Home My WebLink About90-86 - General Municipal Election Held on Nov. 6, 1990RESOLUTION NO. 90-86 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, RECITING THE FACT OF THE GENERAL MUNICIPAL ELECTION HELD IN SAID CITY ON NOVEMBER 6, 1990, DECLARING THE RESULT THEREOF AND SUCH OTHER MATTERS AS ARE PROVIDED BY LAW. MEREAS, a General Municipal Election was held and conducted in the City of Costa Mesa, California, on Tuesday, November 6, 1990, as required by law; arca WEREAS, pursuant to Resolution No. 90-57 adopted July 2, 1990, the election was consolidated with the Statewide General Election and the Registrar of voters of the County of Orange canvassed the returns of said election and has certified the results to this City Council, said results are received, attached as "Exhibit A"; and WHEREAS, notice of said election was duly and regularly given in time, form, and manner as provided by law; and that in all respects said election was held and conducted and the votes cast thereat, received and canvassed and the returns made and declared in time, form, and manner as required by the provisions of the Elections Code of the State of California. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIF- ORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE, AND ORDER AS FOLLOAS: SECTION 1. That there were 78 Voting Precincts plus 3 Absentee Pre- cincts established for the purpose of holding said election consisting of the regular election precincts in said City as established for holding State and County elections. SECTION 2. That the whole number of Precinct Ballots cast in the City was 22,278; the number of Absentee Ballots cast was 3,768; and that the number of Total Ballots cast was 26,046. SECTION 3. That the names of persons voted for at the election for Member of the City Council are as follows: JAY HUMPHREY, ARLENE SCHAFER, ORVILLE AMBURGEY, PETER BUFFA, and KAREN L. MCGLINN. SECTION 4. That the measures voted upon at the election are as follows: MEASURE "V" Shall Section 2-68 of the Costa Mesa Municipal Code be amended by adding Subsection (g) to read as follows: For purposes of this Section, a financial interest as defined by the Act shall also include any campaign contribution of five hundred dollars ($500.00) or more from a contributor or the agent of a contributor in the twelve (12) month interval prior to the date on which the decision involving the con- tributor is to be made. No city council member shall accept, solicit, or direct a contribution of five hun- dred dollars ($500.00) or more from any party or his or her agent, while a proceeding involving a license, permit, or other entitlement for use is pending be- fore city council and for three (3) months following the date a final decision is rendered in the pro- ceeding if the council member knows or has reason to know that the participant has a financial interest, or that tern is used in the Political Reform Act of 1974, as amended (Article 1, Chapter 7, commencing with Section 87100 of the California Government Code)? C[ 14 MEASURE "W" ADVISORY VOTE ONLY Should the City of Costa Mesa continue to permit the sale and discharge of State Safety Approved fireworks by nonprofit organizations with the City of Costa Mesa? SECTION 5. That the number of ballots given at each precinct and the number of votes given in the City to each of the persons above named for Member of the City Council, and for and against the measures, were as listed in Exhibit A" attached. SECTION 6. The City Council does declare and determine that Peter Buffs was elected as Member of the City Council of said City for the full term of four years; and Jay Humphrey was elected as Member of the City Council of said City for the full term of four years. That as the result of the election, a majority of the voters voting on Measure "P' did vote in favor of it, and that the measure was carried, and shall be deemed adopted and ratified. That as the result of the election, a majority of the voters voting on Advisory Measure "W" did not vote in favor of it, and that the measure was not carried, and shall not be deemed adopted and ratified. SECTION 7. The City Clerk shall enter on the records of the City Council of said City, a statement attached as "Exhibit B", of the result of said election, showing: (1) The whole number of votes cast in the City; (2) The names of the persons voted for; (3) The office each person was voted for; (4) The measures voted for; (5) The number of votes given at each precinct to each person and measure; (6) The number of votes given in the City to each person and measure. SECTION 8. That the City Clerk shall immiediately make and deliver to each of such persons so elected a Certificate of Election signed by the City Clerk and duly authenticated; that the City Clerk shall also adminis- ter to each person elected, the Oath of Office prescribed in the State Constitution of the State of California and shall have them subscribe thereto and file the same in the office of the City Clerk. Whereupon, each and all of said persons so elected shall be inducted into the respective office to which they have been elected. SECTION 9. That the City Clerk shall certify to the passage and adoption of this Resolution; shall enter the same in the book of original Resolutions of said City; and shall make a minute of passage and adoption thereof in the records of the proceedings of the City Council of said City, in the minutes of the meeting at which the same is passed and adopted.
