A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
COSTA MESA, CALIFORNIA, APPROVING PLANNING
ACTION PA -94-08.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE
AS FOLLOWS:
WHEREAS, an application was filed by Thomas Steinfeld, authorized agent for Arnold
Beckman, with respect to real property located at 394 Magnolia Street, requesting a Conditional
Use Permit for excess garage area in an R zone; and
WHEREAS, a duly noticed public hearing was held by the Planning Commission on
February 28, 1994; and
WHEREAS, an interested party filed an appeal of said Planning Commission decision
on March 7, 1994; and
WHEREAS, the City Council held a duly noticed public hearing on March 21, 1994;
NOW, THEREFORE, BE IT RESOLVED that based on the evidence in the record and
findings contained in Exhibit "A", and subject to the conditions contained in Exhibit "B", the
City Council hereby APPROVES Planning Action PA -94-08 with respect to the property
described above.
BE IT FURTHER RESOLVED that the Costa Mesa City Council does hereby find and
determine that adoption of this resolution is expressly predicated upon operation of the activity
in the manner described in the staff report for Planning Action PA -94-08, and upon applicant's
compliance with each and all of the conditions contained in Exhibit "B". Should any
material change occur in the operation, or should the applicant fail to comply with the conditions
of approval, then this resolution, and approvals herein contained, shall be deemed null and void.
PASSED AND ADOPTED this 21st day of March, 1994.

EXHIBIT "A
CITY COUNCIL FINDINGS:
1. If the property were to be developed to Code, it would be more objectionable than that
which has been proposed by the applicant.
2. The project substantially complies with Municipal Code Section 13-347.
EXHIBIT "B"
CONDITIONS OF APPROVAL
Planning 1. Approval of the Planning Action is valid for one (1) year and will expire at the
end of that period unless building permits are obtained or the applicant applies for
and is granted an extension of time.
2. Street address shall be displayed on the fascia adjacent to the main entrance or
front door in a manner visible from the public street. Numerals shall be 6 inches
in height with not less than 1/2 -inch stroke and shall contrast sharply with the
background.
3. All new construction shall be architecturally compatible with regard to building
materials, style, colors, etc., with the existing structure(s). Plans submitted for
plan check shall indicate how this will be accomplished.
4. The Conditions of Approval and Ordinance or Code Provisions of Planning
Action PA -94-08 shall be blueprinted on the face of the site plan.
5. The applicant is reminded that a "Special Requirements" inspection of the site will
be required prior to the release of occupancy/utilities. This inspection includes
confirmation that the Conditions of Approval and Code/Ordinance Provisions have
been satisfied.
6. A Land Use Restriction shall be recorded to inform current and future property
owners that a maximum of one dwelling unit may exist on the property; no
portion of either garage may be used for living purposes unless incorporated as
an integral part of the existing dwelling. Additionally, the Land Use Restriction
shall include provisions limiting all car repair or related activities to inside the
garage only and to private vehicles owned by the property owner only.
7. Painting of vehicles on the site is prohibited.
CODE REQUIREMENTS
The following list of Federal, State, and local laws applicable to the project has been compiled
by staff for the applicant's reference.
Planning 1. All contractors and subcontractors must have valid business licenses to do
business in the City of Costa Mesa. Final occupancy and utility releases will not
be granted, and final inspections will not be granted until all such licenses have
been obtained.
Building 2. Comply with the requirements of the Uniform Building Code as to design and
construction.
Engr. 3. A Site Access permit and deposit of $350.00 will be required by the City of Costa
Mesa, Engineering Division, prior to the start of any on- or off-site work, which
may be necessary during construction for street sweeping.
Fire 4. Provide an approved smoke detector to be installed in accordance with the 1991
Edition of the Uniform Fire Code.
