface has been removed, the permittee shall replace it to a thickness of one inch (10 greaterrthan that of the surrounding pavement or surface and, in no event, to and one-half (22) a thickness less than MAN inches. Where a treated or • modiffied s bgrada or surface has been removed or destroyed the permittee shall replace it to a thickness of not less than that of the surrounding or adjacent subgrade or surface, unless the Street Superintendent orders that the repair of such treated or modified subgrade or supface -shall be made by an oil and rock mixture, in which case the thickness shall not be less than one-half the thickness of the treated or modified surfact or subgrade ,, SECTION 18. COST OF RE.SURrACIWG TO BE BORNE BY PERYLTTEE, If after the refilling of zsn excavation the permittee fails or refuses to resurface or repair that portion of the surface of the street damaged by hims or if the Street Superintendent has elected to do such resurfacinG or repairing, the Street Superin- tendent shall do so and the permittee shall be charged with the cost thereof computed by the Street Superintendent as provided in Section 9 or Section it of this Ordinance, whichever, in the I ♦ • m judgement of the Street Superintendent gill most fairly compensate the City for the ei�penses incurred by its. SECTION 19. COST OF FUR TRER REPAIRS TO BE PAID BY PERMITTEE. If at any time subsequent to the: first repair of a surface of a street damaged or destroyed by any excavation or obstruction of such street, it becomes necessary again to repair such surface due to settlement or any other cause directly attributable to such excavation or obstruction, the permitteo shall pay to the City the cost of such additional repairs made by the Street Superintendent,, The cost shall be computed by the Street Superintendent as provided in Section 9 or Section 11 of this Ordinance, trhichever,, in the judgement of the Street Superintendent will most fal-oly compensate the City for the expenses incurred by its, SECTION 20, TRAFFIC TO EF KEPT OPEN. Trenching for installation across any Intersecting roadway open to traffic shall be progressive. Not more than one -'calf (1/2) of the width of a traveled tray shall be disturbed at one time and the remaining width shall be kept open to traffic -by bridging or backfilling. SECTION 21t, W_ONING LIGHTS OR TORCHES AND SIGNS REQUIRED.
