HomeMy WebLinkAbout93-70 - Approving Planning Action ZA-93-0341208 RESOLUTION NO. 93-70 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, APPROVING PLANNING ACTION ZA-93-03. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, an application was filed by Richard and Cristina Cendoya with respect to real property located at 3469 Fuchsia Street, requesting a Minor Conditional Use Permit to install a satellite antenna dish in an R1 zone; and WHEREAS, a duly noticed public hearing was held by the Planning Commission on July 26, 1993, at which time the said Minor Conditional Use Permit was denied; and WHEREAS, the applicant appealed the Planning Commission decision, and the City Council, on August 16, 1993, held a duly noticed public hearing on the appeal of said Minor Conditional Use Permit; NOW, THEREFORE, BE IT RESOLVED that based on the evidence in the record and the findings contained in Exhibit "A", and subject to conditions contained in Exhibit "B", the City Council hereby approves Planning Action ZA-93-03 with respect to the property described above. BE IT FURTHER RESOLVED that the City Council of the City of Costa Mesa does hereby find and determine that adoption of this resolution is expressly predicated upon the terms and conditions as described in the staff report for Planning Action ZA-93-03, and upon applicant's compliance with each and all of the conditions contained in Exhibit "B". Should any material change occur in the operation, or should the applicant fail to comply with the Conditions of Approval, then this resolution, and any approvals herein contained, shall be deemed null and void. The information presented substantially complies with Section 13-347 of the Costa Mesa Munlclpal Code in that the antenna, despite its size and height, is not visually obtrusive and thus substantially compatible with developments in the same general area and would not be materially detrimental to other properties within the area. B. The project has been reviewed for compliance with the California Environmental Quality Act (CEQA), the CEQA Guidelines, and the City environmental procedures, and has been found to be exempt from CEQA because the project has no possibility of causing a significant effect on the environment. EXHIBIT "B" CONDITIONS OF APPROVAL Planning 1. Applicant shall relocate the antenna to a less visually obtrusive location on the property under the direction of the zoning Administrator. 2.
