HomeMy WebLinkAbout28 - Regulating Parking of Motor Vehicles (Repealed by Ord. 44)ORDINANCE NO. 28 AN ORDINANCE OF THE CITY OF COSTA MESA REGULATING THE PARKING OF MOTOR VZHICLES WITHIN THE INCORPOi3ATED TERRITORY 03 THE CITY OF COSTA MESA, The City Council of the City of Costa Mesa does ordain as follows: Section 1. The City Council of the City of Costa Mesa may by resolution designate: (A) Certain streets or portions of streets within the incorporated area of the City of Costa Mesa as Traffic District "A" or "R". (B) Certain streets or portions of streets as "No Parking Areas". (C) Portions of streets as "Loading Zones". (D) Certain portions of streets as "Bus Stops". (E) Certain streets and highways entering business or residence districts which shall be sign posted. (F) The time and manner of parking on the streets and highways within the City of Costa Mesa. Section 2. (A) It shall be unlawful for the operaator of a vehicle to stop said vehicle for a period of time longer than one hour between the hours of 7:00 o'clock a,m. and 6:00 o'clock p.m. on any day within any Traffic District "A". (B) It shall be unlawful for the operator of a vehicle to stop said vehicle and leave the same so parked for a period of time longer than two hours between the hours of 7:00 o'clock a.m. and 6:00 o'clock p.m, of any day within any Traffic District "B". (C) It shall be unlawful for the operator of any vehicle to park the same or to stop the same for any purpose other than the unloading or loading of passengers or maaterials, provided that no stop for the loading or unloading of passengers shall be made for more than five (5) minutes, and provided that no stop for the loading or unloading of materials shall be made for more than twenty (20) minutes, in any loading zone. (D) It shall be unlawful for the operator of any vehicle to stop —1— said vehicle immediately adjacent to or opposite any curbing in the City of Costa Masa which has been designated as a Bus Stop fow any purpose other than the loading or unloading of passengers or freight or for a longer period of time than five, (5) minutes. (2) It shall be unlawful to park any motor vehicle immediately to or opposite any curb which has been painted red and which has been marked to indicate or bear a sign indicating that no parking is permitted. (F) It shall be unlawful to park any vehicle on any street or high:- way igh-way within the City of Costa Mesa contrary to the manner that said street or highway has been marked or posted. Section 3, When the BdA dCotnell has tiesignated any street or portion of street as Traffic District "A" or "BN, it shall be the duty of the Superintendent of Streets, and if none, the City Manager, to cause to be posted at the boundary of such District a sign indicating thereon the time permitted for parking within such district. It shall be the duty of the Superintendent of Streets, and if none, the City Manger, to designate upon the curb adjacent to any area designated:, or upon the street or highway: (A) Loading zone by placing and maintaining yellow paint or other yellow material upon the entire curb surface fronting such area, with the words "Loading Zone" painted in black letters thereon. Said loading zone shall not exceed fifty (50) feet in length. (B) Bus stop zones in the same manner as loading zones are indicated, except that there shall be painted upon said curb in black letters the words "Bus Stop". (C) Any No Parking areas by painting the curb adjacent to such area red and marks to indicate or bear a sign indicating that no parking is permitted4 (D) Any parking lines, either parallel, diaganal, or otherwise. Section 4,. Any violation of this ordinance shall constitute a misdemeanor, and -2- shall be punishable by a fine not exceeding $50.00 or by imprisonment in the City or County Jail not exceeding_ thirty (30) days, or both such fine and imprison- ment. Section 5. 3f any paragraph, sentence, clause or phrase of this 0rdi_nance for any reason is held to be unconstitutional or invalid, such shall not. affect the remaining portions of this Ordinance, and the City Council hereby declares it would have passed each paragraph, sentence, clause and phrase thereof irrespective of the fact that any one or more than one sectence, clause or phrase be declared unconstitutional or invalid. Section 6. This Ordinance is herr=t,.,- Ir -c- _ared to be an Ordinance for the immediate preservation of the public peace and safety and the facts constituting its urgency are as follows: The City of Costa Mesa have become incorporated, this Ordinance is necessary for the immdedat,e preservation of the public peace r!,rld safety of the r .tizens of the City of Costa Mesa. Section 7. Thsi Ordinance shall take effect immediately upon its final passage, and within fifteen (1_5) days shall be posted in three public places in the City of Costa Mesa, together with the names of the members of the City Council voting; for and against the same. Passed and adopted this 16th day of November, 191-3.
