HomeMy WebLinkAbout93-37 - Notice to Employees before Contracting out of City ServicesRESOLUTION NO. 93-37 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, AUTHORIZING THE CITY MANAGER TO GIVE NOTICE TO EMPLOYEES SUBJECT TO CONTRACTING OUT OF CITY SERVICES. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: 1, The City of Costa Mesa and the Costa Mesa City Employees Association have entered into a Memorandum of Understanding which remains in effect relating to employee salaries, benefits, terms and conditions of employment; 2. The Memorandum of Understanding provides at paragraph 13, subparagraph B, as follows: "It is further agreed that should a decision be made to contract out for a specific service, the employees affected will be given sufficient notice (a minimum of six months) in which to evaluate their own situation and plan for their future. To this end, the City will make every effort to transfer and utilize attrition in making necessary adjustments. The City will assist employees in this endeavor through training as well as providing preferential treatment (under meritorious consideration) in filling vacancies." 3. Pursuant to the Memorandum of Understanding, the City Manager or his designee will continue to involve the Employee Associations to the greatest degree in the ongoing evaluation of City service costs and make them a part of the activities related to the contracting of City services; 4. The City Council hereby decides, effective upon the date this resolution is adopted, to contract out for the City services represented by the employee classifications listed in Exhibit A, attached hereto and incorporated herein by this reference.; 5. The City Manager or his designee is hereby authorized to provide the employees affected with six (6) months notice of the decision to contract out for the City services represented by the employee classifications listed in Exhibit A and such notice shall be in writing and given with seventy-two (72) hours of the date this resolution is adopted. 6. The City Manager will utilize the layoff policy set forth in Administrative Regulation 2.26; 7. The City Manager or his designee is hereby authorized to issue, as he deems necessary, requests for proposals for the City services represented by the employee classifications listed in Exhibit A.
