HomeMy WebLinkAbout98-87 - Waiving publication of notice to bidders for the 2569 Santa Ana Avenue Historic House Relocation49 RESOLUTION NO. 98-87 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, WAIVING PUBLICATION OF NOTICE TO BIDDERS FOR THE 2569 SANTA ANA AVENUE HISTORIC HOUSE RELOCATION. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY FIND AND DECLARE AS FOLLOWS: WHEREAS, on September 221, 1998, the City Council received and accepted an offer from Eric Cernich of Real Estate Exchange, Inc. to donate a historic house located at 2529 Santa Ana Avenue, Costa Mesa; and WHEREAS, the donation is conditioned upon the expedited relocation of the historic house from the parcel at 2529 Santa Ana Avenue to a public site to commence on or after October 15, 1998; and WHEREAS, if the historic house is not relocated in an expedited time, the donor's development project will be delayed and the historic house could be demolished; and WHEREAS, due to the expedited relocation project, the normal time frame to publish the City of Costa Mesa Notice to Bidders for the 2529 Santa Ana Avenue historic house relocation is not feasible as required by the Public Contracts Code, and the above -referenced circumstances for expedited relocation of the historic house justify waiving the publication requirements in order to comply with the donation offer and saving the historic house from demolition; and WHEREAS, waiving the publication notice to bidders has not resulted in an unfair competitive advantage because the City of Costa Mesa has delivered the notice to contractors holding themselves out as experienced in relocation of historic houses; and WHEREAS, waiving the publication requirement and saving the historic house from demolition will serve to protect the public health, safety, and welfare; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Costa Mesa that the publication of Notice to Bidders for the 2529 Santa Ana Avenue historic house relocation project required by the California Public Contracts Code is hereby waived and the Notice to Bidders is found to provide adequate notice of the invitation to bid on the project to comply with such statute.
