HomeMy WebLinkAbout99-22 - Authorizing access to sales and use tax records pursuant to Revenue and Taxation Code Section 7056252 RESOLUTION NO. 99-22 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, AUTHORIZING ACCESS TO SALES AND USE TAX RECORDS PURSUANT TO REVENUE AND TAXATION CODE SECTION 7056. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, the following City officials are hereby authorized to receive and review sales and use tax allocation information from the State Board of Equalization: Members of the City Council; Allan L. Roeder, City Manager; and Marc R. Puckett, Director of Finance, or his designee(s); and WHEREAS, the following independent contractor for the City of Costa Mesa is hereby authorized to receive and review sales and use tax data received from the State Board of Equalization: Hinderliter, de Llamas and Associates; Robert Hinderliter, Principal; and Lloyd de Llamas, Principal; and WHEREAS, the City of Costa Mesa hereby certifies that Hinderliter, de Llamas and Associates has a current confidentiality contract with the City of Costa Mesa to receive sales and use tax records; is required by that contract to disclose information contained in, or derived from, those sales and use tax records only to an officer or employee of the City of Costa Mesa who is authorized by this resolution to examine the information; is prohibited by that contract from performing consulting services for a retailer during the term of that contract; and is prohibited by that contract from retaining the information contained in, or derived from, those sales tax records after that contract has expired; and WHEREAS, information obtained by examination of board of records shall be used only for purposes related to the collection of local sales and use taxes by the Board of Equalization for municipal revenue forecasting and verification; NOW, THEREFORE, BE IT RESOLVED by the Costa Mesa City Council that this resolution supersedes all previous authorizations. BE IT FINALLY RESOLVED that upon adoption of this resolution, a certified copy of such be sent to Mr. Jim Munekawa, State Board of Equalization, 2014 "T" Street, Suite 220, Sacramento, California 95814.
