A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
COSTA MESA, CALIFORNIA, APPROVING MASTER
PLAN AMENDMENT PA -00-50.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY
RESOLVE AS FOLLOWS:
WHEREAS, an application was filed by Ed Aleson, authorized agent for Mike
Paz, South Coast Plaza, 3315 Fairview Road, Costa Mesa, with respect to real
property located at 3333 Bristol Street, Suite 1876, requesting approval of a
Master Plan amendment to expand existing restaurant space by 662 -square -feet in
the PDC zone; and
WHEREAS, a duly noticed public hearing was held by the City Council on
December 18, 2000;
NOW, THEREFORE, BE IT RESOLVED that based on the evidence in the
record and the findings contained in Exhibit "A", and subject to conditions
contained in Exhibit "B", the City Council hereby approves Master Plan Amendment
PA -00-50 with respect to the property described above.
BE IT FURTHER RESOLVED that the Costa Mesa City Council does hereby
find and determine that adoption of this resolution is expressly predicated upon the
activity as described in the staff report for Master Plan Amendment PA -00-50, and
upon applicant's compliance with each and all of the conditions contained in Exhibit
"B". Any approval granted by this resolution shall be subject to review,
modification, or revocation if there is a material change that occurs in the
operation, or if the applicant fails to comply with any of the conditions of approval.

FINDINGS

A. The master plan meets the broader goals of the General Plan, the North Costa
Mesa specific plan, and the Zoning Code by exhibiting excellence in design, site
planning, integration of uses and structures and protection of the integrity of
neighboring development. Specifically, the restaurant expansion complies with
all applicable development standards and is a compatible use with the subject
and surrounding properties.
B. The proposed project complies with Costa Mesa Municipal Code Section 13-29
(e) because:
a. The proposed development and use is compatible and harmonious with
uses both on-site as well as those on surrounding properties.
b. Safety and compatibility of the design of the buildings, parking areas,
landscaping, luminaries, and other site features including functional
aspects of the site development such as automobile and pedestrian
circulation have been considered.
C. The proposed project complies with applicable performance standards
prescribed in the Zoning Code.
d. The project is consistent with the General Plan and the applicable specific
plan.
e. The planning application is for a project -specific case and does not
establish a precedent for future development.
f. The cumulative effects of all past and present planning applications have
been considered for both the subject property and surrounding properties.
C. The project has been reviewed for compliance with the California Environmental
Quality Act (CEQA), the CEQA Guidelines, and the City environmental
procedures, and has been found to be exempt from CEQA.
D. The project is exempt from Chapter XII, Article 3, Transportation System
Management, of Title 13 of the Costa Mesa Municipal Code.

CONDITIONS OF APPROVAL

Ping. 1.
The conditions of approval and ordinance or code provisions of
Planning Application PA -00-50 shall be blueprinted on the face of the
site plan.
2.
The applicant shall contact the Planning Division to arrange for a
"special requirements" inspection of the site prior to the release of
occupancy. This inspection is to confirm that the conditions of
approval and code requirements have been satisfied.
3.
The restaurant shall remain a "bona fide eating place" as defined by
section 23038 of the California Business and Professions Code.
Eng. 4.
Maintain the public right-of-way in a "wet -down" condition to prevent
excessive dust and promptly remove any spillage from the public right-
of-way by sweeping or sprinkling.
CODE REQUIREMENTS
The following list of federal, state and local laws applicable to the project has been
compiled by staff for the applicant's reference. Any reference to "City" pertains to
the City of Costa Mesa.

All contractors and subcontractors must have valid business licenses
to do business in the City of Costa Mesa. Final inspections, final
occupancy and utility releases will not be granted until all such
licenses have been obtained.
Approval of the planning application is valid for one ( 1) year and will
expire at the end of that period unless building permits are obtained
and construction commences, or the applicant applies for and is
granted an extension of time.
Permits shall -be obtained for all signs according to the provisions of
the Costa Mesa Sign Ordinance.
Hours of operation for customer service shall not occur any time
between 11 p.m. and 6 a.m. without previous approval of a minor
conditional use permit.
Live entertainment for the restaurant may only be permitted subject to
approval of a minor conditional use permit by the Zoning Administrator
and City issuance of a "public entertainment permit".
Comply with the requirements of the Uniform Building Code as to
design and construction and CCR Title 24 pertaining to "Disabled
Access Regulations". .
Fulfill San Joaquin Hills Transportation Corridor Fee Ordinance
requirement at the time of issuance of building permit by submitting
the required fee to the Planning Division: For the proposed use, the
corridor fee is estimated as $2,283.90.

SPECIAL DISTRICT REQUIREMENTS
The requirements of the following special districts are hereby forwarded to the
applicant:
Sani. 1.
Developer will be required to construct sewers to serve this project, at
his own expense, meeting the approval of the Costa Mesa Sanitary
District.
2.
Orange County Sanitation District fees, fixture fees, inspection fees,
and sewer permit required prior to issuance of building permits. To
receive credit for buildings to be demolished, call (714) 754-5307 for
inspection.
3.
Developer shall submit a plan showing sewer improvements that
meets with the District Engineer's approval to the Building Division as
a part of the plans submitted for plan check.
4.
Developer is required to contact the Costa Mesa Sanitary District at
(714) 754-5307 to arrange final sign -off prior to certificate of
occupancy or utilities being released.
School 5.
Pay applicable Newport Mesa Unified School District fees to the
Building Division prior to issuance of building permits.
