HomeMy WebLinkAbout875 - Monrovia Avenue Improvement District - Ordering ReportRESOLUTION NO. 875 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, COVERING PRELIMINARY DETERMINATION OF THE LEGI- SLATIVE BODY UNDER "SPECIAL ASSESSMENT INVESTIGATION, LIMI- TATION AND MAJORITY PROTEST ACT OF 1931," DETERMINING THE GENERAL NATURE, LOCATION AND EXTENT OF THE PROPOSED WORK AND ACQUISITION, AND ORDERING THE PREPARATION OF A REPORT OF SAID IMPROVEMW AND ACQUISITION, IN THE MATTER OF TRE IM- PROVEMENT OF MONROVIA AVENUE AND CERTAIN OTEER STREETS, ALIEYS AND EASEMENTS (ASSESSMENT DISTRICT NO. 9). The City Council of the City of Costa Mesa, California, does hereby resolve as follows: SECTION 1. That certain improvements and acquisitions of property for public use are proposed to be done, made and acquired within the boundaries of the proposed assessment district, hereinafter described, within and without the boundaries of said City. In connec- tion therewith, said City Council hereby finds and determines as follows: A. That the nature of the proposed improvement and acquisi- tion is as follows: The acquisition of property for public use for street purposes, the grading, paving, and the construction of curbs and gutters, concrete cross gutters, sanitary sewers, house connec- tion sewers, manholes, water house connections, installation of water mains, installation of certain pipe and structures for drainage pur- poses, installation and relocation of certain fire hydrants, removal of obstructions, together with appurtenances and appurtenant work in Monrovia Avenue and certain other streets, alleys and easements, all as shown on that certain plan heretofore approved by this Council and on file in the office of the City Clerk and open to public inspection; that said plan is hereby referred to for a description of the pro- posed acquisitions and work and shall govern for all particulars relative to said acquisition and improvement. B. That the boundaries of the district of lands proposed to be assessed to pay the costs and expenses of said proposed acquisition and work and improvement are as shown upon the said plan, which plan has been heretofore approved by this Council; said plan is on file in the office of the City Clerk and open to public inspection; and said plan shall govern for all details as to the extent of said assessment district. C. That the legislative body further determines that the sum of $ .24 �". 00 , shall be contributed by the City of Costa Mesa toward the cost of the acquisition and improvement; that all other cost of said acquisition and work is to be assessed upon said district. D. The statute under which it is proposed to conduct proceedings is the "Improvement Act of 1911", being Division 7 of the Streets and High- ways Code of the State of California, with improvement bonds to be issued as authorized under the provisions of said Act; that the redemption pro- visions of said bonds require the payment of a premium of five per cent (5%) of the unpaid principal. SECTION 2. That LAURENCE J. THOMPSON, a competent person here- tofore employed by this Council for the purpose of preparing a report, is hereby required to procure all necessary information to prepare a report of the proposed acquisition and improvement in the manner and form provided in Division 4 of said Streets and Highways Code; that said report shall, as a part thereof, contain a copy of this resolution.
