HomeMy WebLinkAbout98-81 - Approving an agreement for donation of surplus fire ladders to the Santa Ana College Fire Academy1 1 1 RESOLUTION NO. 98-81 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, APPROVING AN AGREEMENT FOR DONATION OF SURPLUS FIRE LADDERS TO THE SANTA ANA COLLEGE FIRE ACADEMY. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, the Costa Mesa Fire Department has an inventory of surplus fire ladders that do not comply with current Fire Department standards and have no salvage value; and WHEREAS, the donation of such surplus fire ladders to the Santa Ana College Fire Academy would promote fire suppression education activities to benefit the public health, safety, and welfare; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Costa Mesa hereby authorizes the Fire Chief to execute the agreement to donate the subject surplus fire ladders to the Santa Ana College fire Academy, a nonprofit corporation. The agreement is approved as shown in attached Exhibit "A", and incorporated herein by this reference. PASSED AND ADOPTED this 21 ' day of September, 1998. Deputy Cio Clerk and ex -officio Clerk of the City Council of the City of Costa Mesa 39 DONATION AGREEMENT This Agreement, dated August 17, 1998, is made between the CITY OF COSTA MESA, a municipal corporation (CITY) and SANTA ANA COLLEGE, a non- profit corporation (DONEE). The CITY has found that certain Fire Department fire ladders are surplus property and suitable for donation to the Santa Ana College Fire Academy for use in fire suppression education activities. Accordingly, the parties hereto agree as follows: 1. CITY shall transfer fifteen (15) fire ladders to DONEE and release any and all title and interests in such fire ladders to DONEE. 2. DONEE shall assume ownership and full responsibility for all related and unrelated expenses for the fire ladders. 3. DONEE shall assume all liability for the fire ladders and agrees to protect, defend, indemnify and hold harmless the CITY and its elected and appointed boards, officers, agents and employees from any and all claims, liabilities, expenses, or damages of any nature, including attorneys fees, for injury to or death of any person, and for injury to any property, including consequential damages of any nature resulting therefrom, arising out of or in any way connected with the fire ladders or the performance of this Agreement.
