RESOLUTION NO. 90-88
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
COSTA MESA, CALIFORNIA, ORDERING THE VACATION OF
A PUBLIC STREET LOCATED AT THE SOUTHEAST CORNER
OF NEWPORT BOULEVARD AND OLD 17TH STREET.
WHEREAS, the City Council of the City of Costa Mesa did, on the 5th
day of November, 1990, adopt Resolution No. 90-81, entitled: "A RESOLUTION
OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, DECLARING ITS
INTENTION TO ORDER THE VACATION OF A PUBLIC STREET LOCATED AT THE SOUTHEAST
CORNER OF NEWPORT BOULEVARD AND OLD 17TH STREET";
WHEREAS, pursuant to said Resolution of Intention, the time and place
for hearing all persons interested in or objecting to the proposed vaca-
tion was set for Monday, the 3rd day of December, 1990, at the hour of
6:30 p.m., in the Council Chambers of City Hall, 77 Fair Drive, Costa Mesa,
California; and
WHEREAS, notices of said proposed vacation were duly and regularly
posted as required by law, all pursuant to the provisions of Section 8300
et seq. of the Streets and Highways Code of the State of California; and
WHEREAS, on said date of hearing the proposed vacation came on regu-
larly to be heard; all persons appearing on the proposed vacation were
heard; and said hearing was closed on the 3rd day of December, 1990; and
WHEREAS, the City Council of the City of Costa Mesa finds and deter-
mines from all the evidence submitted that the hereinafter described right-
of-way is unnecessary for present or prospective street purposes;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES ORDER
AND RESOLVE AS FOLLOWS:
1. That the hereinafter described right-of-way is unnecessary for
present or prospective street purposes.
2. It is hereby ordered that the following described right-of-way
be, and the same is hereby vacated:
PARCEL 1: That portion of Lot 82 in Newport Heights, in the City of
Costa Mesa, County of Orange, State of California, as per map recorded
in Book 4, Page 83 of Miscellaneous Maps, in the office of the County
Recorder of said County, described as follows:
Beginning at the most westerly corner of said Lot 82; thence south
50°00100" east 124.05 feet along the southwesterly line of said Lot 82
to the most southerly corner of the land described in the Deed to Fred
Feinstein and wife recorded April 3, 1924, in Book 519, Page 97 of
Deeds; thence north 40000'00" east 165.15 feet to the most southerly
corner of the land described in the Deed to Emil Leonard Myrehn, Jr.,
a single man, recorded February 14, 1947, in Book 1479, Page 207 of
Official Records; thence north 50000'00" west parallel with the
southwesterly line of said Lot 82 to the westerly line of said lot;
thence southerly along said westerly line to the Point of Beginning.

PARCEL 2: That portion of Lot 82 of Newport Heights, in the County
of Orange, State of California, as per map recorded in Book 4, Page 83
of Miscellaneous Maps of said County, described as follows:
Beginning at the intersection of the easterly line of County Road (60
feet wide) with the southwesterly line of 17th Street (60 feet wide),
as shown on said map; thence along said southwesterly line, south

50015'16" east, 108.27 feet; thence south 84044'45" west, 21.21 feet;
thence south 39044144" west 84.82 feet to the Point of Tangency of
this course with a curve, concave southwesterly, having a radius of
140.00 feet; thence southwesterly, along said curve, through an angle
of 26007104", an arc distance of 63.82 feet to the Point of Tangency
thereof with a curve, concave easterly and having a radius of 3885.00
feet; thence southerly along said last mentioned curve, through an
angle of 2018'05", an arc distance of 156.05 feet to the southwesterly
line of said lot; thence along the southwesterly line of said lot,
north 50015'16" west 4.75 feet to the easterly line of said County
Road; thence along said easterly line, northerly to said Point of
Beginning.
RESERVING THEREFROM a public use easement for all existing underground
and overhead public utilities, together with right of ingress and
egress for the purpose of maintaining, replacing, and upgrading said
existing public utilities.
All as more particularly shown on a map attached hereto and by this
reference made a part hereof.
