RESOLUTION NO. 90-87
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF COSTA MESA, CALIFORNIA, AUTHORIZING CERTAIN
OF ITS EMPLOYEES AT THE SCENE OF A HAZARDOUS
MATERIAL EMERGENCY TO EXECUTE AN EMERGENCY
SERVICES CONTRACT.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS
FOLLOWS:
WHEREAS, the Orange County -City Hazardous Materials Emergency Response
Joint Powers Authority ("Authority"), through Provider Agencies, employs,
maintains, trains, and equips personnel capable of responding to emergen-
cies created by the release of hazardous materials; and
WHEREAS, the City of Costa Mesa may require the services of the
Authority to respond to a hazardous material emergency within its jurisdic-
tion;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Costa Mesa as follows:
1. The City Manager, Deputy City Manager, Police Chief, Fire Chief,
Acting Fire Chief, Battalion Chief, Acting Battalion Chief, Hazardous
Materials Captain or the Incident Commander are hereby authorized to exe-
cute a contract at the scene of a hazardous material emergency agreeing to
pay for the services provided by the Authority at its hourly rate; and
2. The City of Costa Mesa shall defend, indemnify, and hold harmless
the Authority, its Provider Agencies and other participating agencies,
their respective officers, employees, representatives, and agents from and
against any and all loss, litigation, liability, injury, damage, claim,
lawsuit, cost or expense arising out of, or in any way related to, the
performance of services pursuant to the agreement referred to above or the
existence of a hazardous material emergency to which the Authority and/or a
Provider Agency has responded.
PASSED AND ADOPTED this 3rd day of December, 1990.
