HomeMy WebLinkAbout63-76 - Fairview Road Improvement District - Ordering Work43 RESOLUTION No. 63-76 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, ORDERING THE WORK DESCREM IN RESOLUTION OF INTENTION No. 63-68, Amp= ON THE 17TH DAY OF JUNE, 1963, IN THE MATTER OF THE AC99SITEON OF RIGHTS OF WAY AND CONSTRUCTION OF IMPROVEME'M IN FAIRVIEW ROAD AND CERTAIN OTMM STREETS, ALLEYS AND EASM1 NTS. The City Council of the City of Costa Mesa, pursuant to the provisions of the "Improvement Act of 1911", being Division 7 of the Streets and Highways Code of the State of California, does hereby resolve as follows: That the public interest and convenience require the work hereinafter mentioned to be done, and therefore, said City Council hereby ordem the the following work to be done and improvements to be made in said City, to wit: The acquisition of rights of way and easement, the grading, paving, resurfacing, construction of curbs and gutters, cross gutters, spandrel, sanitary sewers, house connection sewers, manholes, water house connections, installation of water mains and reconstruction of existing water mains, installation of certain pipe and structures for drainage purposes, installation and relocation of certain fire hydrants, removal of obstructions, together with appurtenances, and appurtenant work in connection therewith, in Fairview Road and certain other streets, alleys and easements, all as more particularly described in Resolution of Intention No. 63-68, passed and adopted by the City Council of the City of Costa Mesa on the 17th day of June, 1963, and on file in the Office of the City Clerk of the City of Costa Mesa. For further particulars, reference is hereby made to said Resolution of Intention No. 63-68, and to plans, profiles and drawings for the acquisition of rights of way and for the construction of said improvements, being Plan No. 11, consisting of forty-six (46) sheets, and to the specifications for the said work heretofore adopted by the said City Council and on file in the Office of the City Clerk of said City, and all of said plans, profiles and drawings and specifications heretofore approved by the City Council of the City of Costa Mesa reference is hereby made thereto for a more particular description of the said acquisition and work. Said City Council has determined and declared that the contemplated acquisition and work or improvement hereinbefore mentioned was, in the opinion of the City Council, of more than local or ordinary public benefit and the said City Council has made the expenses of the said acquisition and work or improvement chargeable upon a district. For the particular description of the said assessment district reference is hereby made to the said Resolution of Intention No. 63-68. Said City Council has determined and declared that serial bonds bearing M interest at the rate of six per cent (6$) per annum shall be issued to represent each assessment of Fifty Dollars ($50.00) or more, remaining unpaid for thirty (30) days after the date of the recordation of the warrant. Said serial bonds shall extend over a period ending nine (9) years from the second day of January next succeeding the next September First following their date. The redemption provisions of said bonds shall require the payment of a premium of five per cent (5%) of the unpaid principal, and the words "together with a premium of five per cent (5%) of said unpaid principal" shall be added after the redemption clause in the bond form of the bonds issued. All the acquisition and work herein ordered shall be done and carried through in pursuance of an act of the Legislature of the State of California designated the "Improvement Act of 1911," being Parts 1, 2, 3, 4, 5, and 6 of Division 7 of said Streets and Highways Code. The City Clerk of the said City is hereby directed to post conspicuously for ten (10) days on or near the Chamber door of the said City Council in the manner and form required by said Code, a notice inviting sealed proposals or bids for doing the work ordered and the said City Clerk is hereby directed to publish twice in the Orange Coast Daily Pilot, a daily newspaper, printed, published and circulated in said City, and hereby designated for that purpose by the City Council, a notice inviting such proposals or bids for doing the said work and referring to the specifications on file.
