RESOLUTION NO. 65-30
RES017JTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA
OPPOSING SENATE BILL NO. 1366 RE USE OF COURTS BY CITIES
AND COUNTIES AGAINST FREEWAYS.
WHEREAS, Senate Bill No. 1366 provides that any city or county may
defend by action, in the Supreme Court, any state declared intention to con-
struct a highway or freeway or actual work of construction thereon, when a
t city or county determines that the construction would result in greater damage
L as a nusiance to the community compared to the benefits of the motoring public;
and
WHEREAS, the City of Costa Mesa has, within its boundaries, several
freeways, to wit: The Newport Boulevard Freeway, the San Diego Freeway and the
Comm del Mar Freeway; and
WHEREAS, all of said freeways also go through both other cities and
unincorporated territory within the County of Orange; and
WHEREAS, it is vital for the orderly planning and development and
growth of the City of Costa Mesa for the City to be able to plan its local
street patterns and traffic matters and zoning areas with reasonable assurance
that the adoption of a state highway or freeway route, by the Highway Commission
of the State of California, establishes the route around which all the foregoing
plans have to be based; and
WHEREAS, Senate Bill No. 1366 would take the final decision of the loca-
tion from the Highway Commission of the State of California and place such
decision in the hands of the Courts, thereby creating uncertainty, not only
prior to the adoption of the freeway route, but up to the actual work of con-
struction therOoh', thereby preventing the City of Costa Mesa from proceeding with its
planning and local traffic solutions;
BE IT FURTHER RESOLVED that the City Attorney of the City of Costa Mesa
be authorized to request from the Senate Committee on Transportation, notice
of any and all hearings on said Senate Bill No. 1366 and that the City Attorney
attend all such hearings for the purpose of fully setting forth to said Committee
the views of the City of Costa Mesa on Senate Bill No. 1366.

THEREFORE,
be it resolved by the City Council of the City of Costa
Mesa, that the said
City Council unanimously opposes Senate Bill No. 1366 and
requests
the Senate
Committee on Transportation join the City of Costa Mesa in
opposing
said bill.
