HomeMy WebLinkAbout62-89 - Street Lighting District - Setting HearingRESOLUTION NO. 62-89 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, APPOINTING A TIME AND PLACE FOR HEARING PROTESTS IN RELATION TO THE PROPOSED IMPROVEMENT REFERRED TO IN RESOLUTION OF INTENTION NO. 62-88 AND DIRECTING THE CLERK OF SAID CITY COUNCIL TO GIVE NOTICE OF SAID HEARING. WHEREAS, the City Council of the City of Costa Mesa, California, did, 11 in a Resolution of said City Council adopted June 4, 1962, pursuant to the J provisions of the "Street Lighting Act of 1919" of the State of California (Part 1 of Division 14 of the Streets and Highways Code of the State of California) as amended, and particularly as contemplated under the provisions of 918041 of said law and under the alternative procedure for installment assessments provided for in Chapter 8 of said "Street Lighting Act of 1919", require the City Engineer of said City to make and file with the Clerk of said City Council a report in writing presenting certain matters relating to a proposed lighting maintenance and service district in said City; and WHEREAS, the City Engineer, pursuant to the requirements of said City Council expressed in said Resolution of June 4th, 1962, on file in the office of the City Clerk (who is ex -officio Clerk of the City Council) of said City filed his report in writing responsive to the requirements of the said Resolution of June 4th, 1962, and of said law relating to the proposed lighting maintenance and service district in said City; and WHEREAS, the said City Council has proceeded to carefully examine, inspect and consider the said Report, and has afforded all persons interested an opportunity to be heard with reference thereto, and is satisfied with each and all of the various items thereof and the matters therein set forth; and WHEREAS, said City Council did in Resolution No. 62-87, approve said report on the 18th day of June, 1962, in conformity with the provisions of said "Street Lighting Act of 1919", and WHEREAS, after the approval of said report, and in conformity with the provisions of said "Street Lighting Act of 1919", said City Council did duly and regularly adopt its Resolution of Intention No. 62-84 entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA ORDERING THE CITY ENGINEER TO PREPARE AN ASSESS- MENT DIAGRAM, PLANS, SPECIFICATIONS, ESTIMATE AND REPORT PURSUANT TO THE PROVISIONS OF DIVISION 14, PART 1, STREETS AND HIGHWAYS CODE, STREET LIGHTING ACT OF 1919, AS AMENDED, FOR THE FURNISHING OF ELECTRIC CURRENT AND FOR THE MAINTENANCE OF CERTAIN LIGHTING FIXTURES AND APPLIANCES IN SAID CITY FOR A PERIOD OF MONTHS, BEGINNING NOVEMBER 1, 1962, AND ENDING OCTOBER 31, 1963; and W17REAS, it now becomes the duty of said Council to appoint a time and place for hearing protests in relation to the proposed improvement referred to in said Resolution of intention No. 62-84, ani to direct the giving of notice of said hearing; NOW, 'TITEREFORE, THE CITY COUNCIL OP THE CITY Oil COSTA IDSA, CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMI!E AND ORDER AS FOLLOWS: SECTION 1. That the 16th day of July, 1962, at the hour of 7:30 o'clock P. M., in the Council Chamber of the City Council, in the Costa Mesa City Hall, located at 695 West 19th Street, Costa Mesa, California, be and the same is sereby appointed as the time and the Council Chamber of the Costa Mesa City Hall of the City of Costa Mesa, California, is hereby appointed as the place for nearing protests in reference to the said proposed improvement. SECTIO1. 2. That the City Clerk (who is ex -officio Clerk cf the City Council) is hereby authorized, designated and directed to give notice of said hearing in time, form and manner as required by law. SECTION 3. That the Orange Coast Daily Pilot, a daily newspaper of general circulation, published in the City of Costa Mesa, California, and circulated generally within said City of Costa Mesa, California, is hereby designated as the newspaper in which such notice shallbe published. SECTION 1A. That the City Clerk shall certify to the passage and adoption of this Resolution; stall enter the same among the original Resolutions of the City Council of said City; and shall make a minute of the records of the proceedings of the City Council of said City in the minutes of the meeting at which the same is passed and adopted.
