RESOLUTION NO. 62-99
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA
MESA, CALIFORNIA, CONFIRMING THE REPORT OF THE CITY
ENGINEER DATED JUNE 18, 1962, PREPARED PURSUANT TO THE
PROVISIONS OF THE "STREET LIGHTING ACT OF 1919," AND
REFERRED TO IN RESOLUTION OF INTENTION N0. 62-88 OF SAID
COUNCIL, AND THE PLANS AND SPECIFICATIONS, ESTIMATE,
DIAGRAM AND ASSESSMENT CONTAINED IN SAID REPORT: ORDERING
THE WORK AND LEVYING THE ASSESSMENT FOR SERVICE NECESSARY
TO MAINTAIN AND ILLUMINATE BY ELECTRIC ENERGY THE STREET
LIGHTS WITHIN SAID CITY FOR THE PERIOD OF MONTHS ENDING
OCTOBER 313 1963.
WHEREAS, the City Council of the City of Costa Mesa, California, did,
in a Resolution adopted by said Council on the 4th day of June, 1962, pursuant
to the provisions of the "Street Lighting Act of 1919" of the State of California,
which is now included as Part 1 of Division 14 of the Streets and Highways Code
of the State of California, require the City Engineer of said City to make and
file with the Clerk of said Council a report in writing, presenting certain
matters relating to a proposed lighting, maintenance and service district in
said City, as contemplated under the provisions of said Act; and
WHEREAS, the City Engineer, pursuant to the requirements of said
Council as set forth in said Resolution No. 62-84 dated June 4, 1962, did make,
and on the 18th day of June, 1962, did file in the Office of the City Clerk
relating to the proposed lighting, maintenance and service district in said
City referred to in said Resolution of Intention No. 62-88, and as contemplated
under the provisions of said "Street Lighting Act of 1919;" and
WHEREAS, the said City Council did, in Resolution No. 62-87 of said
Council, approve said report on the 18th day of June, 1962, in conformity with
the provisions of said Act; and
WHEREAS, said City Council did thereafter, and on said 18th day of
June, 1962, pass its Resolution of Intention No. 62-88, declaring its intention
to install certain street light standards, appliances and fixtures, to be
assessed over a three (3) year period, all as shown on Diagram and Plan No.
62-63 on file in the office of the City Clerk, and to order certain fixtures
and appliances on certain streets and public places within said City to be
maintained and electric current to be furnished for lighting said fixtures for
a period of months ending October 31, 1963; and
WHEREAS, said Council did also on said 18th day of June, 1962, in its
Resolution No. 62-89, fix and designate Monday, the 16th day of July, 1962,
at the hour of 7:30 P.M. of said day, as the time and place for hearing
protests in reference to the proposed improvement and assessment; and

WHEREAS, the said City Council did, in Resolution No. 62-87 of said
Council, approve said report on the 18th day of June, 1962, in conformity with
the provisions of said Act; and
WHEREAS, said City Council did thereafter, and on said 18th day of
June, 1962, pass its Resolution of Intention No. 62-88, declaring its intention
to install certain street light standards, appliances and fixtures, to be
assessed over a three (3) year period, all as shown on Diagram and Plan No.
62-63 on file in the office of the City Clerk, and to order certain fixtures
and appliances on certain streets and public places within said City to be

WHEREAS, said Council did also on said 18th day of June, 1962, in its
Resolution No. 62-89, fix and designate Monday, the 16th day of July, 1962,

WHEREAS, at the time and place above stated for hearing protests in
reference to the proposed improvement and assessment, said Council did
proceed to hold and did hold said hearing; and
WHEREAS, at the time and place above stated for hearing protests in
reference to the proposed improvement and assessment, no protests or objections,
either written or oral, were submitted or made; and
WHEREAS, said Council
having held
said hearing,
and being
fully
advised in the premises, has
now acquired
jurisdiction
to proceed
further;
NOW, THEREFORE, the City Council of the City of Costa Mesa, California,
does resolve, declare, find, determine and order as follows:
SECTION 1. That said Council does hereby approve, confirm and adopt
the said report of said City Engineer dated the 18th day of June, 1962, and
does approve and confirm the assessment proposed for said proposed improvement
set forth and referred to in said report, which said report is now on file in
the Office of the City Clerk of said City, open to public inspection, hereby
referred to and made a part hereof; and said City Council does hereby also
confirm and adopt the respective instruments therein contained and designated
Diagram and Plan No. 62-63, Specifications No. 62-63, Estimate, Diagram and
Assessment, all of which are on file as aforesaid, and are hereby incorporated
herein and made a part hereof.
SECTION 2. That said Council does hereby order and determine that the
period of months referred to in said Resolution of Intention No. 62-88 shall
be, and the same is hereby fixed and established, as the period of months ending
on the 31st day of October, 1963, as therein set forth; and said Council does
hereby levy the said proposed assessment made to cover the costs and expenses
of said improvement upon the respective several subdivisions of land in the
assessment district described and referred to in said Resolution of Intention
No. 62-88, and as fixed and determined by the said report of June 18th, 1962,
and the proposed assessment filed therewith as aforesaid, which said proposed
assessment shall be for the period of months as above designated, including
those certain parcels of land outside the boundaries of the City, as shown in
Section 2 of the report pursuant to and under the authority of 918033 of the J
Streets and Highways Code of the State of California.
SECTION 3. That the City Clerk of said City is hereby ordered to
transmit, or cause to be transmitted, to the County Auditor of Orange County,
California, as contemplated under the provisions of said "Street Lighting Act
of 1919,11 the said diagram and assessment upon which such levy is based, and
the County Tax Collector of said County (who is also the City Tax Collector

for said City) is hereby designated, requested, empowered, authorized, instructed
and directed to make collection of all assessments shown in said assessment,
and to perform the acts and duties as are required by law of, and to be performed
by the officer, employee or person so designated.
SECTION 4. That the City Clerk shall sertify to the passage and
adoption of this Resolution, shall cause the same to be entered among the
original Resolutions of said City; and shall make a minute of the passage and
adoption thereof in the records of the proceedings of the City Council of said
City of the meeting at which the same were passed and adopted.
SECTION 5. That this Resolution shall take effect immediately.
PASSED, APPROVED AND ADOPTED this 16th day of July, 1962.
