HomeMy WebLinkAbout92-02 - Career Criminal Apprehension Program304, RESOLUTION NO. 92-2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, AUTHORIZING PARTICIPATION IN CCAP, CAREER CRIMINAL APPREHENSION PROGRAM, ADMINISTERED BY THE OFFICE OF CRIMINAL JUSTICE PLANNING. WHEREAS, the City Council of the City of Costa Mesa desires to partic- ipate in the regional crime analysis program called PROACT, Proactive Resource Organization Against Crime through Technology, administered by the Office of Criminal Justice Planning, OCJP; and WHEREAS, grant money is available for the creation and development of CCAP, Career. Criminal Apprehension Program, through OCJP; and WHEREAS, the cities of Costa Mesa, Fountain Valley, Huntington Beach, Irvine, Newport Beach, Seal Beach, and Westminister wish to participate in the implementation of CCAP to improve their ability to provide the best available law enforcement service to their. communities; NOW, THEREFORE, BE IT RESOLVED that David L. Snowden, Chief of Police of the City of Costa Mesa, is authorized to submit the grant proposal to the City of Huntington Beach, who, acting as host city for the group of seven cities, will submit the grant proposal to the Office of Criminal Justice Planning; and BE IT FURTHER RESOLVED that Allan Raeder., City Manager of the City of Costa Mesa, is authorized to execute the attached Memorandum of Understand- ing, including any extensions or amendments thereof on behalf of the City; and BE IT FURTHER RESOLVED that the applicant agrees to provide all match- ing funds required for said project under. CCAP and the funding terms and conditions of OCJP, including any amendment thereof, and that the cash match will be appropriated as required; and BE IT FURTHER RESOLVED that any liability arising out of the perform- ance of the grant award agreement, including civil court actions for damages, shall be the responsibility of the grant recipient and the author- izing agency. The State of California and OCJP disclaim responsibility for any such liability; and BE IT FINALLY RESOLVED that grant funds received hereunder shall not be used to supplant expenditures controlled by this body. Ci y Clerk and ex -officio Clerk of Vie City Council of the City of Costa Wsa ORANGE COAST REGIONAL CAREER CRIMINAL APPREHENSION PROGRAM MEMORANDUM OF UNDERSTANDING PURPOSE The parties to this agreement will participate in the development of a "Long Range Plan," the purpose of which will be to define the nature and extent of CCAP services and products, and to assure that such services and products are timely, pertinent, and useful in improving the efficiency and economy of all the law enforcement agencies involved in the project. OPERATION The City of Huntington Beach will take responsibility for submitting the grant proposal to the Office of Criminal Justice Planning. The City of Huntington Beach will also facilitate the development of the program's advisory committees and act as "host" for the purpose of grant development and documentation. The Cities of Seal Beach, Westminster, Fountain Valley, Huntington Beach, Costa Mesa, Newport Beach, and Irvine will facilitate the program by providing pertinent law enforcement data to the program for analysis, and by incorporating the program's product in the planning and execution of Police Department operations. All participating cities will support the development and staffing of a centrally located Crime Analysis Unit. The purpose of this document is to formalize and certify, in written form, that the City of Costa Mesa will participate in and support a state grant -funded initiative entitled the o "Orange Coast Regional Career Criminal Apprehension Program" I rt (CCAP). That program will facilitate an inter -agency effort rn to identify and apprehend chronic offenders whose prolific b o criminal behavior engenders widespread victimization 2throughout cn our community. cWo m r O TERM r O C rnrt iv o The term of this agreement is July 1, 1992 through June 30, :3 1993. Subsequent agreements are anticipated for each successive program year. It is acknowledged that this • agreement does not bind any party to participation beyond N the term of this agreement. However, it is emphasized that N the CCAP program should be considered a long-term investment in the improvement of regional law enforcement. If future evaluations of the program confirm its merit, its continuation in subsequent grant terms (as well as after the expiration of grant funding) should be supported. Page 2 EVALUATION The CCAP program will be subject to on-going monitoring and review by the Executive Advisory Committee made up of the participating cities chiefs of police. A recommendation regarding the continuation of the program at the end of each N grant funding phase will be provided by that organization. CNN In addition, the program will be subject to an independent evaluation prior to the 'completion of the final eighteen (18) months of state funding. The selection of the evaluator, as well as the evaluation methodology to be OC`' employed, will be subject to the approval of the Executive Advisory Committee. o TERMINATION a4 It is emphasized that the CCAP program will require a binding contract o° 44 between the State and the City of Huntington Beach (which will receive the grant funds and act S as the program's "host"). The term of that contract corresponds to the term of this agreement. Withdrawal from the agreement during the "grant year" is, therefore, discouraged. FINANCING The majority of CCAP funding will be provided by the State for the first forty-two (42) months of operation. A local government funding "match" is, however, required during each grant phase. A share of this match will be provided by each jurisdiction on the basis of its population ratio to the total population of the service area.
