HomeMy WebLinkAbout63-24 - Vacation - Portion of Tustin Avenue & Santa Isabel Street373 REsoumm No. 63-24 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA ORDERING THE VACATION OF CERTAIN PORTIONS OF TUSTIN AVENUE AND SANTA ISABEL STREET IN THE CITY OF COSTA MESA. WHEREAS, the City Council of the City of Costa Mesa did, on the 7th day of January, 1963, pass and adopt Resolution No. 63-8, entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA DECLARING ITS INTENTION TO ORDER THE VACATION FOR STREET PURPOSES OF PORTIONS OF TUSTIN AVENUE AND SANTA ISABEL STREET IN THE CITY OF COSTA MESA; and WHEREAS, pursuant to said Resolution of Intention the time and place for hearing all persons interested in or objecting to the proposed vacation was set for Monday, the 4th day of February, 1963, at the hour of 7:30 o'clock p.m., in the Council Chamber at the City Hall, 695 West 19th Street, Costa Mesa, California; and WHEREAS, notices of said proposed vacation were duly and regularly posted as required by law, all pursuant to the provisions of Division 9, Part 3, Chapter 2 of the Streets and Highways Code of the State of California; and WHEREAS, said date of hearing coming on regularly to be heard, all persons appearing on the proposed vacation were heard, and said hearing was closed on the 4th day of February, 1963; and WHEREAS, the City Council of the City of Costa Mesa finds and determines, from all the evidence submitted, that the hereinafter described rights of Way are unnecessary for present or prospective street or alley purposes; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES ORDER AND RESOLVE AS FOLLOWS: 1. That the hereinafter described rights of way are unnecessary for present or prospective street or alley purposes. 2. It is hereby ordered that the following described rights of Way in Tustin Avenue and Santa Isabel Street be, and the same are hereby vacated: PARCEL A: A strip of land forty (40) feet in width, adjoining and northeasterly of the center line of Santa Isabel Avenue as said Santa Isabel Avenue is shown on a map of Tract No. 300 recorded in Book 14, pages 11 and 12, miscellaneous maps, records of Orange County, California, bounded on the southeast by the southeasterly line of Lot 114 of said Tract No. 300 and bounded on the northwest by the southeasterly line of that certain parcel of land described in a deed recorded in Book 1054, page 361, official records of Orange County, California. 3'7'4 PARCEL H: The northwesterly ten (10) feet of the southeasterly forty (40) feet of that portion of Lot No. 114 of Tract No. 300 as shown on a map thereof recorded in Book 14, pages 11 and 12, miscellaneous maps, records of Orange County, California, bounded on the northeast by the southwesterly line of that certain parcel of land described in a deed recorded in Book 1722, page 351, official records of Orange County, California, and bounded on the southwest by the northeasterly line of the afore described Parcel A. EXCEPTING THEREFROM the following described portion of said Lot 114: Beginning at the intersection of a line that is 40.00 feet north- westerly of, measured at right angles, and parallel with the center line of Tustin Avenue as said Tustin Avenue is described in a deed, recorded in Book 2682, Page 326, Official Records of said Orange County, with the southwesterly line of the southwesterly 132 feet of the northeasterly 264 feet of the southeasterly one-half of said Lot 114; thence South 500 11' 45" East, along last mentioned South- westerly line 10.00 feet, to a line 30.00 feet northwesterly of, measured at right angles, and parallel with the center line of said Tustin Avenue; thence South 390 48' 45" West, along last mentioned parallel line 10.00 feet; thence North 50 ll' 30" West, 14.14 feet to the point of beginning. PARCEL 1: Beginning at the intersection of a line that is parallel with and forty (40) feet northeasterly, as measured at right angles, from the center line of Santa Isabel Avenue as said Santa Isabel Avenue is shown on a map of Tract No. 300 recorded in Book 14, pages ll and 12, miscellaneous maps, records of Orange County, California, with a line that is parallel with and forty (40) feet northwesterly, as measured at right angles, from the center line of Tustin Avenue as said Tustin Avenue is des- cribed in a deed recorded in Book 2682, Page 326, official records of Orange County, California; thence, northeasterly along last mentioned parallel line, a distance of twenty (20) feet; thence westerly to a point on first mentioned parallel line twenty (20) feet northwesterly from the point of beginning; thence, southeasterly along first mentioned parallel line, a distance of twenty (20) feet to the point of beginning. 3. Reserving therefrom an easement to construct, place, operate, inspect, maintain, repair, replace, and remove such aerial and underground telephone, telegraph and communication structures as the company may from time to time require, consisting of poles, anchors, wires, cables, conduits, manholes, markers and necessary fixtures and appurtenances.
