HomeMy WebLinkAbout91-61 - Opposing Legislation to Authorize Satellite Wagering at OC Fair Grounds180 et RESOLUTION NO. 91-61 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, OPPOSING THE ESTABLISH- MENT OF SATELLITE WAGERING AT THE ORANGE COUNTY FAIRGROUNDS, AND REQUESTING THAT THE ORANGE COUNTY REPRESENTATIVES IN THE CALIFORNIA STATE LEGISLATURE OPPOSE ANY LEGISLATION TO AUTHORIZE SATELLITE WAGERING AT THE ORANGE COUNTY FAIR- GROUNDS. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, establishment of satellite wagering at this site would be incompatible with the nature of the surrounding community, which is prinmr- ily residential, and which includes two churches, two colleges, a high school, and a municipal government civic center; and WHEREAS, the City Council fears that the establishment of satellite wagering at the Orange County Fairgrounds (32nd Agricultural District) would increase traffic gridlock, parking violations, noise disturbances, litter, and other disruptions which negatively impact our communities; and WHEREAS, the Master Plan and Environmental Impact Report prepared by the Orange County Fairgrounds is currently being challenged as to adequacy; and WHEREAS, establishment of a revenue -generating satellite wagering operation is neither consistent with the mission of the 32nd Agricultural District, nor compatible with its focus on special events and community service; and WHEREAS, the survey conducted by Opinion Research of California is inadequate and represents approximately .2 percent of the community sur- veyed; and WHEREAS, the survey was prepared for the California Authority of Racing Fairs with no input from local agencies most impacted by satellite wagering; and WHEREAS, Senate Bill 945 does not require adherence to the California Environmental Quality Act (CEQA) and the establishment of satellite wager- ing on the Fairgrounds site would seriously impact the health, well-being, and quality of life in the Costa Mesa community; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Costa Mesa opposes the establishment of satellite wagering at the Orange County Fairgrounds, and conveys this to the California State Legislature. However, in the event that the Legislature determines that establishment of satellite wagering would be compatible with the mission of the Fair- grounds, and would provide a needed service to residents of the region, the City Council will request that the Legislature modify any authorizing legislation to incorporate the following two conditions: 1. That any legislation authorizing establishment of satellite wager- ing on the grounds of the Orange County Fairgrounds specifically preclude such a facility within 500 feet from any of the follow- ing: residential communities; churches, synagogues, or places of worship; public or private education institutions; and publicly dedicated open space. 2. That any legislation authorizing the establishment of satellite wagering on the grounds of the Orange County Fairgrounds require that the proposed facility be subject to all review and approval procedures that are applied to any other commercial project under Xel$7 the City's purview, and that the project include appropriate miti- gation measures, including prepayment or reimbursement for the costs of public services.
