RESOLUTION NO. 98-97
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
COSTA MESA, CALIFORNIA, APPROVING AN
AGREEMENT FOR SALE OF A SURPLUS COMPUTER,
MONITOR, AND PRINTER.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE
AS FOLLOWS:
WHEREAS, the City of Costa Mesa has a surplus computer, monitor, and
printer which are several years old due to use by the assigned City officer and has a
salvage value of an estimated sum of less than $500.00; and
WHEREAS, the sale of such surplus equipment to Peter Buffa, the former
Mayor of the City, would honor him for his 14 years of service to the City and the sale
proceeds will benefit the public health, safety, and welfare;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City
of Costa Mesa, California, hereby declares the above -referenced equipment surplus,
and authorizes the City Manager to execute the agreement for sale of the surplus
equipment to Peter Buffa, an individual, for the sum of $499.00. The agreement is
approved as shown in Exhibit "A", attached hereto and incorporated herein by this
reference.

I, MARY T. ELLIOTT, Deputy City Clerk and ex -officio Clerk of the City Council
of the City of Costa Mesa, hereby certify that the above and foregoing
Resolution No. 98-97 was duly and regularly passed and adopted by the said City
Council at a regular meeting thereof, held on the 7"' day of December, 1998.

EXHIBIT A
AGREEMENT
This Agreement, dated December 7, 1998, is made between the CITY OF
COSTA MESA, a municipal corporation (CITY) and PETER BUFFA (BUYER).
The CITY has found that certain computer, monitor and printer equipment,
listed in the attached Exhibit 1, and incorporated herein by this reference, are surplus
property and suitable for sale to the BUYER.
Accordingly, the parties hereto agree as follows:
1. CITY shall transfer a computer, monitor and printer to BUYER and
release any and all title and interests in such equipment to BUYER.
2. BUYER shall pay the sum of $499.00 to CITY and thereafter assume
ownership and full responsibility for all related and unrelated expenses for the
computer, monitor and printer, and shall obtain the necessary licenses for use of any
software remaining therein.
3. BUYER shall assume all liability for the computer, monitor, printer and
software, and agrees to protect, defend, indemnify and hold harmless the CITY and
its elected and appointed boards, officers, agents and employees from any and all
claims, liabilities, expenses, or damages of any nature, including attorneys fees, for
injury to or death of any person, and for injury to any property, including
consequential damages of any nature resulting therefrom, arising out of or in any way
connected with the computer, monitor, printer and software or the performance of
this Agreement.
4. BUYER shall copy on a memory diskette all original public records of
CITY, if any, from the computer memory and transmit such records to the CITY
within seven (7) calendar days of execution of this Agreement.
