A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA
OF INTENTION TO ANNEX TO SAID CITY A CERTAIN UNINHABITED
AREA DESIGNATED AS "ALISO NO. 1 ANNEXATION."

NOTICE OF THE PROPOSED ANNEXATION OF TERRITORY TO THE COSTA
MESA RECREATION AND PARK DISTRICT IN ORANGE COUNTY.
WHEREAS, there is situated outside of and contiguous to the City of Costa
Mesa a certain uninhabited area as hereinafter more particularly described; and
WHEREAS, the City Council of the City of Costa Mesa desires and hereby
initiates proceedings to annex said territory on its own motion without requiring
a petition; and
WHEREAS, the reasons for desiring said annexation are to insure compatible
zoning in the said territory with contiguous territory now within the City of Costa
Mesa, and said territory proposed to be annexed is presently within the Costa Mesa
Union School District, the Costa Mesa County Water District, and the Costa Mesa
Sanitary District; and
WHEREAS, the area above referred to is also outside of and contiguous to
the Costa Mesa Recreation and Park District; and the City Council of the City of Costa
Mesa, finds and determines, as supervising authority of said District, that said
territory should be annexed to the existing Costa Mesa Recreation and Park District;
and
WHEREAS, there has been submitted, on or about the 29th day of March, 1963,
to the Orange County Boundary Commission, a legal description and plat of the said
hereinafter described area, for its report pursuant to the provisions of Section 35002
of the Government Code of the State of California; and
WHEREAS, the report of the Orange County Boundary Commission has been secured
and reported upon by said .Boundary Commission with respect to the definiteness and
certainty of the proposed boundaries;
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Costa Mesa,
to annex to the City of Costa Mesa the said real property as hereinafter described,
which said real property is contiguous to the present boundaries of the City of Costa
Mesa and which property is, at the present time, uninhabited; and
THEREFORE, BE IT RESOLVED FURTHER, by the City Council of the City of Costa
Mesa, as the supervising authority of the Costa Mesa Recreation and Park District,
to annex to the existing Costa Mesa Recreation and Park District the said real
property as herein after described, which said real property is contiguous to the
existing Costa Mesa Recreation and Park District.
NOTICE IS HEREBY GIVEN THAT IT IS PROPOSED BY THE CITY OF COSTA MESA to
annex to said City the hereinafter described real property and to the Costa Mesa
Recreation and Park District, which said real property shall in these proceedings
be known as "ALISO NO. 1 ANNEXATION' to the City of Costa Mesa and the Costa
Mesa Recreation and Park District.
The specific description of the boundaries of the territory proposed to
be annexed to the City of Costa Mesa and to the Costa Mesa Recreation and Park
District is as follows:
Beginning at a point in the existing boundary of the City of Costa Mesa as
said existing boundary is described in the Underwood Annexation to the City
of Costa Mesa, California, Ordinance No. 205, adopted June 16, 1958, said
point being the intersection of the northwesterly line of Tustin Avenue,
60 feet in width, as shown on a map of Newport Heights, recorded in Book
4, page 83 of Miscellaneous Maps, Records of Orange County, California,
with a line 110.00 feet southwesterly of and parallel with the northwesterly
line of Lot 227 of said Newport Heights; thence departing from the existing
boundary of the City of Costa Mesa, North 400 East, along said northwesterly
line of Tustin Avenue, 110.00 feet, to the northwesterly prolongation of
the north easterly line of said Lot 227; thence South 50o East, along said
northwesterly prolongation of the northeasterly line of Lot 227 and the
northeasterly line of Lot 227, 228.00 feet, to the northwesterly line of
the southeasterly 102.00 feet of the northwesterly 270 feet of the South-
westerly one-balf of Lot 237 of said Newport Heights, thence North 400 East,
along said northwesterly line, 165.07 feet, to the northeasterly line of
the southwesterly one-half of said Lot 237; thence South 500 East, along
last mentioned northeasterly line, 173.00 feet, to the southeasterly line
of the northwesterly 341.00 feet of Lot 237 of said Newport Heights;
thence North 400 East, along last mentioned southeasterly line, 165.08
feet, to the northeasterly line of said Lot 237; thence South 500 East,
along said northeasterly line of Lot 237, 289.00 feet, to the southeasterly
line of said Lot 237; thence South 400 West along said southeasterly line
of Lot 237, and the northwesterly line of Lot 238 of said Newport Heights,
165.08 feet, to the most westerly corner of Tract No. 3176, as shown on a
Record of Survey, recorded in Book 55, page 6 of Records of Surveys,
Records of Orange County, California; thence South 50D East along the south-
westerly line of said Tract No. 3176, 173.53 feet; thence South 405 West,
parallel with the northwesterly line of said Lot 238, 76.73 feet, to a
point in the southeasterly line of that certain Parcel No. 1 described in
a deed to Costa Pacifica, Inc., recorded July 3, 1961, in Book 5773, Page
19 of Official Records, Orange County, California; thence North 500 West
parallel with the southwesterly line of said Lot 238, 23.50 feet, to the
most westerly corner of said Parcel No. 1 described in said deed to Costa
Pacific, Inc., thence South 40D West, along the southeasterly line of
Parcel No. 2 as described in said deed to Costa Pacifica, Inc., 88.50 feet,
to the northeasterly line of Tract No. 2992 as shown on a map thereof,
recorded in Book 96, pages 45 and 46, Miscellaneous Maps, Records of Orange
County, California, and the existing boundary of the City of Costa Mesa as
said existing boundary is described in the Bissell Annexation to the City
of Costa Mesa, California, Ordinance No. 117, adopted January 16, 1956,
thence North 50o West, along said northeasterly line of Tract No. 2992
and said existing boundary of the City of Costa Mesa, 150.03 feet, to the
easterly comer of said Lot 227 of Newport Heights; thence South 400 West,
along the southeasterly line of said Lot 227, 110.00 feet, to the south-
westerly line of northeasterly rectangular 110 feet of said Lot 227 and
the existing boundary of the City of Costa Mesa, as described in said
Underwood Annexation to the City of Costa Mesa; thence North 500 West,
along last mentioned southwesterly line and last mentioned existing boundary
of the City of Costa Mesa, 690.00 feet, to the point of beginning.
RMTHER NOTICE IS HEREBY GIVEN, that on the 20th day of May, 1963, at the
hour of 7:30 o'clock p.m., or as soon thereafter as it may be heard in the Council
Chamber of the City Hall of the City of Costa Mesa, 695 West 19th Street, Costa
Mesa, California, hearingswill be held at which hearings the City Council shall
hear and pass upon all written protests to the annexation to the City filed at
any time before the said hour set for said hearings, by any person owning real
property within the territory so proposed to be annexed to said City and at any
time before the said hour set for said hearings any owner of property within the
territory proposed to be annexed may file a written protest against the annexation
to said City. The protest shall set forth the name of the owner of the property
affected and give a description of the property in general terms.
NOTICE IS HEREBY FURTHER GIVEN that unless more than one (1) per cent of
the total comber of voters living within the territory proposed to be annexed to
the Costa Mesa Recreation and Park District have, at or prior to said hearing,
filed written objections to said annexation, the question of annexation shall not
be submitted to the voters at an election. At the time and place fixed for said
hearing the City Council shall hear any person objecting to said annexation.
The City Clerk of the City of Costa Mesa is hereby directed and authorized
to cause a copy of this Resolution and Notice to be published once a week for two
successive weeks prior to said hearing in the ORANGE COAST DAILY PILOT, a news.
paper of general circulation printed and published in the City of Costa Mesa, and
in the SANTA ANA DAILY REGISTER, a newspaper of general circulation printed outside
the City of Costa Mesa and in the County of Orange.
