RESOLUTION N0. 64-74
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA,
CALIFORNIA, FIXING THE AMOUNT OF REVENUE FROM PROPERTY TAXES
NECESSARY TO SUPPORT ITS DEPARTMENTS FOR THE CURRENT FISCAL
YEAR OF 1964-1965.
WHEREAS, Section 51508 of the Government Code of the State of California
requires a City Council which has transferred the duties of the Assessor and Tax

Collector to fix by ordinance or resolution the amount of revenue from property
taxes necessary to support the departments of the City for the current fiscal
year and to pay the bonded or other indebtedness of the City or any portion or
district of the City, and
WHEREAS, the City Council of the City of Costa Mesa has heretofore by
ordinance transferred the duties of the Assessor and Tax Collector to the County
of Orange, and
WHEREAS, the City of Costa Mesa has no bonded indebtedness.
NOW, THEREFORE, the City Council of the City of Costa Mesa, California, does
hereby resolve and determine as follows:
SECTION 1. The amount of revenue from property taxes necessary to support the
departments of the City of Costa Mesa for the current fiscal year of 1964-1965
is $950,000.00•
SECTION 2. That there is no bonded or other indebtedness of the City.
SECTION 3• The amount of revenue from a special assessment tax upon all
land and all improvements within the Costa Mesa Street Lighting District necessary
to support the said District for the fiscal year 1964-1965 is $171,000.00.
SECTION 4. That there is no bonded or other indebtedness of said District.

after referred to as 'DISTRICT,"

CITY OF COSTA MESA, a municipal
corporation, hereinafter referred
R E C I T A L S
A. Under authority of the Orange County Flood Control Act
District proposes to construct and improve a portion of its Santa Ana -
Delhi Channel Bond Projact Fl of the Engineers Report dated March
1955, including the construction of reinforced concrete culverts across
Sunflower Avenue for the Santa Ana -Delhi Channel and the Santa Ana
Gardens Channel.
B. Sunflower Avenue, at this location, has an existing right
of way of forty feet, the northerly portion of which is partly occu-
pied by the existing Santa Ana -Delhi Channel.
C. DISTRICT's normal obligation at the Sunflower Avenue
crossings of the Santa Ana -Delhi Channel and the Santa Ana Gardens
Channel would be the construction of a culvert thirty feet in length,
within the existing forty foot right of way.
D. To provide for ultimate street improvement of Sunflower
Avenue, CITY desires that DISTRICT construct the Santa Ana Gardens
Channel culvert 47.00 feet southerly of the existing Sunflower Avenue
centerline and the Santa Ana -Delhi Channel culvert 47.34 feet southerly
of the existing Sunflower Avenue centerline as a part of the Santa
Ana -Delhi Channel contract improvement.

E. Those portions of the Santa Ana Gardens Channel and the
Santa Ana -Delhi Channel more than 25 feet southerly of the existing
Sunflower Avenue centerline are within the City of Costa Mesa.

NOW, THEREFORE, in consideration of the mutual benefits, J
covenants and conditions herein contained, the parties hereto agree
as follows;
1. For the purpose of this agreement, any and all references
to a length of culvert set out herein shall mean length measured at
right angles to the centerline of existing Sunflower Avenue, not the
true lengths necessarily, along the centerline of construction, and
length shall mean distances measured to inside faces of parapets.
2. DISTRICT shall prepare plans and specifications for the
construction of a double 12 x 10.5' reinforced concrete culvert across
Sunflower Avenue for the Santa Ana Gardens Channel, a triple 12 x 12
reinforced concrete culvert across Sunflower Avenue for the Santa An

De_hi Channel, and the relocation of the Santa Ana -Delhi Channel now
within Sunflower Avenue to a position northerly of the existing forty
foot street right of way, and submit said plans and specifications to
CITY for review and approval.
3. DISTRICT shall upon approval of the plans and specifica-
tions by CITY and upon receipt of approval of the plans and specifica-
tions for the Santa Ana -Delhi Channel improvement by such agencies as
required undo: the provisions of the Orange County Flood Control Act,
promptly undertake and perform all the work of advertising for bids
and awarding a contract under applicable provisions of law governing
such award.
4. DISTRICT shall furnish a Resident Engineer during con-
struction of the culverts. CITY may also furnish a Resident Enginee�
to consult with DISTRICT's Resident Engineer. In the event of a
disagreement the decision of the DISTRICT's Resident Engineer shall

be final.
5. DISTRICT shall upon completion of the culverts and
filing Notice of Completion on the Santa Ana -Delhi Channel improve-
ment, bill CITY for its share of the cost as set out below.
6. CITY shall pay to DISTRICT within thirty days after
receipt of invoice from DISTRICT, CITY's proportionate share of the
cost of constructing the Sunflower Avenue culverts for the Santa Ana
Gardens and Santa Ana -Delhi Channels, said proportionate share to be
the sum of the following;
a. 22.00/78.25ths of the total cost of constructing
78.25 lineal feet of double 12 x 10.5' reinforced
concrete culvert at Sunflower Avenue for the Santa
Ana Gardens Channel, the total cost to be computed
as the quantity of the reinforced concrete, rein-
forcing steel, and gravel base bid items of culvert
.construction multiplied by the unit price paid by
DISTRICT for the respective items.
b. 22.34/69.18ths of the total cost of cors tructing
69.18 lineal feet of triple 12 x 12 reinforced
concrete culvert at Sunflower Avenue for the Santa
Ana -Delhi Channel, the total cost to be computed as
the quantity of the reinforced concrete, reinforcing
steel, and gravel base bid items of culvert con-
struction multiplied by the unit price paid by
DISTRICT for the respective items.
c. Ten percent of the sum of a, plus b, above to cover
DISTRICT's cost of design, inspection, field
engineering, final reports and acceptance.
