HomeMy WebLinkAbout64-113 - Kaiser No. 3 Annexation - Calling Election Jan. 12, 196533°7 RESOLUTION N0. 64-113 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, CALLING A SPECIAL ANNEXATION ELECTION IN THE MATTER OF KAISER NO. 3 ANNEXATION. WHEREAS, a public hearing in the matter of Kaiser No. 3 Annexation has been held pursuant to law; and WHEREAS, this City Council has adopted Resolution No. 64-112, pursuant to Section 35121.1 of the Government Code, that a majority protest was not made, in accordance with Section 35121 of the Government Code, that in fact no protests were made. NOW, THEREFORE, the City Council of the City of Costa Mesa does hereby resolve as follows: SECTION 1. That a special election shall be held on the 12th day of January, 1965, in certain inhabited territory contiguous to the City of Costa Mesa pro- posed to be annexed thereto for the purpose of submitting to the qualified electors residing in said territory the question of whether or not said territory shall be annexed to the City of Costa Mesa. SECTION 2. That said territory is described as follows: Beginning at an angle point in the existing boundary of the City of Costa Mesa as said boundary is described in the Woodland No. 2 Annexation to the City of Costa Mesa, California, adopted May 17, 1964, by Ordinance No. 64-21, said point being the most southerly corner of Lot 256 of Newport Heights and the northwesterly line of Tustin Avenue, 60 feet in width, as shown on a map of said Newport Heights, recorded in Book 4, page 83 of Miscellaneous Maps, records of Orange County, California; thence along the existing boundary of the City of Costa Mesa and the southwesterly line of said Lot 256, North 50o West, 327.00 feet to an angle point in the existing boundary of the City of Costa Mesa as described in the Kaiser No. 1 Annexation to the City of Costa Mesa, Califomia, adopted November 16, 1964 by Ordinance No. 398; thence North 4G° East, 300.15 feet along the existing boundary of the City of Costa Mesa to an angle point in said Kaiser No. 1 Annexation; thence South 500 East, 327.00 feet along the existing boundary of the City of Costa Mesa and the northeasterly line of said Lot 256 to the northwesterly line of Tustin Avenue; thence South 400 West, 300.15 feet along said northwesterly line of Tustin Avenue to the point of beginning. SECTION 3. That said territory is hereby designated and identified as "KAISER NO. 3 ANNEXATION". SECTION 4. That the City Clerk is hereby instructed and directed to procure and famish any and all official ballots, notices, printed matter and all supplies, equipment and paraphernalia that may be necessary in order to properly and lawfully conduct said election. SECTION 5. That the ballots to be used at said election shall be, both as to form and matter contained therein, such as may be required by law to be used thereat. SECTION 6. That upon the ballots to be used at said election there shall be L printed the words: SHALL "KAISER NO. 3 ANNEXATION" BE ANNEXED TO THE CITY OF COSTA MESA? Opposite those words there shall be printed the words "Yes" and "No", and to the right of each of these last two words there shall be a voting square. If an elector shall stamp a cross (x) in the voting square after the printed word "Yes" the vote of such elector shall be counted in favor of the annexation of said territory to the City of Costa Mesa; and if an elector shall stamp a cross (x) in the voting square after the printed word "No" the vote of such elector shall be counted against such annexation. SECTION 7. That for the purpose of holding said special annexation election, there shall be one voting place established for holding the election, designated as follows: Polling Place: Wilbur A. Young Residence 396 21st Street Inspector: Gertrude E. Pence Judge: Ruth Eisman Judge: Helen Burkardt SECTION 8. That all of the persons hereinabove named as election officers are hereby appointed as such election officers, respectively, and their compensation is hereby fixed at the sum of $15.00 for the Inspector, and $12.00 for each Judge for said election. SECTION 9• That the polls for said election shall be open at seven o'clock a.m. of the day of said election, and shall remain open continuously from said time until seven o'clock p.m. of the same day when said polls shall be closed, except as provided for in Sections 5734 and 5735 of the Elections Code of the State of California. SECTION 10. That in all particulars not recited in this Resolution, said election shall be held and conducted as provided by law for holding annexation elections in said City. R SECTION 11. That notice of the time and place of holding said election is hereby given, and the City Clerk is hereby authorized, instructed and directed to give such further or additional notice of said election in time, form and manner as required by law. SECTION 12. That the City Clerk shall certify to the passage and adoption of this resolution, shall enter the same in the book of original resolutions of said City, and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said City, in the minutes of the meeting at which the same is passed and adopted. SECTION 13• That this resolution shall take effect immediately.
