HomeMy WebLinkAbout91-53 - In-Lieu Impact Fee for Acquisition of Park Land�X165 RESOLUTION NO. 91-53 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, FINDING AND DETERMINING THE POPULATION DENSITY STANDARD FOR SINGLE- AND MULTIPLE -FAMILY DWELLING UNITS, AND AMENDING THE CURRENT IN -LIEU IMPACT FEE FOR ACQUISITION OF PARK LAND WITHIN THE CITY OF COSTA MESA. THE CITY COUNCIL OF THE CITY OF COSTA MESA FINDS AND DECLARES AS !lliiilll FOLD: WHEREAS, the City Council of the City of Costa Mesa adopted Ordinances 89-28 and 91-14, amending provisions of the Costa Mesa Municipal Code relating to the dedication of land or the payment of in -lieu fees for acquisition of land for park and recreation purposes by residential sub- dividers; and WHEREAS, the City Council is required to find and determine the popu- lation density standard for single- and multiple -family dwelling units for park fee and dedication purposes as set forth in Section 13-488 of the Costa Mesa Municipal Code; and WHEREAS, the City Council is required to establish in -lieu park fees which reflect the average value of community and neighborhood park land within the community as set forth in Section 13-490 of the Costa Mesa Municipal Code; and WHEREAS, the "Costa Mesa Park Dedication and In -Lieu Fee Study of November, 1990", analyzed the authority of the City to impose park land dedication and in -lieu fee exactions for residential subdivisions and described the methodology to establish the required population density standards and park dedication and in -lieu fee requirements. The "Costa Mesa Park Dedication and In -Lieu Fee Study" was prepared by the City and is dated November, 1990; and WHEREAS, an Addendum to the "Costa Mesa Park Dedication and In -Lieu Fee Study of November, 1990" has been prepared to update information and to respond to issues raised since publication of the study. The Addendum is dated February, 1991. WHEREAS, notice of the hearing to adjust the in -lieu fee schedule was provided fourteen (14) days prior to the initial hearing on this item as required by Section 54992 of the Government Code; and WHEREAS, the "Costa Mesa Park Dedication and In -Lieu Fee Study" was made available for public review at least ten (10) days prior to the initial hearing on this item as required by Section 54992 of the Government Code; and WHEREAS, after considering the above-mentioned study and analysis prepared by the City, and the testimony received at the public hearings on this item, the City Council approves said study (including the Addendum), and incorporates it by this reference herein; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Costa Mesa that the population density standards for single- and multiple - family dwelling units shall be set as follows: TYPE OF UNIT POPULATION DENSITY STANDARD Single-family residential 3.02 persons per unit Multiple -family residential 2.07 persons per unit Aho BE IT FURTHER RESOLVED that the in -lieu park fee schedule for single - and multiple -family subdivisions shall be set as follows: TYPE OF UNIT FEE Single-family $5,748.82 Multiple -family $3,940.34 The above fees shall go into effect pursuant to the requirements of State and Local Law.
