HomeMy WebLinkAbout62-12 - Report Filed under Division 4 of Streets and Highways Codes RESOLUTION N0. 62-12 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, ORDERING CERTAIN ADDITIONS, ALTERATIONS, OMISSIONS FROM AND DECREASES IN THE THINGS PROPOSED TO BE DONE AS SET FORTH IN THE REPORT FILED UNDER DIVISION 4 OF THE STREETS AND HIGHWAYS CODE OF THE STATE OF CALIFORNIA, AND FINDING THAT SUCH ADDITIONS, ALTERATIONS, OMISSIONS AND DECREASES DO NOT INCREASE THE ESTIMATED COST BY MORE THAN ONE-TENTH OF THE TOTAL ESTIMATED COST. WHEREAS, this City Council has heretofore taken steps provided by Sections 2821, 2822 and 2823 of the Streets and Highways Code of the State of California, and WHEREAS, this City Council directed Laurence J. Thompson to procure the required information and prepare and present to this City Council the written report on the acquisition, work and improvement, and said report has been presented and approved by this City Council, and WHEREAS, by Resolution, this City Council fixed a time and place for hearing by it on said report, and WHEREAS, Notice of said hearing was mailed as required by said Division 4 of the Streets and Highways Code of the State of California, and WHEREAS, at the time and place so fixed a hearing was duly held by this City Council, at which all written protests or objections were presented, read and all persons desiring to be heard thereon were heard, and this City Council gave all persons present an opportunity to be heard in respect to any matter relating to said report, said acquisition, work or improvement, or any of the proceedings therefor, and WHEREAS, all persons desiring to appear and be heard at said hearing were heard, and said hearing has been regularly held, and WHEREAS, this Council adopted Resolution No. 897, determining the results of hearing, overruling protests, determining that the public interest, convenience and necessity require certain acquisition, work or improvement of Monrovia Avenue and certain other streets, alleys and easements, substantially as set forth in the report on the project filed under the "Special Assessment, Investi- gation, Limitation and Majority Protest Act of 1931," and determining that said project is feasible, and making other determinations, and WHEREAS, this Council has found and determined certain additions, altera- tions, omissions from and decreases in the things proposed to be done, and WHEREAS, the Engineer has recommended certain additions, alterations, omissions from and decreases in the things proposed to be done as set forth in said report, and 70 WHEREAS, said additions. alterations, omissions from and decreases in the things proposed to be done do not increase the estimated cost by more than one- tenth of the total estimated cost as stated in said report; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, !4 DOES HEREBY RESOLVE AS FOLLOK�: SECTION 1. That the following acquisitions and items of work be added, A omitted from and decreased in the things proposed to be done as set forth in the report filed under Division 4 of the Streets and Highways Code of the State of California, and certain additions and alterations made as follows: A. The grading, paving with asphalt concrete over aggregate base and seal coat, construction of curbs and gutters, spandrel, cross gutter, removing obstructions, and appurtenant work in connection therewith: In NEWHALL STREET between Monrovia Avenue and 842 feet westerly from the centerline of Monrovia Avenue, as shown on the Diagram. B. The grading, paving with asphalt concrete over aggregate base and seal coat, construction of curbs and gutters, cross gutters, barricade, ---M removing obstructions and appurtenant work in connection therewith: In SERVONICS AVENUE between 16th Street and 390 feet northerly from the centerline of 16th Street, as shown on the Diagram. C. The grading, construction of concrete drainage channel, including removing of obstructions, in the easement located between Newhall Street and Servonics Avenue, over and across the following described real property, to wit: A portion of Lot 1111 of Newport Mesa Tract, as shown on a map thereof, recorded in Book 5, page 1 of Miscellaneous Maps, records of Orange County, California, more particularly described as follows: Beginning at a point in the Northerly line of said Lot 1111, distant thereon, 1.32.00 feet, Westerly of the Northeasterly corner of said Lot 1111; thence Southerly along a line 132.00 feet Westerly —. of, measured at right angles, and parallel to the Easterly line of said Lot 1111, 270.00 feet to a line 60.00 feet Northerly of, measured at right angles, and parallel to the Southerly line of said Lot 1111; thence Easterly along the last mentioned parallel line, 8.00 feet, to a line 12+.00 feet Westerly of, measured at right angles, and parallel to the Easterly line of said Lot 1111, the true point of beginning of the land herein described; thence Northerly along last mentioned parallel line, 220.6+ feet to a point on a curve, concave Northerly, having a radius of 50.00 feet; thence Northeasterly along said curve through a central angle of 110 53' 36", an arc distance of 10.38 feet to a line 114.00 feet Westerly of, measured at right 71 angles and parallel to the Easterly line of said Lot 1111; thence Southerly along last mentioned parallel line, 223.35 feet to a line 60.00 feet Northerly of, measured at right angles, and parallel to the Southerly line of said Lot 1_111; thence Westerly along last mentioned parallel line, 10.00 feet to the true point of beginning. as shown on the Diagram. D. The construction of outlet structure on 18th Street at its intersection with drainage easement located between Sunset Drive and 18th Street. E. The construction of two (2) inlet structures in Newhall Street and Sunset Drive, respectively, as shown on the Diagram. F. The elimination of six (6) house connection sewers consisting of 630 linear feet, all as shown on the Diagram. G. The elimination of curbs and gutters in the following portions of streets: (1) 17th Street fronting on Block 1009; (2) Monrovia Avenue fronting on Block 1009 and 1010; (3) Monrovia Avenue fronting on Assessor's Parcels Nos. 13 and 14. (4) Placentia Avenue fronting on Assessor's Parcels No. 32 as shown on the diagram. H. The elimination of thirteen (13) water service house connections on 16th Street in front of Assessment Nos. 51, 52, 142 and 268. 1. The elimination of 39 Linear Feet of curb at the Southwest Corner of 17th Street and Monrovia Avenue, as shown on the diagram. J. The elimination of cross gutters and spandrel at the Southwest corner of 17th Street and Monrovia Avenue as shown on the diagram. K. The elimination of 60 linear feet of storm drain channel between Sunset Drive and 18th Street as shown on the diagram. SECTION 2. That said additions, alterations, omissions from and decreases in said work do not increase the estimated cost by more than one- tenth of the total estimated cost as set forth in said report.
