ORDINANCE NO, 16
AN ORDINANGZ REGULATING TH3 USE OF FIRE IN THE INCORPORATED TERRITORY OF THE
CITY OF COSTA MWA, REGULATING THE CONTROL OF FIRE MENACE AND SETTING OF FIRES.
The 00ity Council of the City of Costa Mesa does ordain as follows:
Section 1.
That it shall be unlawful in the incorporated territory of Costa Masa
for any person or persons, between April 15th -anal the last day of December of
any year, to ignite or light a fire or use fire for clearing land, or to burn
bruah, stumps, logs, fallen timber, fallows, slash, or grass or forest covered
land or any other inflammable material, or blasting with dynamite, powder, or
other explosives or setting off fire works of any kind in forest, fallows,
brush, grass or grain covered lands, either on his own land or the property
of another, unless such burining or blasting is done under the written permit
from a Federal or State Officer of s Fire Warden duly authorised to issue such
-permits, within the County of Orange; provided, however, that no written
permission shall be necessary to burn inflammable material in small heaps or
piles, where the fire is set on a public road, in door yard premises, corrals,
gardens, or plowed fields, at a distance not less than one hundred, (100) feet
from any woodland, timber or brush covered land or field containing dry grass
or other inflammable material; and provided,olso, that there shall be at least
one adult person in actual attendance and in charge of such fire at all times
during its burning; and provided further that nothing in this section shall
,prevent the use of fires in permanent homes for domestic purposes.
Section 2.
That it shall be unlawful in the incorpo.ratod territory of the City of
Costa Mesa for any person, firm or corporation to place or maintain, or cause
or permit to be placed, or maintained, upon their own lands or lands of another,
any rubbish, raper, shavings, products of petroleum or other combustible mater-
ial which constitute a fire menace, exeeUt at }daces designated by a duly
authorized fire warden; such combustible material to be buried with earth or
destroyed bn fire b`r such parson, firm or corporation, as provided in Section
1 of this ordinance.

Section 3,,
That to carry out the purpose of this ordinance, the County Piro Warden,
his deputies, and Federal and State Forest Officers are hereby made peace
officers em*+owered to issue -permits in writing to light fires, to use fires,
to blast or use explosives, and to inspect and abate any condition that
t constitute a fire menace or a menace to the peace, health or safety; and
Fire Warden shall include in any, permits such safe -guarding restrictions
precautions as are reasonably necessary to -prevent such fires or blasting
m endangering life or property, and no permit issued shall exonerate any
son from civil or criminal liability in case injury results from such fire
persons or property, Any fire warden or Forest Officer of the County of
has the poorer to refuse, revoke or postpone permits when necessary for
protection of life or property.
Section 4..
15 If any section or subsection, clause or phrase of this ordinance shall
16 be held invalid by and Court of competent jurisdiction, such decision shall not
17 &ffect the validity of the remaining portions of this ordinance; and the City
18 Oounoil of the City of Costa Mesa hereby declares that it would have passed this
19 ordinanca and each section, subsection, sentence, clause or phrase thereof,
20 rrespective of the fact that any one or more other sections, subsections,
21 entences, clauses or phrases thereof be declared invalid or insufficient.
2211 Section 5.
23 Any person violating any of the provisions of this ordinance shall be
24guilty* of a misdemeanor and upon conviction shall be punished by a fine of
25 aot more than Five Hundred Dollars ($500.00) or by imprisonment in the County
26 lail for not more than six (6) months, or by both such fine and imprisonment.
27 Section 6.
28 This ordinance shall take effect thirty (30) days after the date of its
29 adoption, and prior to the expiration of fifteen (15) days from the passage
30 ereof shall be posted in at least three public places in the City.
