RESOLUTION NO. 93-26
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF COSTA MESA, CALIFORNIA, REPEALING
SPECIFIC PLANS SP -76-01, SP -76-03, SP -82-01/01A, AND
SP -85-01/01A.
WHEREAS, the Costa Mesa City Council adopted four (4) Specific Plans for various
locations: SP -76-01, north side of Victoria Street between Newport Boulevard and College
Avenue; SP -76-03, five areas north of the San Diego Freeway (I-405) and generally bounded
by Fairview Avenue, Sunflower Avenue, South Coast Drive, and Fuchsia Street; SP -82-01/01A,
Bristol Street, south of the San Diego Freeway (I-405) to the Corona del Mar Freeway (SR -73)
and west of the Orange County Flood Control Channel; SP -85-01/01A, all property bounded by
East 17th Street, Newport Boulevard (1600 block), East 16th Street, and Orange Avenue; and
WHEREAS, these Specific Plans were adopted by Resolution Nos. 81-88, 81-93, 82-38,
82-88, 85-83, and 86-65 (Exhibit "A"); and
WHEREAS, these Specific Plans provided additional standards and guidelines for
development; and
WHEREAS, the goals that were sought through the conditions of Specific Plans SP -76-
01, SP -76-03, and SP -82-01/01A have been achieved; and
WHEREAS, the 1990 Costa Mesa General Plan, adopted March 16, 1992, and the
current Zoning Ordinance contain more restrictive policies and requirements than many of the
conditions set forth in the Specific Plans, in particular SP -85-01/01A; and
WHEREAS, the Costa Mesa Planning Commission has recommended that Specific Plans
SP -76-01, SP -76-03, SP -82-01/01A, and SP -85-01/01A be repealed; and
WHEREAS, the City Council, after hearing all the evidence, deems it to be in the best
interest of the City that said Specific Plans be repealed.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Costa Mesa
that said Specific Plans SP -76-01, SP -76-03, SP -82-01/01A, and SP -85-01/01A and respective
Resolution Nos. 81-88, 81-93, 82-38, 82-88, 85-33, and 86-65 are hereby repealed.
BE IT FURTHER RESOLVED that this project was determined to create no significant
environmental impacts and therefore found to be exempt from the California Environmental
Quality Act.

WHEREAS, the City Council of the City of Costa Mesa adopted the
Bristol Street Specific Plan, S11-82-01, for property located along Bristol
Street between the San Diego and Corona del Mar freeways on May 3, 1982,
by adoption of Resolution No. 82-38; and
WHEREAS, there has been presented to Lire Costa Mesa City Council
certain amendments to the Bristol Street Specific Plan (Specific Plan
SP -82-01A) for properties located not -Lb of Paularino Avenue and east of
Bristol Street; and
WHEREAS, the Costa Mesa Planning Corrurrission has recommended the
adaption of said Specific. Plan SP-112-OIA; and
WNLIiLAS, a public hearing on the adolrl.ion of said Specific Plan has
been duly held and conducted by the Costa Mr,sa City Council on Novendrer
15, 1982; and
WHEREAS, tire City Council, after, hearing all the evidence. deems it
to be in the best interest of the City that said Specific Plan SP-82-OIA
be approved, ratified, and adopted as recommended by the Planning
Commission as set forth below:
Specific Pian Amendments SP-82-OIA
A. Amendment 1: Building Height Interpretation
Mechanical penthouses which conform to the following guidelines
shall be permitted to exceed the 85 -foot freight limit established
for properties located east of Bristol Street, north of Paularino
Avenue:
1. Mechanical penthouses shall not extend more than 15 feet
above the roof of the building upon which it is located.
H. Mechanical penthouses shall not cover more than one-third of
the total roof area of the building upon which it is located.
Ill. Mechanical penthouses shall not encroach into the adopted
setback plane or the extension of the adopted setback plane
to the height of the mechanical penthouse.
A. Amendment 11: Floor Area Ratio
Increase the maximum permitted floor area ratio from 0.80 FAR to
0.85 FAR for properties located east of Bristol Street, north of
Paularino Avenue.

WHEREAS, the City (buncil, after hearing all the evidence, deems it to
be in the best interest of the City that said Specific Pian Pmencinent be
approved, ratified, and adopted.
NCM, THEREFORE, BE IT RESOLVED by the City Council of the City of
Costa Mesa that said Specific Plan AmerKinent SP-85-U1A, for property within
all area bordered by Newport lk)-ulevard, Fast 17th Street, orange Avenue, am]
East 16th Street, and slx)wn in "SP -85-01 arri SP -85-01A, Specific Plan for.
the 1600 Block of Newport Boulevard", is hereby approved, ratified, and
adopted, and by this reference made a part hereof;
BE IT FINALLY RESOLVED that the Negative Declaration prepared for
Specific Plan SP -85-01 is considered adequate for Specific Plan Ametyinent
SP -85--01A.
