HomeMy WebLinkAbout64-103 - Kaiser No. 3 Annexation - Intent to call Electionv ' RESOLUTION N0. 64-103 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA DECLARING ITS INTENTION TO CALL A SPECIAL ELECTION AND FIXING THE TIME AND PLACE FOR HEARING OF PROPERTY OWNERS WITHIN THE AREA PROPOSED TO BE ANNEXED. WHEREAS, there has been presented to the City Council of the City of Costa Mesa a petition signed by more than one-fourth (.1) of the registered voters in that certain area known and designated as "KAISER NO. 3 ANNEXATIONy" setting forth their desire to be annexed to the City of Costa Mesa; and WHEREAS, this Council deems it to be in the best interest of the area pro- posed to be annexed, and of the City of Costa Mesa, that said territory be annexed to the said City; and NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF COSTA MESA AS FOLLOWS: SECTION 1. That it is the intention of the City Council of the City of Costa Mesa to call a special election in certain inhabited territory contiguous to said City, proposed to be annexed thereto, for the purpose of submitting to the electors residing in said territory the question whether or not such terri- tory shall be annexed to the City of Costa Mesa. Said territory is described as follows: Beginning'at an angle point in the existing boundary of the City of Costa Mesa as said boundary is described in the Woodland No. 2 Annexation to the City of Costa Mesa, California, adopted May 17, 1964, by Ordinance No. 64-21, said point being the most southerly corner of Lot 256 of Newport Heights and the northwesterly line of Tustin Avenue, 60 feet in width, as shown on a map of said Newport Heights, recorded in Book 4, page 83 of Miscellaneous Maps, records of Orange County, California; thence along the existing boundary of the City of Costa Mesa and the southwesterly line of said Lot 256, North 500 West, 327.00 feet to an angle point in the existing boundary of the City of Costa Mesa as described in the Kaiser No. 1 Annexation to the City of Costa Mesa, California, adopted November 16, 1961, by Ordinance No. 398; thence North 400 East, 300.15 feet along the existing boundary of the City of Costa Mesa to an angle point in said Kaiser No. 1 Annexation; thence South 500 East, 327.00 feet along the existing boundary of the City of Costa Mesa and the northeasterly line of said Lot 256 to the northwesterly line of Tustin Avenue; thence South 400 West, 300.15 feet along said northwesterly line of Tustin Avenue to the point of beginning. SECTION 2. That said territory is hereby designated and identified as 1 "KAISER NO. 3 ANNEXATION" to the City of Costa Mesa. J SECTION 3• NOTICE IS HEREBY GIVEN that on the 2nd day of November, 1964, at the hour of 7:30 o'clock p.m., or as soon thereafter as the matter may be heard, in the Council Chamber at the City Hall, 695 West 19th Street, Costa Mesa, California, any person owning real property within said territory so proposed to 320 be annexed and having any objection to the proposed annexation may appear before said City Council and show cause why such territory should not be annexed. Such protests must be in writing and shall state the name or names of the owner of the property affected by such annexation and the location and area of such property in general terms. Owner means the owner as shown on the last equalized assessment roll of the County of Orange, or the person or persons entitled to be shown as such on the last equalized assessment roll, or, where such land is subject to a recorded written agreement to buy, the purchaser under such agree- ment to buy shall be deemed the owner. If it be found that protest is not made by the owners of one-half (z) of the value of the territory proposed to be annexed, as shown by the last equalized assessment roll, further proceedings shall be taken in accordance with the law for the holding of such special election. SECTION 4. The City Clerk shall certify to the adoption of this Resolution, and cause the same to be published at least once a week for two successive weeks prior to the hearing in a newspaper of general circulation published in the terri- tory proposed to be annexed, or if there is none, in the ORANGE COAST DAILY PILOT, a newspaper of general circulation published in the City of Costa Mesa, and shall mail notices to all owners of property as required by law at least twenty (20) days prior to the date set for hearing.
