RESOLUTION NO. 63-16
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA,
CALIFORNIA, CONFIRMING THE REPORT OF THE CITY ENGINEER
DATED JANUARY 7, 1963, PREPARED PURSUANT TO THE PROVISIONS
OF THE "STREET LIGHTING ACT OF 1919,° AND REFERRED TO IN
RESOLUTION OF INTENTION NO. 63-5: AND ORDERING THE WORK AND
LEVYING THE ASSESSMENT FOR SERVICE NECESSARY TO MAINTAIN AND
ILLUMINATE BY ELECTRIC ENERGY THE STREET LIGHTS WITHIN SAID CITY.
WHEREAS, the City Council of the City of Costa Mesa, California,
did, on the 7th day of January, 1963, adopt Resolution No. 63-3 ordering the
City Engineer to make and file a report in writing pursuant to the provisions
of the "Street Lighting Act of 1919", being Part 1, Division 14 of the Streets
and Highways Code of the State of California; and
WHEREAS, the City Engineer did, on the 7th day of January, 1963, file
said report with said City Council; and
WHEREAS, said City Council approved said report by Resolution No. 63-4
adopted on the 7th day of January, 1963; and
WHEREAS, on said date said City Council did further adopt Resolution
No. 63-5 declaring its intention and ordering the proposed street lighting
improvements; and
WHEREAS, said City Council did on said date adopt Resolution No. 63-6
appointing the time and place for hearing protests to the proposed improvement;
and
WHEREAS, at the time and place above stated for hearing protests, said
City Council did proceed to hold and did hold said hearing; and
WHEREAS, at the time and place above stated for hearing protests in
reference to the proposed improvement and assessment, no protests, either
written or oral, were submitted or made; and
WHEREAS, the said City Council having held said hearing, and being
fully advised in the premises, has now acquired jurisdiction to proceed further;
NOW, THEREFORE, the City Council of the City of Costa Mesa, California,
does resolve, declare, find, determine and order as follows:

SECTION 1.
That said Council
does hereby approve,
confirm and
adopt
Ethe
report of the
City Engineer dated
January 7, 1963, and
does hereby
approve
and confirm the assessment proposed for the proposed improvement set forth and
referred to in said report, which said report is now on file in the Office of
the City Clerk of said City, open to public inspection, and hereby referred to and
made a part hereof.
SECTION 2. That the boundaries of the District as shown in said
report are hereby established and the description of said boundaries are set
forth in Exhibit "A" attached hereto and made a part hereof. That no zones
within said District are established. y
SECTION 3. That the period of time for which the proposed improvement ]
shall continue is three (3) years, beginning November 1, 1963, and ending J
October 31, 1966.
SECTION 4. That the proposed improvement is the installation of
street light standards, appliances and fixtures, and the maintenance of street
light standards, appliances and fixtures, and the furnishing of electric
current therefore.
SECTION 5. That the estimated cost of the proposed improvement for
the first year is $194,886.42; that all of the estimated cost for the first year
shall be borne by the District.
SECTION 6. The City Council does hereby order the proposed improvement
to be made; and said Council does hereby order that the estimated cost of the
proposed improvement shall
be paid by special assessment taxes
levied
upon
all the lands exclusive of
improvements within the District.

SECTION 7. That the City Clerk of said City is hereby ordered to
transmit to the County Assessor for the County of Orange, and to the State
Board of Equalization, a certified copy of this Resolution together with a map
or plat of the District and a legal description of the boundaries of said District.
SECTION 8. That the City Clerk shall certify to the passage and
adoption of this Resolution and shall cause the same to be entered among the
original Resolutions of said City; and shall make a minute of the passage and
adoption thereof in the records of the proceedings of the City Council of the
meeting at which the same was passed and adopted.
SECTION 9• That this Resolution shall take effect immediately.
