HomeMy WebLinkAbout93-101 - Home Investment Partnership AgreementT OF 302 RESOLUTION NO. 93-101 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, APPROVING THE HOME INVESTMENT PARTNERSHIP AGREEMENT PROVIDING FOR THE REHABILITATION OF CERTAIN MULTI -FAMILY RESIDENTIAL PROPERTY LOCATED IN THE CITY. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AND FIND AS FOLLOWS: WHEREAS, the City of Costa Mesa ("City") has received funds from the United States Department of Housing and Urban Development ("HUD") pursuant to the Federal Government's HOME Program, 42 U.S.C. Section 12701 et seq.; and WHEREAS, pursuant to the HOME Program and the HOME Regulations, 24 CFR 92, the City may provide financial assistance to qualified developers to acquire and rehabilitate multi -family residential real property; and WHEREAS, the City desires to enter into a Home Partnership Investment Agreement with Civic Center Barrio Housing Corporation ("Developer") to provide financial assistance to Developer for acquisition of certain real property located within the City, to rehabilitate the eleven (11) multi -family rental units thereon, and to assure the long-term affordability of the units to persons and families of very low and low income. NOW, THEREFORE, the City Council of the City of Costa Mesa, California does hereby resolve as follows: 1. The City Council finds that the proposed Project is categorically exempt under the California Environmental Quality Act (CEQA) (California Public Resources Code Section 21000 et seq.) pursuant to Section 15301 of the CEAQ Guidelines, and that all applicable requirements of the National Environmental Policy Act of 1969 associated with the Project have been satisfied. 2. The City Council approves the Home Investment Partnership Agreement No. M92-MC060509 by and between the City of Costa Mesa and Civic Center Barrio Housing Corporation ("Agreement") attached hereto and incorporated by reference herein and authorizes and directs the Mayor to execute the Agreement upon final approval by the City Attorney as to form and further authorizes the City Attorney, subsequent to execution by the Mayor, to make such corrections and minor revisions as deemed necessary and appropriate to implement the Agreement. 3. The City Council further authorizes the City Manager to approve additional expenditures of HOME Program Funds in an amount not to exceed Four Thousand Dollars ($4,000.00), if necessary, to cover the administrative costs associated with the review and inspection of the rehabilitation work to be completed by the Developer on the Property pursuant to the terms and conditions of the Agreement.
