A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
COSTA MESA, CALIFORNIA, SPECIFYING THE PROCESS
FOR APPROVING AND SITING IN ORANGE COUNTY SOLID
WASTE FACILITIES REUSING OR RECYCLING LESS THAN
FIFTEEN PERCENT OF MATERIAL RECEIVED AND SERVING
ONLY ONE JURISDICTION.
WHEREAS, AS 2296 requires that on or before February 1, 1991, each
county and majority of cities containing the majority of the population in
the incorporated area in the county must adopt a resolution following a
public hearing specific to the approval and siting of solid waste facili-
ties, not identified in a previously approved County Solid Waste Management
Plan, which are designed to recover or reuse less than 15 percent of the
material received; and
WHEREAS, the Orange County Local Task Force is charged with ensuring
a coordinated and cost-effective regional recycling system pursuant to
AB 939, Article 2, Section 40950; and
WHEREAS, the Local Task Force can assist the recycling activities of
the cities by ensuring that solid waste facilities maximize the recycling
of material received within and beyond local jurisdictions; and
WHEREAS, recycling, the second priority of the AB 939 Source Reduc-
tion and Recycling hierarchy, can be accomplished efficiently only if
recyclable materials are recovered and reused and all points of entry; and
WHEREAS, solid waste reduction within the County of Orange must be a
comprehensive endeavor, requiring both private and public sector coopera-
tion and conformity with all local, state, and regional laws and regula-
tions.
NOW, THEREFORE, BE IT RESOLVED, that the City of Costa Mesa specifies
that that following process be established for approval and siting of solid
waste facilities during the AS 939 "gap" that have not been identified in
the previously approved County Solid Waste Management Plan:
A. Any individual or entity that proposes to develop a solid waste
facility in the County of Orange that recovers or reuses less than 158
of the material received and serves only one jurisdiction shall be
subject to an approval process requiring vote by the County of Orange
and a majority of the cities containing a majority of the incorporated
population in the county.
B. A facility site identification and description shall be submitted
to the Local Task Force for review and comment regarding its conform-
ity with AS 939 Source Reduction and Recycling diversion goals.
PASSED AND ADOPTED, this 21st day of January, 1991.
