HomeMy WebLinkAbout674 - Merger of City and Costa Mesa County Water District1076 RESOLUTION NO. 674 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA MERGING ITS WATER FACILITIES INTO THE COSTA MESA COUNTY WATER DISTRICT, PURSUANT TO SENATE BILL NO. 1375 (NOW KNOWN AS CHAPTER 1377, STATUTES 1959)• WHEREAS, Senate Bill No. 1375 (now known as Chapter 1377, Statutes 1959), was enacted by the 1959 Session of the Legislature of the State of California, allow- ing for the dissolution of the Fairview County Water District, the Newport -Mesa County Water District, the Newport Heights Irrigation District and the Newport -Mesa Irrigation District and their merger into the Costa Mesa County Water District; and WHEREAS, said Senate Bill No. 1375 (now known as Chapter 1377, Statutes 1959), above referred to further allowed the City of Costa Mesa to merge its water facilities into the Costa Mesa County Water District; and WHEREAS, the City Council of the City of Costa Mesa has been informed and ad- vised that the Fairview County Water District, the Newport -Mesa County Water District and the Newport Heights Irrigation District are adopting resolutions dissolving their respective districts and merging into the Costa Mesa County Water District, pursuant to said Senate Bill No. 1375 (now known as Chapter 1377, Statutes 1959); and WHEREAS, said Senate Bill No. 1375 (now known as Chapter 1377, Statutes 1959), provides that the City Council of the City of Costa Mesa may adopt a resolution at any time prior to January 1, 1960, merging its water facilities into the Costa Mesa County Water District; and WHEREAS, the City Council has long advocated and has, with the cooperqtion of others, encouraged and worked towards the merger of the aforesaid water districts, and it is to the best interests of the City of Costa Mesa and to the citizens thereof that the City merge and transfer to the Costa Mesa County Water District its water facilities in order that one agency will have the responsibility for planning and carrying out a complete water program, including vitally needed water storage capacity for the entire Costa Mesa area: NOW, THEREFORE, it is hereby resolved by the City Council of the City of Costa Mesa as follows: Section 1. That pursuant to the provisions of the Costa Mesa District Merger law, the water facilities set forth in Exhibit "A", attached hereto and by this ref- erence made a part hereof, are hereby merged and transferred to the Costa Mesa County Water District. Section 2. That pursuant to the provisions of the Costa Mesa District Merger law, there is attached hereto marked Exhibit "B", and by this reference made a part hereof, a description of the boundaries of the City of Costa Mesa as the same exists as of the date of the adoption of this resolution. A 10" Section 3• That the effective date of this resolution shall be the date that that certain written agreement between the City of Costa Mesa and the Costa Mesa County Water District is executed by the Costa Mesa County Water District; that a copy of said agreement above referred to is attached hereto marked Exhibit "C", and by this reference made a part hereof. Section 4. That the City Clerk of the City of Costa Mesa is directed to cause a certified copy of this resolution to be recorded with the Recorder of Orange County, California, immediately upon receipt by him of the executed agreement referred to in Section 3 above. Section 5• That the City Council of the City of Costa Mesa does hereby express its desire and willingness to cooperate with the new Costa Mesa County Water District in any way desired by said new District in order to achieve the full solution of the water and water storage problems in the Costa Mesa area.
