HomeMy WebLinkAbout873 - Adams No. 3 Annexation - Intent to AnnexIY� 3 RESOLUTION N0. 873 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA OF INTENTION TO ANNEX A CERTAIN UNINHABITED AREA DESIGNATED AS "ADAMS N0. 3 ANNEXATION", AND GIVING NOTICE THEREOF. WHEREAS, there is situated outside of and contiguous to the City of Costa Mesa a certain uninhabited area as hereinafter more particularly described; and WHEREAS, the owners of all the land and territory by area and by assessed valuation as shown on the last equalized assessment roll of the County of Orange have expressed themselves as desirous of having the same annexed with the City of Costa Mesa; and WHEREAS, it would be for the best interest of the City of Costa Mesa to annex the said hereinafter described property; and WHEREAS, there has been submitted, on or about the 14th day of July, 1961, to the Orange County Boundary Commission, a legal description and plat of the said hereinafter described uninhabited area, for its report, pursuant to the provisions of Section 35002 of the Government Code of the State of California; and y WHEREAS, the report of the Orange County Boundary Commission has been secured and reported upon by said Boundary Commission with respect to the definiteness and certainty of the proposed boundaries; NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Costa Mesa, a City of the Sixth Class, to annex the herein- after described real property to the City of Costa Mesa, which said real property shall, in these proceedings, be known as Annexation No. 51 to the City of Costa Mesa, and bear the nerve: "ADAMS NO. 3 ANNEXATION". The specific description of the boundaries of the terri- tory proposed to be annexed is as follows: That portion of Section 4, and that portion of Section 5, both in Township 6 South, Range 10 West, in the lands allotted to Eduardo Pollereno in decree of partition of the Rancho de Santa Ana, recorded in Book B of Judgments of the 17th Judicial District Court of Los Angeles County, State of California, in the County of Orange, State of California, described as follows: Beginning at a point in the existing boundary of the City of Costa Mesa, said point being the moat Northwesterly corner of Lot 68, in Tract No. 3380 as shown on a map recorded in Book 133, Pages 34 to 39 inclusive of Mis- cellaneous Maps in the office of the County Recorder, in the County of Orange, State of California, said point being also the Northerly terminus of that certain course having a bearing of North 290 54' 49" West and a dis- tance of 83.17 feet as shown in Mesa Verde No. 3 Annexa- tion to the City of Costa Mesa, California, Ordinance No. 305, adopted May 2, 1960; thence along the existing boundary of the City of Costa Mesa the following courses and distances: South 290 54' 49" East, 83.17 feet; thence South 400 31' 53" East, 152.35 feet; thence south 460 46,oC'East,690.28 feet to a point in the Westerly line of the land deeded to Lincoln Savings and Loan Association recorded in June 9, 1959, in Book 4777, Page 303, records of said Orange County; thence continuing along said last mentioned Westerly line and the existing boundary of the City of Costa Mesa, South 00 38' 57" East, 260.58 feet to the Southwesterly comer of the land described in said last mentioned deed; thence North 890 59' 35" East, along the existing boundary of the City of Costa Mesa as established by the Mesa Verde Annexa- tion No. 2 to the City of Costa Mesa, California, Ordinance No. 259, adopted August 24, 1959, 1.57 feet to a point on a curve, concave Southwesterly and having a radius of 800.00 feet, a radial bearing to said curve at said point bears North 620 54' 58" East; thence Southerly along said curve and the existing boundary of the City of Costa Mesa, as established by the Adams No. 2 Annexation to the City of Costa Mesa, California, Ordinance No. 335, adopted January 3, 1961, through a central angle of 260 21' 19", an are length of 367.99 feet; thence tangent to said curve South o0 43' 43" East, along said existing boundary of the City of Costa Mesa, 465.06 feet, to a point in the existing boundary of the City of Costa Mesa as established by said Adams No. 2 Annexation, said point being 50.00 feet Northerly, measured at right angles, of the center- line of Adams Avenue, as described in a deed to the County of Orange, recorded December 4, 1908 in Book 160, Page 180 of Official Records, Orange County, California; thence departing from the existing boundary of the City of Costa Mesa, South 890 16' ll" West, along a line 5D.00 feet Northerly of, measured at right angles, and parallel to the centerline of said Adams Avenue, 1030.66 feet; thence South 890 16' 24" West, along last mentioned parallel line, 2382.68 feet, to the Easterly line of the Greenville - Banning Channel, as described in a deed to the Orange County Flood Control District, recorded in Book 4367, Pages 346 to 350, inclusive, of Official Records of said Orange County; thence North 130 ll' 54" East, along said Easterly line of the Greenville -Banning Channel, 767.56 feet, to the beginning of a tangent curve, concave Easterly, having a radius of 22,538.30 feet; thence Northerly, along said curve and said Er,sterly line of the Greenville -Banning Channel, through a central angle of 20 52' 59.3", an are length of 1134.14 feet to a point in the existing boundary of the City of Costa Mesa, a radial to said curve, at said point, bears North 730 55' 06.7" West, said point also being that certain point described in Mesa Verde Annexation No. 1 to the City of Costa Mesa, Ordinance No. 227, adopted April 20, 1959, as having a radial bearing of North 730 56' 31.6" West; thence North 890 59' 35", along the existing boundary of the City of Costa Mesa as established by said Mesa Verde Annexation No. 1, 2288.17 feet, to a point in the Northwesterly line of said Tract No. 3380, said point also being on a curve, concave Northwesterly and having a radius of 840.00 feet, a radial to said curve at said point bears South 320 14' 01" East; thence Southwesterly, along said curve, said existing boundary of the City of Costa Mesa as established by said Mesa Verde Annexation No. 3 and said Northwesterly line of Tract No. 3380, through a central angle of 20 19' 12", an are length of 34.01 feet; thence tangent to said curve, South 600 05' ll" West, 66.83 feet to the point of beginning. FURTHER NOTICE IS HEREBY GIVEN, that on the 5th day of September, 1961, at the hour of 7:30 o'clock p.m. on said day, or as soon thereafter as the matter may be heard, in the Council Chamber of the City Hall of the City of Costa Mesa, 695 West 19th Street, Costa Mesa, California, a hearing will be had at which hearing the City Council shall hear and pass upon all written protests filed at any time before said hour set for said hearing by any person owning real property within the territory so proposed to be annexed, and at any time before the said hour set for said hearing, any owner of property within the territory proposed to be annexed may file a written protest against the annexation. The protest shall set forth the name of the owner of the property affected and give a description of the said property in general terms. The City Clerk of the City of Costa Mesa is hereby directed and authorized to cense a copy of this Resolution to be published once a week for two weeks prior to said hearing in the GLOBE -HERALD AND PILOT, a newspaper of general circulation printed and published in the City of Costa Mesa.
