HomeMy WebLinkAbout93-86 - Approving Planning Action PA-90-55A3204 RESOLUTION NO. 93-86 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, APPROVING PLANNING ACTION PA -90-55A3. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, an application was filed by Mike Gray, authorized agent for Triangle Square Joint Venture, with respect to real property located at 1875 A-111 Newport Boulevard, requesting an amendment to a Planned Signing Program in the PDC zone•, and WHEREAS, a duly noticed public hearing was held by the Planning Commission on September 13, 1993; and WHEREAS, Vice Mayor Humphrey filed a request for Council review of said Planning Commission decision on September 17, 1993; and WHEREAS, the City Council held a duly noticed public hearing on October 4, 1993; NOW, THEREFORE, BE IT RESOLVED that based on the evidence in the record and the findings contained in Exhibit "A", and subject to the conditions contained in Exhibit "B", the City Council hereby approves Planning Action PA -90-55A3 with respect to the property described above. BE IT FURTHER RESOLVED that the Costa Mesa City Council does hereby find and determine that adoption of this Resolution is expressly predicated upon operation of the business or activity in the manner described in the Staff Report for Planning Action PA -90-55A3 and upon applicant's compliance with each and all of the conditions contained in Exhibit "B". Should any material change occur in the operation, or should the applicant fail to comply with the conditions of approval, then this Resolution, and any approvals herein contained, shall be deemed null and void. The information presented satisfies the conditions set forth in Section 5-122 of the Costa Mesa Municipal Code in that the proposed Planned Signing Program Amendment, as modified by staff, is consistent with the intent of the Sign Code and approval does not constitute a grant of special privilege or allow greater visibility than standard ordinance provisions. Specifically, sign allocation, letter height and placement of signs for the tenant will be consistent with signs for other major tenants at this site and total sign area for the Triangle Square project will not substantially increase. B. The project has been reviewed for compliance with the California Environmental Quality Act (CEQA), the CEQA Guidelines, and the City environmental procedures, and has been found to be exempt from CEQA because the project has no possibility of causing a significant effect on the environment. �zss EXHIBIT "B" Planning Action PA -90-55A3 Resolution No. 93-86 CONDITIONS OF APPROVAL: Planning 1. A maximum of two (2) tower signs shall be allowed for this tenant. Sign plans submitted for sign permits shall indicate the north and south elevations for placement of each sign. 2. Street addresses shall be displayed on the ground sign (if permitted) or on the fascia or store front adjacent to the main entrance of the building, in a manner visible to the public street. Numerals shall be 12" in height with not less than 3/4" stroke and shall contrast sharply with the background. Identification of individual units shall be provided adjacent to the unit entrances. Letters or numerals shall be 4" in height with not less than 1/4" stroke and shall contrast sharply with the background. 3. The word "Megastore" shall be eliminated from signs designated as sign type A. ORDINANCE AND/OR CODE PROVISIONS The following list of Federal, State, and local laws applicable to the project has been compiled by staff for the applicant's reference. Planning 1. All contractors and subcontractors must have valid business licenses to do business in the City of Costa Mesa. Final inspections will not be granted until all such licenses have been obtained. 2. Permits shalt be obtained for all signs, including banners and other special event signing, according to the provisions of the Costa Mesa Sign Ordinance. Building 3. Comply with the requirements of the Uniform Building Code as to design and construction. J
