SECTION I
INTRODUCTION
This report has been prepared and is submitted for renewal to the
City Council of the City of Costa Mesa under authority of the Landscape
and Lighting Act of 1972 of the Streets and Highways Code of the State of
California.
SECTION II
BACKGROUND
This Landscaping Assessment District has been formed as a result of
Specific Plan SP -76-03. This Specific Plan set as a development standard
for the area in question that a "private mandatory homeowner's association
or landscape assessment district must be established", and that "such an
association or assessment district shall be responsible for the maintenance
of the required setbacks along Smalley Road and Sunflower Avenue".
Tract 12011 was annexed to this Landscaping Assessment District by the
City Council through the adoption of Resolution No. 84-82. A Condition of
Approval for Tract 12011 was that a private mandatory homeowners' associa-
tion or landscape assessment district be formed to establish and to main-
tain landscaped setbacks along Smalley Road similar to that in Landscape
Assessment District No. 1.
