HomeMy WebLinkAbout00-83 - Underground Utility District No. 214a � RESOLUTION NO. 00-83 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, ESTABLISHING UNDERGROUND UTILITY DISTRICT NO. 21, ON PLACENTIA AVENUE FROM 18TH STREET TO 20TH STREET; AND ON 19TH STREET FROM ANAHEIM AVENUE TO MONROVIA AVENUE. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, a public hearing was called for November 20, 2000, at the hour of 6:30p.m., in the Council Chambers of City Hail, 77 Fair Drive, Costa Mesa, California, to ascertain whether the public necessity, health, or welfare requires the underground installation of wires and facilities for supplying electrical, communication, or similar or associated service, within that certain area of Costa Mesa described in Exhibit "A", the legal description attached hereto and made a part hereof; and WHEREAS, such hearing was duly and regularly held and all persons interested were given an opportunity to be heard; WHEREAS, the City Council of the City of Costa Mesa has found that the public necessity, health, or welfare requires the underground installation of wires and facilities for supplying electrical, communication, or similar or associated service, within that certain area of Costa Mesa described in Exhibit "A"; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Costa Mesa that pursuant to Title 15, Chapter VII, Sections 15-150 through 15-166, Costa Mesa Municipal Code, the above described area is hereby declared an underground utility district and is designated as Underground Utility District No. 21 of the City of Costa Mesa. Attached hereto marked Exhibit "B" is a map delineating the boundaries of said District and is hereby incorporated as part of this Resolution. BE IT FURTHER RESOLVED that the City's Rule 20A Allocation will be charged for all electrical service undergrounding in this District, including service laterals and conversions to individual structures, and Pacific Bell and the City's cable television franchisee shall finance their respective portion of the underground cost within the District from their own resources. Notwithstanding any provisions to the contrary in Chapter Title 15, Chapter VII of the Costa Mesa Municipal Code, owners or possessors of private property within the District shall not be responsible for undergrounding utilities on his or her property, but shall give appropriate access to utilities to undertake the undergrounding. BE IT FURTHER RESOLVED that the City Council does hereby fix November 20, 2001, as the date of commencement of the undergrounding work within this District, and as the date on which affected property owners must be ready to receive underground service, and does hereby order removal of all poles, overhead wires, and associated overhead structures, and underground installation of wires and facilities for supplying electrical, communication, or similar or associated service within this District by January 30, 2003. BE IT FURTHER RESOLVED that the following exceptions in said Underground Utility District No. 21 be and they are hereby authorized: (1) Poles or electroliers used exclusively for street lighting (or traffic signals). (2) Equipment appurtenant to underground facilities, such as surface - mounted transformers, pedestal -mounted terminal boxes and meter cabinets, and concealed ducts. (3) Temporary poles, overhead wires, and associated overhead structures used, or to be used in conjunction with construction projects. BE IT FURTHER RESOLVED that the City Clerk is hereby instructed to notify all affected utilities and all persons owning real property within Underground Utility District No. 21 of the adoption of this Resolution within ten (10) days after the date of adoption. Said City Clerk shall further notify said property owners of the necessity that, if they or any person occupying such property desires to continue to receive electric, communication, or other similar or associated service, they or such occupant shall, during the dates fixed in this Resolution, cooperate with City officials and utility contractors in order to give appropriate access to undertake the undergrounding and provide all necessary facility changes on their premises so as to receive such from the lines of the supplying utility or utilities at a new location, subject to applicable rules, regulations, and tariffs of the respective utility or utilities on file with the Public Utilities Commission of the State of California. Such notification shall be made by mailing a copy of this Resolution, together with a copy of Title 15, Chapter VII, Sections 15-150 through 15-166 of the Costa Mesa Municipal Code, to all affected property owners as such are shown on the last equalized assessment roll and to the affected utilities. BE IT FINALLY RESOLVED that the City Council hereby finds and determines as follows: (1) The undergrounding will avoid or eliminate an unusually heavy concentration of overhead distribution facilities. (2) Because the streets and rights-of-way in the District are extensively used by the general public and carry a heavy volume of pedestrian and vehicular traffic, undergrounding will enhance safety for pedestrians and vehicles.
