RESOLUTION NO. 745
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA,
CALIFORNIA, ORDERING CERTAIN ADDITIONS, ALTERATIONS, OMIS-
SIONS FROM AND DECREASES IN THE THINGS PROPOSED TO BE DONE
AS SET FORTH IN THE REPORT FILED UNDER DIVISION 4 OF THE
STREETS AND HIGHWAYS CODE OF THE STATE OF CALIFORNIA, AND
FINDING THAT SUCH ADDITIONS, ALTERATIONS, OMISSIONS AND
DECREASES DO NOT INCREASE THE ESTIMATED COST BY MORE THAN
ONE-TENTH OF THE TOTAL ESTIMATED COST.
WHEREAS, this City Council has heretofore taken steps provided by Sections
2821, 2822 and 2823 of the Streets and Highways Code of the State of California; and
WHEREAS, this City Council directed Laurence J. Thompson to procure the req-
uired information and prepare and present to this City Council the written report on
the acquisition, work and improvement, and said report has been presented and app-
roved by this City Council; and
WHEREAS, by Resolution, this City Council fixed a time and place for hearing
by it on said report; and
WHEREAS, notice of said hearing was mailed as required by said Division 4
of the Streets and Highways Code of the State of California; and
WHEREAS, at the time and place so fixed a hearing was duly held by this City
Council, at which all written protests or objections were presented, read and all per-
sons desiring to be heard thereon were heard, and this City Council gave all persons

present an opportunity to be heard in respect to any matter relating to said report,
said acquisition, work or improvement, or any of the proceedings therefor; and
WHEREAS, all persons desiring to appear and be heard at said hearing were
heard, and said hearing has been regularly held; and
WHEREAS, this Council adopted Resolution No. 742, determining the results of
hearing, overruling protests, determining that the public interest, convenience and
necessity require certain acquisition, work or improvement of Santa Ana Avenue and
Certain Other Streets, Alleys and Easements, substantially as set forth in the re-
port on the project filed under the "Special Assessment Investigation, limitation
and Majority Protest Act of 1931"1 and determining that said project is feasible; and
WHEREAS, this Council has found and determined certain additions, alterations,
omissions from and decreases in the things proposed to be done; and
+i WHEREAS, this Council has ordered the Engineer to make certain additions,
alterations, omissions from and decreases in the things proposed to be done as set
forth in said report; and
WHEREAS, said additions, alterations, omissions from and decreases in the
things proposed to be done do not increase the estimated cost by more than one-tenth
of the total estimated cost as stated in said report;

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COSTA MESA, DOES HEREBY
RESOLVE AS FOLLOWS:
SECTION 1. That the following acquisitions and items of work to be added,
omitted from and decreased in the things proposed to be done as set forth in the
report filed under Division 4 of the Streets and Highways Code of the State of
California, and certain additions and alterations made as follows:
A. The addition of 125.0 l.f. of house connection sewers as shown on the
diagram.
B. The addition of 6 water service house connections as shown on the diagram.
C. The grading, paving with plant mixed surfacing material over rock base
and seal coat, construction of cement combination curbs and gutters,
curb return, cement concrete cross gutters and spandrel, vitfified clay
pipe sewer main, manholes, vitrified clay pipe house connection sewers,
asbestos cement water main and appurtenances, copper tubing water ser-
vice house connections, installation of fire hydrants and gate valves,
removing obstructions, and appurtenant work in connection therewith on
Tulip Lane between Elden Avenue and Orange Avenue, as shown on the
diagram.
D. The construction of cement concrete combination curbs and gutters on
Orange Avenue at its intersection with Walnut Place, as shown on the
diagram.
E. The construction of concrete storm channel and appurtenant work in conn-
ection therewith in the following public easements:
(1) In the easement over and across the following described real
property, to wit: A strip of land 4.00 feet wide, lying within
Lot 253, Newport Heights as shown on a map thereof recorded in
Book 4, page 83 of M scellaneous Maps, Records of Orange County,
California, the centerline of whihh is described as follows:
Beginning at a point on the southwesterly line of said Lot 253,
305.00 feet southeasterly of the most westerly comer thereof;
thence northeadterly parallel with the northwesterly line of Lot
253 North 400 East, 115.81 feet; thence North 00 15'09" West,
53.62 feet to a point South 240 03' 47"West, 45.00 feet from a
point on the northeasterly line of the southwesterly 200 feet of
said lot 253, said point being 258 feet southeasterly of the
northwesterly line of Lot 253, measured along the northeasterly
line of the southwesterly 200 feet of said Lot 253; and
(2) In the easement over and across a portion of Lot 108, Tract 300
in the City of Costa Mesa, as shown on a map thereof recorded
in Book 14, pages 11 and 12 of Miscellaneous Maps, Records of
Orange County, California, described as follows:
A strip of land 5 feet in width, being the southwesterly 5 feet
feet of the northeasterly 210 feet of said Lot 108 (measured from
the centerline of Santa Isabel Avenue);
as shown on the diagram.
F. The elimination of 2210 l.f. of house connection sewers as shown on the
diagram.
G. The elimination of 4 water service house connections as shown on the
diagram.
H. The elimination of the acquisition of rights of way Nos. 7, 10, 156,
169, 216, 217, 218, 219, 220, 221, and 222, as shown on the diagram.
I. The elimination of grading, 2" plant mixed surfacing material over 4"
rock base, and removing of obstructions on that portion of Flower Street
between Raymond Avenue and Tustin Avenue, as shown on the diagram.

J. The elimination of I" plant mixed resurfacing material and seal coat
on that portion of Fullerton Avenue between 19th Street and 20th Street,
as shown on the diagram.
K. The elimination of the grading, paving with plant mixed surfacing met-
erial over rock base and seal coat, construction of cement concrete
curbs and glitters, curb returns, alley aprons, removing obstructions,
and appurtenant work in connection therewith on Walnut Place between
Fullerton Avenue and Orange Avenue, as shown on the diagram.
L. The elimination of grading, paving with plant mixed surfacing material
over rock base and seal coat, construction of cement concrete cross gutter
and spandrel, removing obstructions, and appurtenant work in connection
therewith in the following portions of streets:
(1) That portion of Westminster Place described as the northwesterly
30 feet of the northeasterly 150 feet of Lot 107, Tract No. 300,
in the City of Costa Mesa, and
(2) That portion of Camellia Lane described as the southwesterly 25
feet of the northwesterly 155.7 feet of Lot 283, Newpmrt Heights,
as shown on the diagram.
M. The elimination of cement concrete combination curbs and gutter in the
following portions of streets:
(1) Orange Avenue at its intersection with Tulip Lane, and
(2) Elden Avenue at its intersection with Tulip Lane,
as shown on the diagram.
SECTION 2. That said additions, alterations, omissions from and decreases:.
in said work do not increase the estimated cost by more than one-tenth of the total
estimated cost as set forth in said report.
