BACKGROUND: Senate Bill 1 (SB 1), the Road Repair and Accountability Act of 2017, (Chapter 5, Statutes of 2017) was passed by the Legislature and signed into law by the Governor in April 2017 to address the significant multi-modal transportation funding shortfalls statewide. SB 1 increases several taxes and fees to raise over $5 billion annually in new transportation revenues. Moreover, SB 1 makes adjustments for inflation every year so that the purchasing power of the revenues does not diminish as it has historically. SB 1 prioritizes this funding towards critical maintenance, rehabilitation, and safety improvements on state highways, local streets and roads, and bridges and to improve the state’s trade corridors, transit, and active transportation facilities. As codified in the Streets and Highways Code (SHC), RMRA local streets and roads allocations must be used for projects that include, but are not limited to: • Road maintenance and rehabilitation • Safety projects • Railroad grade separations • Traffic control devices • Complete street components, “including active transportation purposes, pedestrian and bicycle safety projects, transit facilities, and drainage and storm-water capture projects in conjunction with any other allowable project” At the September 19, 2017 meeting, the City Council adopted a Resolution amending the FY 2017-18 Budget to approve a list of projects proposed to be funded with RMRA revenues. Subsequently, the approved project list incorporating the 2 (two) street improvement projects – Newport Boulevard Frontage Road (northbound), from 15th Street to 17th Street, and 23rd Street, from Elden Avenue to Waterman Way – was submitted to the California Transportation Commission (CTC). The street improvements to Newport Boulevard Frontage Road (northbound) are well underway and improvements to 23rd Street are being designed. 2 As part of SB 1’s various accountability and transparency measures, and according to the CTC’s March 2018 Adopted Annual Reporting Guidelines for Local Streets and Roads Funding Program, the City is required to submit annually a proposed project list to the CTC by May 1st of each year and subsequently provide year end updates on the progress and expenditures of previously proposed projects by October 1st of each year. ANALYSIS: It is estimated the City will receive $1,893,820 in FY 2018-19 from RMRA funding. To be eligible for funding, the City must submit a proposed project list to the CTC by May 1, 2018, along with an adopted resolution documenting the City Council’s approval of the projects proposed to be implemented with specific RMRA funding allocations. The City is proposing that the FY 2018-19 RMRA funding be allocated to 2 (two) new street improvement projects that would not have otherwise been funded – Bear Street Improvements, from I-405 to Baker Street, and Fairview Road Improvements, from I-405 to Adams Avenue. To meet SB 1’s eligibility and reporting requirements, the $1,893,820 of RMRA funding must be specifically differentiated from Highway Users Tax Account (HUTA) for each project utilizing RMRA funds, and requires such projects to include the following components: project description, specific location, proposed schedule for its completion, and the estimated useful life. These required project components are reflected in the Resolution. The 2 (two) projects will also be proposed to the City Council for approval as part of the FY 2018-19 Capital Improvement Program budget adoption. ALTERNATIVES CONSIDERED: One alternative is to not adopt the Resolution. However, this alternative is not recommended as it would result in the City not receiving RMRA funding for future road maintenance and rehabilitation. FISCAL REVIEW: The City anticipates receiving $1,893,820 in FY 2018-19 from RMRA funding based on the January 2018 State Department of Finance statewide RMRA revenue projections. Pursuant to the CTC’s March 2018 Adopted Annual Reporting Guidelines for Local Streets and Roads Funding Program, staff recommends the adoption of a Resolution adopting a list of projects for FY 2018- 19 proposed to be funded with Road Maintenance and Rehabilitation Account (RMRA) revenues. The projects’ specific RMRA funding allocations are reflected below: FY 2018-19 Proposed RMRA Funded Projects Program/Project Name Gas Tax (RMRA) Fund Bear Street Improvements, from I-405 to Baker Street $715,000.00 Fairview Road, from I-405 to Adams Avenue $1,178,820.00 Total RMRA Funding $1,893,820.00 The City will reflect this accordingly in its FY 2018-19 proposed Capital Improvement Program budget. It will enable the City to continue essential road maintenance and rehabilitation projects and increase access and mobility options for the traveling public that would not have otherwise been possible without SB 1; and WHEREAS, the City used a Pavement Management System to develop the SB 1 project list to ensure revenues are being used on the most high-priority and cost-effective projects that also meet the community’s priorities for transportation investment; and ATTACHMENT 1 WHEREAS, the funding from SB 1 will help the City maintain and rehabilitate two local streets and roads and provide resources for similar projects in the future; and WHEREAS, the 2016 California Statewide Local Streets and Roads Needs Assessment found that the City’s streets and roads are in an overall good condition, with some streets identified in poor condition, and this revenue will help the City increase the quality of such streets and assist in bringing our citywide streets and roads into an excellent condition; and WHEREAS, the SB 1 project list and overall investment in our local streets and roads infrastructure, with a focus on basic maintenance and safety, investing in complete streets infrastructure, and using cutting-edge technology, materials and practices, will have significant positive co-benefits statewide.
