HomeMy WebLinkAbout64-65 - Gisler Drainage District - Overruling ProtestsRESOLUTION No. 64-65 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, OVERRULING PROTESTS. WHEREAS, proceedings have been instituted for the acquisition of certain easements and rights of way and the improvement of certain streets and said easements and rights of way by the construction of storm drain and appurtenances, together with appurtenant work in connection therewith under the provision of J Division 12 of the Streets and Highways Code of the State of California (being the Municipal Improvement Act of 1913); and WHEREAS, this City Council did, by its Resolution No. 64-54, fix the 20th day of July, 1964, at the hour of 7:30 o'clock p.m., in the Council Chambers of the City Council, located in the City Hall, 695 West 19th Street in the City of Costa Mesa, California, as the time and place when and where all interested persons may file written protests or objections to the proposed acquisition or improvement to be done and made, or to the extent of the Assessment District, or to the proposed assessment, or to any or all of the foregoing, all of which are more particularly referred to in Resolution of Intention No. 64-45 of the City Council adopted on the 4th day of May, 1964, and to the "Report" on file in the Office of the City Clerk; and WHEREAS, no written protests or objections in writing have been filed with the City Clerk prior to or at the time set for hearing such protests and objec- tions; and WHEREAS, at the time and place set for hearing said protests and objections to the acquisition and improvement proposed to be done and made under said Resolution of Intention No. 64-45 and said "Report", the said City Council of the City of Costa Mesa proceeded with the hearing and all persons having been heard and all maters having been duly considered. NOW, THEREFORE, IT IS RESOLVED BY THE CITY COUNCIL OF THE CITY OF COSTA MESA, as follows: SECTION 1. That all of the protests and objections of every kind and nature be, and they are hereby, overruled and denied. 1 SECTION 2. That the City Council finds that no protests or objections have been filed with the City Clerk by any owners and that a certificate of the City Clerk that no protests were filed is on file; that this City Council finds that protests and objections filed with the City Clerk were made by the owners of less than one-half of the area of the property to be assessed for the acquisition or work.
