HomeMy WebLinkAbout62-131 - Tree Planting Standards and Specifications288 RESOLUTION NO. 62-131 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA ADOPTING STANDARDS AND SPECIFICATIONS FOR TREE PLANTING IN SUBDMSIONS. WHEREAS, subsection (k) of Section 9116 of Article 1, Chapter IX, of the Municipal Code of the City of Costa Mesa requires a subdivider to plant trees that will conform to standards and specifications established by Reso- lution of the City Council, and WHEREAS, the City Council desires to establish such standards and specifications and the procedure for the enforcement and control thereof. NOW, THEREFORE, THE CITY COUNCIL DOES HEREBY RESOLVE AND DETERMINE AS FOLLOWS: SECTION 1. Procedure. a. Prior to the hearing by the Planning Commission or prior to any action by the Planning Director, all tentative tract maps filed vith the City, and all applications for permission to divide lots into less than five parcels, shall be submitted to the Street Superintendent and his recom- mendations received, regarding tree planting requirements for said tract or parcels to be divided. b. The Planning Commission shall include as one of its conditions on all tentative tract maps the tree planting requirements by the Street Superintendent and the City Engineer shall, in addition to all other bonds required on the filing of the final tract map, require that the bond include the sum sufficient to cover the tree planting requirement. c. In the case of a division of less than five parcels, the Planning Commission shall require such bond in the amount as specified by the Street Superintendent. SECTION 2. Approval of Trees bZ Street Superintendent. The Superintendent shall approve the planting of any tree, shrub or planting requested by the subdivider unless he finds that said tree, shrub or planting will be injurious to: (1) the health and safety of any person; or (2) will constitute a traffic hazard; or (3) will cause damage to pre- sent or future utility installations. SECTION 3. Appeal. In the event the Superintendent of Streets denies the subdivider's application for any tree, shrub or planting, such persons shall have the right to have the matter heard by the City Council by requesting such hearing by letter. SECTION 4. Tree Planting Requirements. Each subdivider and each person seeking to divide lots into less than five (5) parcels shall plant one tree for each lot in the proposed sub- division. Said tree may be either in the right of tray fronting the lot, In any location on the front half of the lot, or grouped in areas that L average out one tree per lot, even though some lots or rights of way in front thereof do not have any trees.
