RESOLUTION N0. 652
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA
DECLARING ITS INTENTION TO CALL A SPECIAL ELECTION TO SUBMIT
TO THE QUALIFIED ELECTORS RESIDING IN THE HEREINAFTER DES-
CRIBED TERRITORY THE QUESTION OF ANNEXATION OF SAID TERRITORY
TO THE CITY OF COSTA MESA.
WHEREAS, on the 31st day of July, 1959, certain proponents presented a
written request to the City of Costa Mesa asking said City to give its consent to
said proponents to proceed under the Inhabited Annexation Act of 1913 to annex
certain inhabited territory, more particularly hereinafter described, to the City
of Costa Mesa; and
WHEREAS, said written request was duly presented to the Planning Commission
of the City of Costa Mesa for its report and recommendations; and
WHEREAS, on August 1, 1959, the City Council did receive from the City
Planning Commission its recommendation approving the proposed annexation; and
WHEREAS, the proposal for the annexation for said territory to the City
of Costa Mesa was submitted to the Boundary Commission of the County of Orange for
its report to the proponents with respect to the definiteness and certainty of the
proposed boundaries, and said Boundary Commission reported upon the petition or pro-
ceedings; and
WHEREAS, City Council did, on the 1st day of August, 1959, adopt its
.the
resolution giving its consent to the commencement of said annexation proceedings and
approving the circulation of a petition for the annexation of said territory to the
City of Costa Mesa; and
WHEREAS, on the 3rd day of August, 1959, said proponents did cause to be
published a Notice of Intention to Circulate a Petition for the annexation of the
hereinafter described territory to the City of Costa Mesa, and on said day did file
with the City Clerk of the City of Costa Mesa a copy of such Notice of Intention to
Circulate a Petition for the annexation to the City of Costa Mesa of said territory,
which notice contained the names of the proponents intending to circulate the petition
and the specific boundaries of the territory proposed to be annexed together with an
Affidavit of Publication of said Notice of Intention to Circulate said Petition; and
WHEREAS, the City Council did on August 3, 1959, adopt its resolution find-
ing and determining that it would be to the advantage and for the best interests of
the City of Costa Mesa and the qualified electors residing within the hereinafter des-
cribed territory, to approve the circulation of a petition for the annexation of said
territory to the City of Costa Mesa, and did thereupon approve the circulation of said
petition and acknowledge the receipt of said copy of Notice of Intention to Circulate
said Petition and said Affidavit of Publication; and

WHEREAS, the City Council did receive a petition signed by not less than one-fourth
of the qualified electors residing within the territory hereinafter described, as
shown by the County Registration of Voters, containing a description of the new terr-
itory proposed to be annexed to the City of Costa Mesa and asking that said territory
be annexed to said City; and
WHEREAS, the City Council does find and determine that said proponents have
Act; and, that said petition was circulated more than twenty-one (21) days after the
publication of Notice of Intention to Circulate said Petition; and, that it is signed
by not less than one-fourth of the qualified electors residing within the territory
proposed to be annexed, as shown by the County Registration of Voters and as appears
from the certificate of the City Clerk of the City of Costa Mesa presented to the City
Council at the time of consideration of said petition and prior to the adoption of this
resolution; and
WHEREAS, the City Council does further find that more than twelve (12)
qualified electors resided within the boundaries of the territory proposed to be ann-
exed at the time of filing of said petition for said annexation; and

as required by
the provisions of said
Act; and, that said petition was circulated more than twenty-one (21) days after the
publication of Notice of Intention to Circulate said Petition; and, that it is signed
by not less than one-fourth of the qualified electors residing within the territory
proposed to be annexed, as shown by the County Registration of Voters and as appears
from the certificate of the City Clerk of the City of Costa Mesa presented to the City
Council at the time of consideration of said petition and prior to the adoption of this
resolution; and
WHEREAS, the City Council does further find that more than twelve (12)

the City of Costa Mesa did not form a part of any other city or municipal corporation;
and, that said territory was, at the time of filing said petition, inhabited territory
and is contiguous to the City of Costa Mesa; and
WHEREAS, the City Council does further find that it would be to the advantage
and for the best interests of the City of Costa Mesa and the residents thereof and the
qualified electors residing within the territory proposed to be annexed, to submit the
question of the annexation of said territory to the City of Costa Mesa to the electors
residing within the said territory; and
WHEREAS, the City Council does further find that said territory should be
designated by some appropriate name and so referred to upon the ballots used at the

and for the best interests of the City of Costa Mesa and the residents thereof and the
qualified electors residing within the territory proposed to be annexed, to submit the
question of the annexation of said territory to the City of Costa Mesa to the electors
residing within the said territory; and
WHEREAS, the City Council does further find that said territory should be
designated by some appropriate name and so referred to upon the ballots used at the
ropriate designation for such territory is BRISTOL NO. 3 ANNEXATION; and
WHEREAS, the City Council finds, from said petition and evidence and reports
received that the boundaries of the territory as proposed and sought to be annexed to
the City of Costa Mesa are as follows, to wit:

WHEREAS, the City Council finds, from said petition and evidence and reports
received that the boundaries of the territory as proposed and sought to be annexed to
the City of Costa Mesa are as follows, to wit:

Beginning at a point in the existing boundary of the City
of Costa Mesa, said point being the intersection of the southerly
line of Baker Street 80.00 in width with the southerly prolongation
of the easterly line of Lot 4, Block E, Berry Tract, as shown on a
map recorded in Book 9, page 6, Miscellaneous Records of Los Angeles
County, California; thence easterly along the said southerly line
of Baker Street and the easterly prolongation thereof to the south-
easterly line of Newport Avenue; thence northeasterly along said
southeasterly line of Newport Avenue; to the westerly line of Mac-
Arthur Boulevard; thence northerly along said westerly line of
MacArthur Boulevard and the westerly line of Main Street to the southerly
line of Sunflower Avenue; thence westerly along said southerly line
of Sunflower Avenue to the easterly line of Bristol Street; thence
southerly along said easterly line of Bristol Street to the northerly
line of said Berry Tract; thence westerly along said northerly line
of the Berry Tract to the easterly line of Bear Street; thence south-
erly along said easterly line of Bear Street and the southerly pro-
longation thereof to the southerly line of Paularino Avenue; thence
westerly along said southerly line of Paularino Avenue to the west-
erly line of Lot 1, Block B, of said Berry Tract; thence southerly
along said westerly line of Lot 1, to a line 330.00 feet southerly
of and parallel to the centerline of Paularino Avenue; thence easterly
along said parallel line to the easterly line of said Lot 1 and 10
to said northerly line of Baker Street; thence easterly along said
northerly line of Baker Street to the westerly line of Lot 4, Block E,
Berry Tract, as shown on a map recorded in Book 30, page 74, Miscel-
laneous Records of Los Angeles County, California; thence northerly
along said westerly line of Lot 4 to a point; said point being 412.50
feet northerly of the southerly line of Lot 5 of said Block E, Berry Tract;
thence westerly along a line parallel to said southerly line of Lot 5,
3.80 feet; thence northerly parallel to said westerly line of Lot 4
to the southerly line of Paularino Avenue; thence easterly along said
southerly line of Paularino Avenue to the easterly line of the West
one acre of the northerly one-half of Lot 3, Block E of said Berry
Tract; thence southerly along said east line of the West one acre of
the Northerly one-half of Lot 3 to the southerly line of the north-
erly one-half of Lot 3; thence westerly along said southerly line of
the northerly one-half of Lot 3, to the easterly line of said Lot 4;
thence southerly along said easterly line of Lot 4 and the southerly
prolongation thereof to the point of beginning.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Costa
Mesa that it does hereby declare its intention to call a special election on the
19th day of January, 1960, for the purpose of submitting to the electors residing
in the hereinabove described new territory the question whether said new territory
shall be annexed to, incorporated in, and made a part of the City of Costa Mesa; and
BE IT FURTHER RESOLVED, that the territory so proposed to be annexed shall
be designated as BRISTOL NO. 3 ANNEXATION; and
BE IT FURTHER RESOLVED, that the 26th day of October, 1959, at the hour
of 8:00 o'clock P.M., in the City Council Chamber at the City Rall of the City of
Costa Mesa be, and the same is hereby, fixed as the day, hour and place where any per-
son owning real property within the territory so proposed to be annexed and having any
objections to the proposed annexation, may appear before the City Council of the City

of Costa Mesa and show cause why such .territory should not be so annexed; that all
persons having any objections to such proposed annexation are hereby notified to
appear on said day, at said hour and place, to show cause, if any they have, why
such territory should notb be so annexed; and, that all such persons are further
notified that any protests against the calling of an election to submit to the electors

residing within said territory the questionof annexation of said territory to the
City of Costa Mesa, or any protests against the annexation of said territory to the
City of Costa Mesa, must be in writing and may be filed with the City Clerk of the
City of Costa Mesa at any time not later than the hour and day set forth herein for
the hearing of objections to said election, or within Yken ten (10) days thereafter,
or as otherwise provided by law; and
BE IT FURTHER RESOLVED, that the City Clerk of the City of Costa Mesa be,
and he is hereby, authorized and directed to cause a copy of this resolution to be
published once a week for two successive weeks, prior to the date hereinabove fixed
for the hearing of protests and objections to said election and the annexation of
said territory to the City of Costa Mesa, in the GLOBE -HERALD and PILOT, a newspaper
of general circulation, published and circulated in the City of Costa Mesa, County of
Orange, State of California; and
BE IT FURTHER RESOLVED that the City Clerk of the City of Costa Mesa be,
and he is hereby, authorized and directed to cause written notice of such proposed
annexation to be mailed to each owner of an equitable or legal interest in land,
other than an easement or right of way, within the territory proposed to be annexed
who has filed his name and address and a general description of such land sufficient
to identify it on the last equalized assessment roll with said Clerk, and that said
notice be mailed not less than twenty (20) days before the time hereinabove fixed
for the hearing of protests and objections to said election and the annexation of
said territory to the City of Costa Mesa.
