RECOMMENDATION
1. Approve and authorize the Mayor and the City Clerk to amend professional service
agreements for contract building plan check and contract building counter permit
technicians with the companies of Scott Fazekas & Associates Inc., Bureau Veritas,
Melad & Associates, lnterwest Group, VCA Code, HR Green, Permit Management
Solutions and JAS Pacific. Also approve and authorize the Mayor and the City Clerk to
execute one-year professional service agreements for contract building inspection
services with the companies of JAS Pacific, lnterwest Group, Bureau Veritas, VCA Code
and Safebuilt. The additional requested amount for contract building plan check, contract
counter permit technicians and contract building inspections services is $103,584 in
addition to the current contract amount of $107,938, as budgeted for FY 2017-2018. The
same consultants for building plan check and contract building contract counter permit
technicians are providing contract fire plan checking for a total aggregate amount up to
$142,000 as budgeted for FY 2017-2018 with no change to this amount.
2. Authorize the City Manager and the City Clerk to renew the agreement for four (4)
additional one-year periods upon mutual written agreement of both parties.
BACKGROUND
The Development Services Department and Fire Department operations require the
continued use of contract plan check and inspection services in order to provide building
safety and fire prevention services in a timely and efficient manner. The Building Division
continues to be focused heavily on on-going and upcoming major projects such as the
Lions Park project, 393-unit Symphony Apartments project, The Press project (former LA
Times building), Fire Station One, and South Coast Plaza, along with several projects of
highly complex structural design, which require additional and specialized services from
consultants now and in the future.
The contract consultants will be providing inspection and counter technician staff at an
hourly rate in accordance with their contracts. The plan check service is typically a fee-
based City plan check fee which is based on valuation of construction. The scope of plan
check services includes standard plan review, where contract plan check consultants
receive up to 75 percent of City collected plan check fees. The scope of the contracts
also includes an applicant-requested option for expedited plan check service where a
plan check consultant provides a premium accelerated plan check for time sensitive
projects. In such cases, the applicant pays the consultant a higher fee in accordance with
their contract for accelerated plan checks. For expedited plan check only, applicants also
pay the City an additional 25 percent of plan check fees as an administrative and quality
control fee. This process would remain unchanged.
For the last three calendar years, the Building Division averaged approximately 3,000
permits annually that require counter processing, plan check and inspections. Table 1
shows a three-year average annual count of the various types of permits the Building
Division processes.

Figure 1 - Trend in Building Permit Activities Since 2010
On April 12, 2017 the Purchasing Division advertised Request for Proposal (RFP) No.
17-12 for Inspections Services. As required by the Costa Mesa Municipal Code (CMMC),
the RFP was sent to qualified vendors, published in the Daily Pilot Newspaper and
posted on the City’s website. Also on May 19, 2017 the Purchasing Division advertised
RFP No. 17-22 for Plan Check and Permit Processing Services. As required by the
CMMC, the RFP was sent to qualified vendors, published in the Daily Pilot Newspaper
and posted on the City’s website.
The criteria used in evaluating the proposals received were: company experience and
capabilities, approach and methodology, staffing, qualification and cost proposal.
In order to ensure a fair and objective RFP process, the evaluation process was
conducted by the Purchasing Division. An evaluation committee was assembled and all
members were instructed to conduct their evaluations independently of each other. The
evaluation committee included representation from the Development Services and the
Fire Departments.
The evaluation phase for RFP No. 17-12 Inspection Services began on May 9, 2017,
with an initial meeting to distribute the proposals and evaluation forms and to provide an
explanation of the evaluation phase and expectations. Similarly, the evaluation phase for
RFP No. 17-22 Plan Check and Permit Processing Services began on June 14, 2017..
Based on the City’s criteria and award procedures set forth in the RFP, the evaluation
committee recommended that the agreements be awarded to the most qualified
consultants listed below:
Plan Check and Counter Services
1. Interwest Consulting Group, Inc.
2. Scott Fazekas & Associates
3. Melad & Associates, Inc.
4. Permit Management Solutions
5. Bureau Veritas North America, Inc.
6. The Code Group dba VCA Code
7. HR Green California, Inc.
8. JAS Pacific
Building Inspection Services
1. JAS Pacific
2. lnterwest Group
3. Bureau Veritas
4. VCA Code
5. Safebuilt
The proposed total amount for all contracts was $107,938 for the Building Division. Even
with the additional amount requested of $103,584, this is the lowest amount in over five
years. Figure 2 illustrates the payments made to consultants since 2013.
Figure 2 - Annual Payments to Building Division Consultants Since 2012 (*2017-2018)
Upon completing planned recruitments, the Building Division will maintain a core staff
that will be adequate during less busy times and will rely on consultants to handle
overflow plan check and inspection services during busy times, as well as for highly
specialized tasks. There are advantages and disadvantages to in-sourcing and
outsourcing. By having the option to do both, a greater degree of customer service,
flexibility and efficiency can be achieved. Multiple consultants are chosen for the same
purpose in order the best match a consultant’s staffing to the task needed, as well as to
improve the chances of finding contract staff during times of increasing construction
activities.
Copies of the PSAs with each of the above firms are attached. Most service costs are
recoverable and are designed as a percentage of the City's collected plan check and
inspection fees, thereby leaving adequate remainder for the City's administrative cost to
provide services.
Sufficient funds are proposed in the Development Services Department and Fire
Department budgets for the proposed agreements.
ALTERNATIVES CONSIDERED
The alternative to the proposed City Council action would be to not move forward with
the contracts for the stated consulting services. Due to the volume of work and large
number of projects currently being handled by Development Services and Fire
Department staff; a significant lack of timely inspections, plan check and permit
processing services would be experienced.
FISCAL REVIEW
The additional amount request comes directly from salary savings due to unfilled
positions. It does not require any additional funding beyond the budget of the Building
Division.
Consultant services for plan checking and inspections are utilized by the Development
Services and Fire Departments on an as-needed basis. Most of the consultant fees are
paid from fees collected by the City for either plan check or inspections. The
consultant’s fee is a percentage of the fee collected by the City with the remaining
portion of the fee used to cover administrative and overhead costs of the City. Therefore,
the majority of such costs is paid by the project applicant.
The compensation is an aggregate amount not an annual amount as stated in the
PSA’s.
LEGAL REVIEW
The attached professional services agreements are those provided by the City Attorney
and are "approved as to form."
CONCLUSION
Use of contract plan check and inspection services continues to be a cost effective
means of providing certain Building Safety and Fire Prevention services. The use of core
City staff supplemented by contracts for certain services is common practice for cities
throughout the State. Accordingly, staff recommends the City Council approve increasing
contract amount by $103,584 in addition to the currently authorized contract amount of
$107,938, as budgeted for FY 2017-2018 for contract counter permit technicians and
contract building inspections services.
