RESOLUTION NO. 99-1
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
COSTA MESA, CALIFORNIA, DENYING PLANNING
APPLICATION PA -98-85.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE
AS FOLLOWS:
WHEREAS, an application was filed by Dennis Siggins, authorized agent for
Paul and Linda Licata, with respect to real property located at 996 Springfield Street
requesting a variance from rear yard setback requirements in conjunction with the
addition of three second -story bedrooms totaling 653 square feet over a renovated
master bedroom of an existing single-family residence, in the R1 zone; and
WHEREAS, a duly noticed public hearing was held by the Planning Commission
on December 14, 1998, at which time the Planning Commission denied the request;
and
WHEREAS, the applicants filed an appeal with the City Council on
December 21, 1998; and
WHEREAS, a duly noticed public hearing was held by the City Council on
January 4, 1999;
NOW, THEREFORE, BE IT RESOLVED that based on the evidence in the record
and the findings contained in Exhibit "A", the City Council of the City of Costa Mesa
hereby denies Planning Application PA -98-85 with respect to the property described
above.
PASSED AND ADOPTED this 4"' day of January, 1999.

EXHIBIT "A"
FINDINGS
A. The information presented does not substantially comply with section 13-29(g)
(1) of the Costa Mesa Municipal Code in that although the property is
irregularly shaped, adequate space exists on the site to allow for the
construction of a second floor that complies with code requirements or
minimizes the extent of setback encroachment. Strict application of the zoning
ordinance will not deprive the property owner of privileges enjoyed by owners
of other property in the vicinity under identical zoning classification.
Specifically, the proposed addition could be made over the existing
kitchen/dining area where a 16 -foot to 24 -foot rear setback rather than the
requested 10 -foot to 16 -foot setback would result. Locating the addition over
the existing garage would not require a variance or an administrative
adjustment.
B. The project has been reviewed for compliance with the California
Environmental Quality Act (CEQA), the CEQA Guidelines, and the City
environmental procedures, and has been found to be exempt from CEQA.
C. The project is exempt from Chapter XII, Article 3, Transportation System
Management, of Title 13 of the Costa Mesa Municipal Code.
