AN ORDINANCE OF THE CITY OF COS-
TA MESA, CALIFORNIA AMENDING
ORDINANCE NO. 32, ENTITLED "AN
ORDINANCE OF THE CITY OF COSTA
MESA ESTABLISHING LAND CLASSI-
FICATIONS IN DISTRICTS WITHIN
THE INCORPORATED TERRTORY OF
THE CITY OF COSTA MESA AND
REGULATING THE USES OF PRO-
PERTY THEREIN, ADOPTING A MAP
OF SAID DISTRICTS, DEFINING THE
TERMS USED IN THIS ORDINANCE,
PROVIDING FOR THE ADJUSTMENT,
ENFORCEMENT AND AMENDMENT
HEREOF, PRESCRIBING PENALTIES
FOR VIOLATION HEREOF, AND RE-
PEALING ORDINANCES AND PARTS
OF ORDINANCES INCONSISTENT AND
IN CONFLICT HEREWITH."
The City Council of the City of Costa
Mesa, California, does ordain as follows: -
SECTION 1. There is hereby added to
Ordinance No. 32 a new Article VII -A, as
follows: -
"ARTICLE VII -A."
C -1-S — SHOPPING CENTER. DISTRICT
The Shopping Center District Designated
as C -1-S is intended to serve as a shop-
ping center for the convenient needs of a
neighborhood area anti to provide for the
development of a planned and organized
group of compatible retail sho ,s grouped
u .der a commonly designed Master Plan
of a designated area.
Thefollowing regulations shall apply in
the C -1-S Shopping Center District:
SECTION 1: USES PERMITTED:
1. Administrative and Professional Of-
fices.
2. Employees' cafeterias or auditoriums.
3. Bowling alleys.
4. Retail Clothing Shops.
5. Bakeries.
6. Drug Stores.
7. Department Stores.
8. F:etail walk-in restaurants.
S. Grocery stores.
SECTION If. USES PEI1,112TTED SUB-
JECT TO USE PERMIT. Uses permitted
subject to first securi-p a '_'sc Permit
in each case from the Planning Commis-
sion. Said Uses shall comply with the
limitations and restnetiors of the C -1-S

. Any such other uses as the Council,
after review by the Commission may de-

neighborhood stores. Such uses shall not
be obnoxious to surrounding property nor
be specifically listed in a less restrictive
district.
SECTION ID. USES EXPRESSLY PRO-
HIBITED:
1. Residential uses.
2. Churches.
3. Industrial uses.
4. Public address systems and -or loud-
speakers outside of any buildings.
5. Existing residential structures. No
existing residential structure in this dis-
trict may be converted into any more in-
tensive residential use or to any other 1,
uses than that existing on the effective date
of this Ordinance and no such existing
building shall be used for both residential
' and non-residential purposes at the same
time.
6. Out Door Uses: All sales and storage
shall be conducted within a totally enclosed
building constructed in conformity with the
Building Regulations of the City, except-
ing, however, that certain outdoor com-
mercial developments such as plant nur-
series and eating pavilions may be per-
mitted when site plans for said develop-
ments and the relationships to the total
plan for the Shopping Center District have
been submitted to and have been approved
by the Planning Commission.
SECTION IV. PROPERTY DEVELOP-
MENT STANDARDS. The following Pro-
perty Development Standards apply to all
land and -or structures in the C -1-S District.
1. Yards:
(a) Front yard. There shall be a front
yard of not less than 20 feet extending
across the full width of the lot.
(b) Side yard. Side yards shall be a mini-
mum of 20 feet on one side only except
where said district abuts a residential dis-
trict the side yard shall then be not less
than 50 feet provided wall requirements
are complied with as set forth below:
(c) Yards adjacent to Residential Dis-
tricts. Whenever a lot or parcel of land
in the C -1-S District abuts a lot or parcel
of land in a residential district or abuts
an alley or street which separates a C -1-S
Shopping Center District from a Residen-
tial District, a setback of not less than
50 feet from property line of Shopping
Center District shall be provided for any
yard (side, front or rear); in addition, a
solid masonry wall shall be erected to a
height of not less than 5' - 6" nor more
than 6' from finished grade, not more than
10' from the Shopping Center District pro-
perty lines.
2. Building Height: None.
3. Area Requirements: Minimum of five
(5) acres.
4. Off -Street Parking:
(a) A minimum of 75% automobile park-
ing, including ingress and egress, to 25 is
total floor area shall be maintained for
customer and employee parking.
(b) Ingress and egress shall be ap-
proved by the Planning Dept.
(c) Parking stalls shall be a minimum
of 9' x 20' and shall be so installed to cre-
ate a 4' pedestrian safety aisle between
each parking lane.
(d) The applicant shall submit for ap-
proval a traffic flow chart within the con-
fines of the Shopping Center to the Traffic
Commission of the City of Costa Mesa for
its approval.
(e) Loading and delivery zones shall be
clearly marked and truck entry and exit
shall be approved by the Planning Com-
mission.
(f) The Traffic Commission may re-
quire the installation of traffic lights at
prescribed intersections in accordance with
standards of the City of Costa Mesa.
5. Walls. A six foot high solid masonry
wall shall be erected along the property
line or District boundary line to separate
the C -1-S Shopping Center District and -or
uses from abutting residential uses.
6. Other requirements.
(a) The Planning Commission may re-
quire the perimeter adjoining public
streets to be improved and maintained in
accordance with the standards of the City
of Costa Mesa.
(b) Lighting of parking areas shall be
so installed as to not direct a beam or ex-
cessive light onto any abutting residential
area.
(c) Rubbish shall be confined and nec-
essary protective health requirements shall
be installed.
(d) Reflection pools, fish ponds or other
similar devices if constructed shall not be
more than 6" in depth.
(e) Air conditioning units if installed
shall be of the type that re -uses its own
water and cooling towers shall be con-
structed so as to be hidden from view.
7. Frequency of District. The location of
C -1-S Districts shall be determined by
studies of the purchasing power available
to support the uses permitted in the dis-
trict. Said districts should not, however,
be closer than one (1) mile from any
other C -1-S District already established.
SECTION V. APPLICATION TO THE
PLANNING COMMISSION. Before a build-
ing permit shall be issued for any im-
provements on said C -1-S Shopping Center
District, the applicant shall submit to the
Planning Department five days prior to the
next regular Planning Commission meet-
ing a master plot plan clearly indicating
all of the requirements hereinbefore stated
and which will show the type of structure
or structures to be built and location of
said structures. The Planning Commission
shall thereupon impose the conditions
which will guarantee compliance with the
intent and purpose and all provisions of
this Article.
The City Planning Commission shall de-
signate such condition as it deems neces
sary to fulfill the purpose of this Article
and may require such guarantees and
evidence that such condition shall be or
will be complied with.
SECTION VI. ENACTMENT: This Ordin-
ance shall take effect and be in full force
and effect thirty (30) days after its pass-
age, and prior to the expiration of fifteen
(15) days from its passage shall be pub-
lished once in the Costa Mesa Globe -Her.
