HomeMy WebLinkAbout99-10 - Approving Master Plan PA -98-941'7'7 RESOLUTION NO. 99-10 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, APPROVING MASTER PLAN PA -98-94. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, an application was filed by South Coast Plaza, with respect to the real property located at 3333 Bear Street, requesting approval of a master plan amendment to allow a new building area to encroach into the required setback in the PDC zone; and WHEREAS, a duly noticed public hearing was held by the Planning Commission on January 25, 1999, at which time the Planning Commission recommended approval of the request to the City Council; and WHEREAS, the City Council held a duly noticed public hearing on February 16, 1999; NOW, THEREFORE, BE IT RESOLVED that based on the evidence in the record, the findings contained in Exhibit "A", and subject to conditions of approval contained in Exhibit "B", the City Council hereby approves Master Plan PA -98-94 with respect to the property described above. BE IT FURTHER RESOLVED that the City Council hereby finds and determines that adoption of this resolution is expressly predicated upon the activity as described in the staff report for Master Plan PA -98-94, and upon applicant's compliance with each and all conditions contained in Exhibit "B". Should any material change occur in the operation, or should the applicant fail to comply with the conditions of approval, then this resolution and any recommendation for approval herein contained, shall be deemed null and void. The information presented substantially complies with Costa Mesa Municipal Code Section 13-29(g)(5) in that the master plan meets the broader goals of the General Plan, the North Costa Mesa specific Plan, and the Zoning Code by exhibiting excellence in design, site planning, integration of uses and structures, and protection of the integrity of neighboring development. B. The project has been reviewed for compliance with the California Environmental Quality Act (CEQA), the CEQA Guidelines, and the City environmental procedures, and has been found to be exempt from CEQA. C. The project is exempt from Chapter XII, Article 3, Transportation System Management, of Title 13 of the Costa Mesa Municipal Code. The applicant shall contact the Planning Division to arrange for a "special requirements" inspection of the site prior to the release of occupancy. This inspection is to confirm that the conditions of approval and code requirements have been satisfied. 2. The conditions of approval and ordinance or code provisions of Master Plan PA -98-94 shall be blueprinted on the face of the site plan. CODE REQUIREMENTS The following list of federal, state and local laws applicable to the project has been compiled by staff for the applicant's reference. Any reference to "City" pertains to the City of Costa Mesa. Ping. 2. Bldg. 3. Trans. 4. All contractors and subcontractors must have valid business licenses to do business in the City of Costa Mesa. Final inspections, final occupancy and utility releases will not be granted until all such licenses have been obtained. Approval of the master plan is valid for one (1) year and will expire at the end of that period unless building permits are obtained or the applicant applies for and is granted an extension of time. Comply with the requirements of the Uniform Building Code as to design and construction and CCR Title 24 pertaining to "Disabled Access Regulations". Fulfill San Joaquin Hills Transportation Corridor Fee Ordinance requirement at the time of issuance of building permit by submitting the required fee to the Planning Division For the proposed use, the corridor fee is estimated as 5472.32. SPECIAL DISTRICT REQUIREMENTS The requirement of the following special districts are hereby forwarded to the applicant: Sani. 1. Developer shall contact the Costa Mesa Sanitary District at (949) 631-1731 for current district requirements. School 2. Applicant shall submit proof that applicable development fee has been paid to the Newport Mesa Unified School District (714 424- 5002) prior to the issuance of building permits.
