THE VTOLATTON THFRFOF, ANI' REPFALTNG ORD- INANCE NO, 1911. The City Council of the City of Costa Mesa does ordain as follows: - SECTION 1. Section 8 of Article II of Ord=nance No. 42 is hereby amended to read as follows: - "Section 8. FTNLTCENSED, TTNTAO(',ED DOGS AT LARGE. It shall be unlaz,7ful for any person owning or having charge, care or control of any dog, to permit such dog to be kept upon any prendses under his immediate control unless such dog shall be registered as herein provided and shall have attached to it by means of a collar or harness a metal dog tap as described in Section 6." SFCTTnN 2. Section 11 of Article TIT of Ord2lnance No, b2 is hereby amended to read as fol -lows: - "No person owning, having charge, care or control of any dog shall perr1t any dog to be on any public street or any public place in the Citi, of Costa Mesa unless such dog is under restraint and control. Any person, firm or corporation violating any provision of this Section shall be punishable as follows: - a) For the first offense, a citation shall be issued to the owner, warning that any subsequent violation may subject such person to a fine. b) For the second offense within one ,year of the issuance of such citation, by a fine of not less than $C.00 or more than $l[.00. c) For third and subsequent offenses within six months of a second conviction, by a fine of not, less than �i1r.00 and not more than rpc�0.00." SFCTTON 3. Section 12 of Article TTI of Ordinance No. h? is hereby amended to read as follows:- IrWhen written complaint signed by two or more people, that any flog within the City of Costa Mesa is comidtting a nuisance by reason of barking, hording, growling, running; or charging at or after any person or vehicle or destroying, or molesting private or public property or roaming or runnincr at lar,e upon private or public property or for any other reason affecting public peace, security, health, quietude, welfare or safety, such dog may be declared by the City Pounctnaster to be a public nuisance and written notice of such declara- tion shall be delivered to the person owning or having charge or control of such - dog, and thereafter such dog shall be securely tied or kept in an enclosure or on '.eash, and may be destroye.i by the Poundlaaster, if running, at large.t1 . MIACTMENT; This Ordinance shall take effect' and be in full force and effect thirty (30) days after its passage, and prior to the ex- piration of fifteen (15) days from its passage shall be published once in the Costa Mesa Globe Herald., a newspaper of general circulation, printed anal published in the City of Costa Mesa, together wit -h the names of the members of the City Council voting; for and against the same. City Clerk and ex -officio Clerk of the City Council of the City of Costa Mesa rI" LEGAL NOTICE ORDINANCE NO. 162 AN ORDINANCE OF THE CITY OF COS- TA MESA AMENDING ORDINANCE NO. 42 OF TIIE CITY OF COSTA MESA ENTITLUD: AN ORDINANCE OF THE CITY OF COSTA MESA PROVIDING FOR THE LICENSING AND IMPOUND- ING OF DOGS: REGULATING T II E KEEPING AND CONTROL OF DOGS: THE CONTROL AND SUPPRESSION OF RABBIS AND OTHER INFECTIOUS AND CONTAGIOUS DISEASES: PRO- ViDING PENALTiES FOit THE VIO- LATION THEREOF: AND REPEAL- YNG ORDINANCE NO. 19." The Ctv Council of the City of Costa Mesa does ordain as follows: SECTION 1. Section 3 of Article II of Ordinance No. 42 is hereby amended to read as follows: "Sect,on 8. UN?:I, ^NSFD. SECTION 2. SECTION 11 of Article III of Ordinance No. 42 is hereby amended to read as follows: "No person owning, having charge, care or control of any dog shall permit any dog to be on any public street or any pub- lic place in the City of Costa Mesa unless such dog is under restraint and control. SECTION 12 of Article III of Ordinance No. 42 is hereby amended to read as follows: - "When written complaint signed by two or more people, that any dog within the City of Costa Mesa is committing a nui- sance by reason of barking, howling, growling, running or charging at or after any person or vehicle or destroying or molesting private or public property or roaming or running at large upon private or public property or for any other reason affecting public peace, security, health, quietude, welfare or safety, such dog may be declared by the City Poundmaster to be a public nuisance and written notice of such declaration shall be delivered to the person owning or having charge or con- trol of such dog, and thereafter such dog shall be securely tied or kept in an en- closure or on leash, and may be de- stroyed by the Poundmaster, if running at large." SECTION 4. SECTION 14 of Article IV of Ordinance No. 42 is hereby deleted. SECTION 5. SECTION 28 of Article IX of Ordinance No. 42 is hereby amended to read as follows: - "SECTION 28. PENALTY. Any firm, person or corporation violating any of the provisions of this Ordinance, except the provisions of this Ordinance contained in Section 11 of Article III, shall be deemed guilty of a misdemeanor and upon convic- tion thereof, shall be punished by impri- sonment in the City or County jail for a period of not more than three (3) months, or by a fine of not more than Three Hundred Dollars ($300.00), or by both such fine and imprisonment." SECTION 6. ENACTMENT: This Ordin- ance shall take effect and be in full force and effect thirty (30) days after its pass- age, and prior to the expiration of fifteen (15) days from its passage shall be pub- lished once in the Costa Mesa Globe Her- ald, a newspaper of general circulation, printed and published in the City of Costa Mesa, together with the names of the members of the City Council voting for and against the same.
