HomeMy WebLinkAbout877 - Intention to Abandon Streets & Alleys - Fairview Tract.L IL35 RESOLUTION NO. 877 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA DECLARING ITS INTENTION TO ORDER THE VACATION OF EASEMENTS. WHEREAS, the County of Orange did, prior to the incorporation of the City of Costa Mesa, own certain easements described as follows and as shown on f the map on file in the office of the City Clerk of the City of Costa Mesa, ref- erence to which is hereby made: All that portion of that certain alley, fifteen (15.00) feet in width, running north and south through the center of Blocks "N", "R", and "V" as shown on a map of Fairview recorded in Book 25, pages 77 and 78, Miscellan- eous Records of Los Angeles County, California, bounded on the north by a line that is parallel with and four (4.00) feet southerly, as measured at right angles, from the westerly prolongation of the south line of Lot 10, said Block "N", and bounded on the south by the westerly prolongation of the south line of Lot 15 of said Block "V". All that portion of Lemon Street as shown on a map of Fairview, recorded in Book 25, pages 7'1 and 7d, Miscellan- eous Records of Los Angeles County, California, bounded on the north by the westerly prolongation of a line that is parallel with and ten (10.00) feet southerly, as measured at right angles, from the north line of Block "N" of said Fairview, and bounded on the south by the westerly prolongation of the south line of Block "V" of said Fairview. All that portion of that certain unnamed street, thirty (30.00) feet in width, lying westerly of Blocks 54, 552 and 57 as shown on a map of the Fairview Tract, recorded in Book 25, page 761 Miscellaneous Records of Los Angeles County, California, bounded on the north by a line that is concentric with and forty (40.00) feet southeasterly from the centerline of Adams Avenue, as described in Book 358, page 426, Official Records of Orange County, California, and bounded on the south by the south line of said Fairview Tract. All that portion of Chestnut Avenue as shown on a map of Fairview recorded in Book 25, pages 77 and 76, Mis- cellaneous Records of Los Angeles County, California, bounded on the east by a line that is parallel with and sixth (60.00) feet westerly, as measured at right angles, from the centerline of Fairview Avenue (now known as Harbor Boulevard) as said Fairview Avenue is shown on a map of said Fairview, and bounded on the west by the southerly prolongation of the west line of Block "M" of said Fairview. All that portion of Walnut Avenue as shown on a map of Fairview recorded in Book 25, pages 77 and 78, Miscellaneous Records of Los Angeles County, California, bounded on the east by a line that is parallel with and sixty (60.00) feet westerly, as measured at right angles, from the centerline of Fairview Avenue (now known as Harbor Boulevard) as shown on a map of said Fairview, and bounded on the west by the southerly prolongation of the west line of Block "Q" of said Fairview. x!;36 and, All that portion of Palm Avenue as shown on a map of the Fairview Tract, recorded in Book 25, page 76, Miscella- neous Records of Los Angeles County, California, bounded on the east by the southerly prolongation of the east line of Block 56 as shown on a map of said Fairview Tract, and bounded on the west by the west line of said Fairview Tract. All that portion of that certain unnamed street, thirty (30.00) feet win width, lying southerly of Blocks 57 and 58 as shown on a map of the Fairview Tract recorded in Book 25, page 76, Miscellaneous Records of Los Angeles County, California, bounded on the east by the southerly prolongation of the east line of said Block 58, and bounded on the west by the west line of said Fairview Tract. WHEREAS, the Board of Supervisors of the County of Orange did on July 30, 1958, adopt a resolution abandoning the above described easements but reserved and excepted the following: and, Reserving and excepting from this abandonment an easement or easements and right to maintain, operate, replace, remove and renew all now existing sanitary sewers and storm drains and appurtenant structures in, upon and over the said highway and all portions thereof, and pursuant to any existing franchise or renewal thereof to maintain, operate, replace, remove,. renew and enlarge all now existing lines of pipe, conduits, cables, wires, poles, and other convenient structures, equipment and fixtures for the operation of gas pipe lines, telegraphic and telephone lines, railroad lines, and for the transportation or distribution of electric energy, petroleum and its products, ammonia, water, and for incidental purposes. WHEREAS, subsequent to the said action by the Board of Supervisors as aforesaid, the territory described in said easements has become a part of the City of Costa Mesa and the City of Costa Mesa now possesses all the rights formerly reserved and excepted by the Board of Supervisors, and WHEREAS, the City Council of the City of Costa Mesa, on its own motion, finds that the rights reserved in said reservation above set forth to use said easements to maintain, operate, replace, remove and renew all now existing sanitary sewers, storm drains and appurtenant structures in and upon the same are not necessary for such uses and have in fact not been used for such purposes for five (5) consecutive years prior to this date and that it is to the best interest of the City that the rights reserved by said Board of Supervisors in said easements be vacated and abandoned. NOW, THEREFORE, the City Council of the City of Costa Mesa, does hereby resolve and determine as follows: SECTION 1. That the City Council of the City of Costa Mesa, on its own motion, does hereby declare its intention to vacate and abandon, release and relinquish all its right, title and interest in and to the easements above described. SECTION 2. That the aforesaid described easements have not been used for any purpose for five (5) consecutive years prior to the date hereof and are not necessary for any public purpose in the future. SECTION 3. That Monday, September 18, 1961, at the hoar of seven - thirty o'clock (7:30 p.m.) in the Chambers of the City Council, located in the Costa Mesa City Hall, 695 West 19th Street, Costa Mesa, California, is hereby fixed as the time and place for hearing all persons interested in or objecting to the proposed abandonment and vacation of all the right, title and interest of the City of Costa Mesa in and to the above described easements. SECTION 4. The City Clerk of the City of Costa Mesa is hereby directed to cause notices of the said proposed vacation to be posted conspicuously along the line of the easements proposed to be vacated in the manner provided by law. SECTION 5• The City Clerk shall cause this resolution to be published in the Costa Mesa Globe -Herald and Pilot, a newspaper of general circulation printed and published in the City of Costa Mesa, for at least two (2) con- secutive weeks prior to the date set for the hearing.
