RESOLUTION NO. 91-32
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
COSTA MESA, CALIFORNIA, DECLARING ITS INTENTION
TO ORDER THE VACATION OF A PUBLIC STREET LOCATED
AT THE SOUTHEAST CORNER OF NEWPORT BOULEVARD AND
OLD 17TH STREET.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS
FOLLOW:
SECTION 1. The City Council of the City of Costa Mesa does hereby
declare its intention to vacate a street located at the southeast corner
of Newport Boulevard and old 17th Street, more particularly described as
follows:
All that land situated in the City of Costa Mesa, County of Orange,
State of California, being that portion of Int 82, Newport Heights,
per map thereof recorded in Book 4, Page 83, Miscellaneous Maps,
Records of said Orange County, and the County mad (Newport Boulevard)
abutting said Lot 82 on the west and shown on said map, described as
follows:
Beginning at the northwest corner of that certain parcel of land
conveyed to Elin E. Myrehn by deed recorded February 9, 1940 in Book
1030, Page 185 of Official records of said Orange County, said corner
lying south 40001'08" west a distance of 135.00 feet from the north-
easterly line of said Int 82; thence, along a line parallel with and
135.00 feet southwesterly frau said northeasterly line of Lot 82,
north 49°58'52" west a distance of 34.75 feet to a point on a non -
tangent curve concave southeasterly having a radius of 140.00 feet, a
radial through said curve bears north 64032'08" west, said 140.00 -foot
radius curve being on the southeasterly line of that land conveyed to
the State of California by deed recorded May 11, 1953 in Book 2500,
Page 404 of Official Records of said Orange County; thence northeast-
erly along said southeasterly line of the land conveyed to the State
of California and said curve concave southeasterly having a radius of
140.00 feet through a central angle of 14033'16" an arc distance of
35.56 feet to a tangent line, said line being on said southeasterly
line of the land conveyed to the State of California; thence, along
said line, north 40001'08" east a distance of 82.82 feet to a point
17.00 feet southwesterly, as measured at right angles, from said north-
easterly line of said Lot 82; thence, north 49058152" west along a
line parallel and 17.00 feet southwesterly of said northeasterly line
of Lot 82, a distance of 92.45 feet to an angle point; thence south
73014'25" west a distance of 16.44 feet to a point on a non -tangent
curve concave easterly having a radius of 3935.00 feet and a radial
through said point bears north 73038'51" west and being the new east-
erly right of way line of Newport Boulevard as shown on the precise
plan of Newport Boulevard, on file with the City of Costa Mesa City
Engineer's Department in Plan No. 83-2.4 approved on May 16, 1983;
thence southerly along said 3935.00 -foot radius curve through a
central angle of 2051'11" an arc distance of 195.95 feet to the begin-
ning of a tangent curve concave northeasterly having a radius 23.00
feet; thence southerly along said 23.00 -foot radius curve through a
central angle of 117014134" an arc distance of 47.06 feet to a point
of reverse curvature with a tangent curve concave southeasterly having
a radius of 713.00 feet; and said point being on the northerly line of
new 17th Street as shown on the precise plan adopted by the City of
Costa Mesa City Council May 19, 1978 and on file in the office of the
City Engineer of said City, and a radial through said point bears
north 13°44'36" west; thence northeasterly along last said curve
through a central angle 6017143" an arc distance of 78.34 feet; thence
south 78041137" east 33.30 feet to an angle point in said northerly
line, said angle point being the beginning of a non -tangent curve con-
cave southeasterly, having a radius of 703.00 feet, being concentric
with last said curve, a radial through said angle point bears north
4°52137" west and said angle point also being on said line parallel
with and 135.00 feet southwesterly from said northeasterly line of int
82; thence leaving said northerly line and along said parallel line
north 49°58'52" west 60.41 feet to the Point of Beginning.
RESERVING THEREFROM a public use easement for all existing underground
and overhead public utilities, together with right of ingress and
egress for the purpose of maintaining, replacing, and upgrading said
existing public utilities.
SECTION 2. Monday, the 3rd day of June, 1991, at 6:30 p.m., in the
Council Chambers of City Hall, 77 Fair Drive, Costa Mesa, California, is
hereby fixed as the time and place for hearing all persons interested in or
objecting to the proposed vacation.
SECTION 3. These proceedings shall be conducted pursuant to the
provisions of Section 8300 et seq. of the Streets and Highways Code of the
State of California.
SECTION 4. The City Manager of the City of Costa Mesa is hereby
directed to cause notices of the said proposed vacation to be conspicuously
posted along said strips of land for at least two (2) weeks before the date
of said hearing. Said notices shall be posted not more than three hundred
(300) feet apart, but in no event shall fewer than three (3) notices be
posted.
SECTION 5. This Resolution shall be published twice in the ORANGE
COAST DAILY PILOT, a newspaper of general circulation printed and published
in the City of Costa Mesa, orange County, California.
